HomeMy WebLinkAboutOrdinance 4411 ORDINANCE N0, OFftCthl RECORD tial �CR�TARy 10T ORDINANCE ORDERING A SPECIAL HOME-RULECTION IN T � , p" � k , �� ' E B CITY OF FORT WORTH, TEXAS, TO BE HELD ON TUESDAY, THE 24TH DAY OF JANUARY, 1961, FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED VOTERS OF SAID CITY, FOR ADOPTION OR REJECTION, A PROPOSED AMTENMTT TO THE EXISTING CHARTER OF THE CITY OF FORT WORTH PROVIDING FOR THE ESTABLISH AND OPERATION OF A PARK AND RECREATION BOARD CONSISTING OF NINE (9) MEMBERS, TO BE 19TOWN AS THE PAFJ� AND RECREATION BOARD OF THE CITY OF FORT WORTH," IN LIEU OF THE PRESENT PARK BOARD AND RECREA- TION BOARD HERETOFORE PROVIDED FOR IN CHAPTERS XVIII AND XIX, RESPECTIVELY, OF THE CHARTER OF SAID CITY, WHICH CHAPTERS SHALL BE REPEALED, SAVE AND L7KCE2T SECTIONS 4 THEREOF; PRO- VIDING THAT THE JURISDICTION, POWERS AND DUTIES HERETOFORE CONFERRED OF, IMPOSED UPON SAID BOARDS BY THE PROVISIONS OF SECTIONS 4 OF SAID CHAPTERS SHALL BE VFSTED IN AND ASSUI2D AND PERFORM BY THE PARK P21D RECRF ATION BOARD AUTHORMD TO BE ESTABLISHED; AND PROVIDING THAT THE CITY COUNCIL, WHEN LEVYING THE TAXES FOR EACH FISCAL YEAR, SHALL LEVY AN ANNUAL AD VALOREM TAX OF NOT LESS THEFT =VM CENTS (11¢x) ON EACH ONE HUNDRED DOLLARS (100.00) OF ASSESSED VALUE OF ALL REAL AND PERSONAL PROPERTY. INT , CITY NOT M[MVIPT FROM TAXATION BY THE CONSTITUTION AND LAWS OF THE STATE FOR THE USE AND BENEFIT OF THE PARK AND RECREATION BOARD; DESIGNATING THE PLACES AT WHICH SAID ELECTION IS TO BE HELD; APPOINTING PRE- SIDING OFFICERS T ,OF; AND DECLARING AN M a GENCY. WHERE,S, on Friday, the 18th day of November, 1960, an ordinance was duly passed by the City Council of the City of Fort Worth, Texas, giving due notice, in strict compliance with the statutes of the State of Texas and the Charter of the City of Fort Worth, Texas, of its intention to pass an ordinance providing for the submission to the qualified voters of the said City of Fort Worth of a proposed amendment to the existing Charter; and, WHEREAS, said notice of intention to submit such charter amendment was duly given by publication in the Fort Worth Star-Telegram, a newspaper published daily in the City of Fort Worth and the official newspaper of said City, which notice was published for ten (10) days, the date of the first publication thereof beim not less than twenty (20) days next pre- ceding the date of this ordinance; and, WHEREAS, the City Council of the City of Fort Worth, in the exercise of the discretion reposed in it by the Constitution and laws of this State relating to the amendment of city charters by cities having more than five thousand (5,000) inhabitants, deems it wise and expedient to submit the proposed amendment to the existing Charter of said City, hereinafter set forth, at a special election to be held in said city on Tuesday, the 24th day of January, 19613 and, WHEREAS, it appears that no regular municipal election will be held in said City within the time specified in Article 1166 of Vernon's Civil Statutes after the passage of this ordinance; NOW., THEREFORE, BE IT ORDIMTED BY THE4 CITY COUNCIL OF THE CITY OF, FORT WORTH, TEXAS: SECTION 1. That a special election be held in the City of Fort Worth, Texas, on Tuesday, the 24th day of January, 1961, for the purpose of submitting to the qualified voters of said City, for adoption or rejection, the fol- loving Proposed amendment to the existing Charter of the City of Fort Worth: AMENDKM Shall the Charter of the City of Fort Worth be amended by adding to Chapter _XXVIII thereof a new section to read as follows: Section 412. Within thirty (30) days after the adoption of this amendment., the City Council of the City of Fort Worth shall provide by ordinance for the establishment and opera- tion of a park and recreation board consisting of nine (9) members., to be known as the "Park and Recreation Board of the City Of Fort Worth," in lieu of the present Park Board and Recreation Board heretofore provided for in Chapters XVIII and XIX, respectively, of the Charter of said city, which chap- ters are hereby repealed, save and except Sections 4 thereof. The jurisdiction, powers and duties heretofore conferred or im- posed upon said Boards by the provisions of Sections 4 of said chapters shall be vested in and assumed and per-formed by the Park and Recreation Board hereby authorized to be established. The City Council, when levying the taxes for each fiscal year, shall levy an annual ad valorem tax of not less than eleven cents (14) on each one hundred dollars ($100.00) Of assessed value of all real and personal property in the City not exempt from taxation by the Constitution and laws of the State for the use and benefit of the Park and Recreation Board. In addition thereto, said Park and Recreation Board shall be allowed all the receipts and revenues arising from the opera- tion of the various park and recreation grounds and facilities vdthin the jurisdiction of the Park and Recreation Board and whatever further amount, if any, the City Council may, in its discretion, set apart in the annual budget for the use and bene- fit of the Park and Recreation Board. All debts and liabilities heretofore created by the previous Park Board and the previous Recreation Board operat- ing under the provisions of Chapters X=I and xix of the Charter shall be assumed by the Park and Recreation Board here- in authorized to be established by ordinance, and the funds accruing to said Park and Recreation Board from the sources hereinbefore specified, or so much thereof as may be necessary, shall be used in the payment and discharge of the said debts and liabilities.? SECTION 2. That the polling places and presiding officers of said election shall be' respectively, as follows; PRECINCT LOCATION JUDGE SECTION J. That said election shall be held in the manner and within the hours prescribed for general elections by the laws of the State of Texas so far as they may be practicable, and all persons qualified to vote in said City under the laws of this State regulating general elections shall be .allowed to vote. SECTION 4. That it shall be the duty of the City Secretary to prepare the offi- cial ballot, on which official ballot shall appear the Proposed amendment set out in Section 1 of this ordinance, and after said proposed amendment shall be printed the words "Yes" - "No" in order that the voters may vote "Yes"" or "Noll on Said proposed amendment. SECTION 5. That all voters desiring to vote for the adoption of said proposed amendment shall permit to remain on their ballot the word "Yes," and .those opposed shall permit to remain on their -ballot the word "No." SECTION 6. That the City Secretary shall, in accordance with the provisions of Article 1170 of Vernon's Civil Statutes, mail a copy of the proposed amend- ment to every qualified voter in the City of Fort Worth as appears from the rolls of the Tax Assessor-Collector for the year ending January 31, 1060. SECTION 7. That a copy of this ordinance shall be sufficient notice of said elec- tion, and thirty (30) days' notice of the time and places of holding the said election shall be given by publication of such notice in the official newspaper of said City each week for four (4) weeks, the date of the first publication being not less than thirty (30) full days prior to the date of the election. SECTION 8. That the proposed amendment as is set forth hereinabove, if approved by a majority of the qualified voters voting upon said amendment, shall become a part of the Charter of the City of Fort Worth as soon as an official order and ordinance has been entered on the records of said City by the governing body thereof declaring the same adopted. SECTION 9.
