AN ORDINANCE AMENDING THE COMPREHENSIVE ZONING ORDINANCE N.O. 3011 , AS AMENDED; SAME BEING AN ORDINANCE REGULATING AND RESTRICTING THE LOCATION AND USE OF BUILDINGS, STRUCTURES AND LAND FOR TRADE, INDUSTRY, RESIDENCE, AND OTHER PURPOSES; BY, AMENDING SECTION 1 ., DEFINITIONS THEREOF; SECTION 2. , DISTRICTS THEREOF; SECTION 9.A, "FR" RESTRICTED COMMERCIAL DISTRICT; SECTION 10., "F" COMMERCIAL DISTRICT; SECTION 13. , "I" LIGHT INDUSTRIAL DISTRICT; SECTION 14. , "J" LIGHT INDUSTRIAL DISTRICT; -SECTION 15. , "K" HEAVY INDUSTRIAL DISTRICT; SECTION 19. , OFF-STREET PARKING AND LOADING REGULATIONS; SECTION 20., BOARD OF ADJUSTMENT; ADDING A NEW SECTION 2C, "MH" MOBILE H-OME PARK- DISTRICT; PROVIDING FOR INTERPRETATION, PURPOSE, AND CONFLICT; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES AFFECTING ZONING; PROVIDING A SAVINGS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENAL CLAUSE; AND NAMING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH: SECTION FIRST THAT SECTION I, DEFINITIONS, of the Comprehensive Zoning Ordinance, No. 3011 as amended, be and the same is hereby amended, by adding thereto the following definitions: "MOBILE HOME: A movable or portable dwelling constructed to be towed by a motor vehicle on its own chassis over Texas Roads and Highways under special permit;: connected to utilities, and designed with- out a permanent foundation, for year-round living. It may consist of one or more un its. that can be telescoped when towed and expanded later for additional capacity, or of two or more units separately towable but designed to be joined into one integral unit. "MOB.ILE HIOME PARK: A unified development of mobile home spaces arranged on a tract of land under single ownership, meeting all requirements of Ordinance 6293 and this Ordinance." SECTION SECOND THAT SECTION 2, DISTRICTS, SUBSECTION A, of the Comprehensive Zoning Ordinance No. 3011, as amended, be and the same is hereby amended, so that it shall hereafter include under Class l Special Purpose: 3. "MH" Mobile Home Park District or District "MH" and that the item numbers under Subsection A are hereby redesignated in the proper numerical sequence to incorporate said Item 3. SECTION THIRD THAT SUBPARAGRAPH 16 OF SECTION 9A, "F-R" RESTRICTED COMMERCIAL DISTRICT of the Comprehensive Zoning Ordinance, No. 3011 , as amended, is hereby amended so that same shall be and read as follows: 16. Trailer parks, but not including mobile home parks, when in compliance with the following performance standards: a) Located on a site which has frontage on a federal or state designated highway. b) The total fully developed and usable spaces shall be designed for and occupied only by dependent mobile homes. c) The term "dependent" has the meaning ascribed to it in the City of Fort Worth Health Code. -2- SECTION FOURTH THAT SUBPARAGRAPHS 5 AND 6 OF SECTION 10, "F" COMMERCIAL DISTRICT, of the Comprehensive Zoning Ordinance, No. 3011 , as amended, is hereby amended by deleting all reference to independent mobile homes and also deleting Item 6 in its entirety, so that same shall be and read as follows: 5. Trailer Park, but not including mobile home parks, when in compliance with the following performance standards: a) The total fully developed and usable spaces shall be. designed for and occupied only by dependent mobile homes. b) The term "dependent" has the meaning ascribed to it in the. City of Fort Worth Health Code. 6. Special exception uses when authorized by the Board of Adjustment under the provisions of Section 20. SECTION FIFTH THAT SUBPARAGRAPH 1 OF SECTION 131, "I" LIGHT INDUSTRIAL DISTRICT, of the Comprehensive Zoning Ordinance, No. 3011 , as amended, is hereby amended so that same shall b e and read as follows: 1 . Any uses permitted in the "H" District. Mobile Home Parks are excluded. Dwellings are excluded, except that a dwelling can be erected on a Lot of Record which was recorded prior to the adoption of this Ordinance. SECTION SIXTH THAT SUBPARAGRAPH 1 OF SECTION 14, "J" LIGHT INDUSTRIAL DISTRICT, of the Compre- hensive Zoning Ordinance, No. 3011 , as amended, is hereby amended so that same shall hereafter be and read as follows: 1 . Any use permitted' in the "I" Light Industrial District. Mobile Rome Parks are excluded. Dwellings are excluded, except a dwelling may be erected on a Lot of Record which was recorded prior to the adoption of this Ordinance. SECTION SEVENTH THAT SUBPARAGRAPH_ 1 OF SECTION 15, "K" HEAVY INDUSTRIAL DISTRICT, of the Comprehensive Zoning Ordinance, No. 3011, as amended, is hereby amended so that same shall be and read as follows: 1 . Any uses permitted in the "J" Light Industrial District, except that all dwellings are excluded and no mobile home park shall be permitted. SECTION EIGHTH THAT SUBPARAGRAPH 23 OF SECTION 19, OFF-STREET PARKING AND LOADING REGULATIONS, of the Comprehensive Zoning Ordinance, No. 3011 , as amended, is hereby amended so that same shall be and read as follows: 23. DEPENDENT MOBILE HOMES: For each dependent mobile home hereafter oc uc pled—as dwelling unit there shall be a minimum of two C2) off-street parking spaces furnished on premises. Such spaces shall be hard-surfaced and dust free. -3- SECTION. NINTH THAT SECTION 20, BOARD OF