AND PUBLIC PLACES IN THE CITY OF FORT WORTH, TEXAS, DECLARING THE CONTRACT WITH TEXAS BITULITHIC COMPANY FOR THE CONSTRUCTION OF SAID IMPROVEMENTS FULLY COMPLETED AND PERFORMED; DIRECTING THE ISSUANCE, EXECUTION AND DELIVERY OF CERTIFICATES IN EVIDENCE OF SPECIAL ASSESSMENTS LEVIED AFTER GIVING EFFECT TO SUNDRY CREDITS HEREIN AUTHORIZED AND ALLOWED AGAINST SOME OF SAID ASSESSMENTS; DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL OF FORT WORTH, TEXAS, AND BY FILING THE COMPLETE ORDINANCE IN THE APPROPRIATE ORDINANCE RECORDS OF ;SAID CITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Fort Gu'orth, Texas, has heretofore entered into a contract with Texas Bitulithic Company for the making and construction of certain street improvements on the hereinafter described portions of streets, avenues and public places in said City, to-wit: 1. ELLIS AVENUE: From the northerly line of N.W. Twenty- Third Street to the southerly line of N.W. Twenty-Fifth Street, known and designated as Unit No. 6. WHEREAS, by sundry proceedings heretofore passed by the City Council of the City of Fort Worth, Texas, including Ordinance No. 4356, a portion ®€- the cost of said improvements was levied and assessed against the respective properties abutting on each of the above described portion of streets, avenues and public places and against the real and true owners thereof; and, VEEREAS, the City Council of the City of Fort Worth, Texas, has, upon review, found and determined that, in some instances, in order to effect substantial justice and equality, it is desirable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance No. 4356; and, WHEREAS, the street improvements hereinabove mentioned have been completed upon each of the portions of streets, avenues and public places hereinabove described, and have been inspected and found to be in complete accordance with the contract therefor; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT: I. The inprovements on each of the portions of streets, avenues and public places hereinabove described be, and they are hereby accepted, and the contract with reference thereto be, and it is hereby, found and declared fully completed and performed. II. The Mayor be, and he is hereby, directed to issue and execute in the name of the City, certificates in evidence of the special assessments levied against abutting property and the owners thereof for such improvements, and the City Secretary is directed to attest same and impress thereon the corporate seal of the City, all in accordance with the proceedings relating to such improvements and assessments. The certificates shall be numbered, shall describe the property against which the assess- ment has been levied, shall, where known, state the name or names of the true owners of the respective parcels of property assessed and shall be issued in the amount equal to the difference between the principal amount of the assessment and the amounts of -1- any credits issued thereon. The numbers of the certificates, with the property descriptions to be shown on the respective certificates, together with the names of the owners of said property, the principal amount of the assessment, the respective credits,, if any, which are hereby authorized, granted and allowed against the principal amount of some one or more of the assessments heretofore levied, and the principal amount for which each certificate is to be issued after giving effect to such credit, if any' are hereby enumerated and itemized as follows: -2- III. When each of the certificates have been duly executed as hereinabove provided, same shall be delivered to Texas Bitulithic Company as part payment of the contract price. IV. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Mlinute Book of the City Council of Fort Worth$ Texas, and by filing the complete ordinance in the appropriate Ordinance Records of said City. V. This ordinance shall take effect and be in full force and effect from and after the date of its passage. Construction teas been completed on Unit No. 6 - Ellis Avenue, 23rd Street to 25th Street, in accordance with plans and specifications. The contract price on this unit was $50,915.80 and the final contract cost is $47,510.014 The property owners' portion of the Last is $ 18,557.39 and the City's portion is $30,731 .03. The ,revision in roadway width to maintain existing retaining walls, miinor revisions to allow for construction transitions to adjacent property, and variations in contract quantities account for the reduction in the contract price. It is recommended that the project be accepted and Estimate No. 9 and final for Unit No. 6 in the amount of $11 ,339.23 be approved for payment.