ADJUSTMENT, of the Comprehensive Zoning Ordinance, No. 3011 , as amended, is: hereby amended by deleting Item 20, "Mobile Home Park" , in its entirety. Ltem 21 , "Hotel", hereafter shall be designated as Item 20. SECTLON TENTH THAT the Comprehensive Zoning Ordinance No. 3011 , as. amended, be and the same is hereby amended by adding thereto SECTION 2-C - "MH" MOBILE HOME PARK DISTRICT which. shall be and read as. follows: SECTION 2-C "MH" MOBILE HOME PARK DISTRICT: The "MH" Mobile Home Park District is created as a district to accommodate only mobile home parks and their related uses as established in Ordinance No. 6293. A. Use Regulations: In the "MH" District, no building or land shall be used except as permitted in Ordinance No. 6293. B. Development Controls: It is intended by these regulations that development in the MH District shall be compatible with development in the district or districts which it adjoins. The following Items. 1 , 2, and 3, shall comply with. the requirements and regulations pertaining thereto established in Ordinance No. 6293. 1 . Height and Area 2. Yard Requirements. 3. Parking 4. Signs: An identifying sign may be permitted at each major entrance to the mobile home park except that no more than three signs shall be permitted for one park, and such signs shall be subject to the following provisions: a) Each sign shall contain only the identifying name of the park and its street address. b) Signs may be illuminated but the source of light shall not be visible and shall not be intermittent or flashing; revolving signs shall not be permitted. Signs. shall not be lighted between the hours of ten (10:00) P.M. and six (6:00) A.M. c) Such signs may be free standing but shall have not more than two supports and the top of the sign shall be no more than eight (8') feet above grade. d) Each sign shall be single-face and shall be limited to a maximum area of twelve (12) square feet. e) All signs must conform with the setback requirements of buildings within the park, from all public streets, except that such signs may be attached flat against a wall or fence surrounding the mobile home park, no portion of which shall extend into the public right-of-way. SECTION, ELEVENTH THAT the zoning regulations and districts, as herein established, have been made in accordance with the comprehensive plan for the purpose of promoting health, safety, morals and the general welfare of the community. They have been designed to lessen congestion in the streets; to secure safety from fire, panic, flood and other dangers; to provide adequate light and air; to prevent over-crowding of land, to avoid undue concentration of population; to facilitate the adequate provisions of transportation, water, sewerage, parks and other public requirements. They have been made after a full and complete public hearing with reasonable consideration, among other things, of the character of the district and its peculiar suitability for the particular uses and with a view of conserving the value of buildings and encouraging the most appropriate use of land throughout the community. SECTION TWELFTH THAT this ordinance shall be cumulative of all other ordinances of the City of Fort Worth effecting zoning and shall not repeal any of the provisions of said ordinances except in those instances where provisions of t4ose ordinances are in direct conflict with the provisions of this ordinance. SECTION THIRTEENTH THAT all rights or remedies of the City of Fort Worth, Texas, are expressly saved as to any and all violations of Ordinance No. 3011 or of any amendments thereto, of said City of Fort Worth, Texas, that have accrued at the time of the effective date of this ordinance; and as to such accrued violations, the court shall have all the powers that existed prior to the effective date of this ordinance; and that all existing violations of Ordinance No. 3011 , as amended, which would otherwise become non-conforming uses under th.is ordinance, shall not become legal non-conforming uses under this ordinance but shall be considered as violations of this ordinance in the same manner that they were violations of Ordinance No. 3011 , as amended, of said city. SECTION FOURTEENTH THAT it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared void, ineffective, or unconstitutional by the valid judgment or final decree of a court of competent jurisdiction, such voidness, ineffectiveness, or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections hereof, since the same would have been enacted by the City Council without the incor- poration herein of any such void, ineffective or unconstitutional phrase, clause, sentence, paragraph or section. SECTION FIFTEENTH THAT any person, firm or corporation who violates, disobeys, omits, neglects, or refuses to comply with or who resists the enforcement ofany of the provisions of this ordinance shall be fined not less than Five and No/100 Dollars ($5.00) nor more than Two Hundred and No/100 Dollars ($200.00) for each offense. Each day that a violation is permitted to exist shall constitute a separate offense. SECTION SIXTEENTH THAT this ordinance will take effect and be in full force and effect from and after its passage and publication as required by law.
