HomeMy WebLinkAboutOrdinance 7611 ORDINANCE NO, -7 6 ORDINANCE ACCEPTING IMPROVEMENTS ON A PORTION OF BASIL AVENUE AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES IN THE CITY OF FORT WORTH, TEXAS; DECLARING THE CONTRACT WITH SRA 'RT 11,13MIC CQMM FOR THE CONSTRUCTION OF SAID IMPROVEMENTS FULLY COMPLETED AND PERFORMED; DIRECTING THE ISSUANCE, EXECUTION AND DELIVERY OF CERTIFICATES IN EVIDENCE OF SPECIAL ASSESSMENTS LEVIED AFTER GIVING EFFECT TO SUNDRY CREDITS HEREIN AUTHORIZED AND ALLOWED AGAINST SOME OF SAID ASSESSMENTS; DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL OF FORT WORTH, TEXAS, AND BY FILING THE COMPLETE ORDINANCE IN APPROPRIATE ORDINANCE RECORDS OF SAID CITY; AND PROVIDING AN EFFECTIVE DATE, WHEREAS, the City of Fort Worth, Texas, has heretofore entered into a contract with Texas Bitulithic Company , for the snaking and construction of certain street improvements on the hereinafter described portions of streets, avenues and public places in said City, to-vit.- UNIT o-vitoUNIT is BASIL AVENUE From Grady Lee Street to California Parkway South, known and designated as Project No. 104-24000-260, Unit 1. UNIT 2 : CAMILLA STREET From Essex Street to Beach Street, known and designated as Project No. 104-24000-260, Unit 2. UNIT 3 : FRANCIS DRIVE From West Elixabeth Lane to Doreen Avenue, known and designated as Project No. 104-24000-260, Unit 3, WH MS, by sundry proceedings heretofore passed by the City Council of the City of Fort Worth, Texas, including Ordinance No. 7403 , a portion of the cost of said improvements was levied and assessed against the respective properties abutting on each of the above described portions of streets, avenues and public places and against the real and true owners thereof; and, W=AS, the City Council of the City of Fort Worth, Texas, has, upon re— view, found and determined that, in some instances, in order to effect substantial justice and equality, it is desirable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance No. 74039 and ?SEAS, the street improvements hereinabove mentioned have been completed upon each of the portions of streets, avenues and public places hereinabove described, and have been inspected and found to be in complete accordance with the contract therefor; NOW, TH71LEFORE, BE IT OR DAIN30 BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT: I. The improvements on each of the portions of streets, avenues and public places hereinabove described be, and they are hereby, accepted; and the contract with re— ference thereto be, and it is hereby, found and declared fully completed and performed. II. The Mayor, be, and he is hereby, directed to issue and execute in the name of the City, certificates in evidence of the special assessments levied against abutting property and the owner thereof for such improvements, and the City Secretary is directed to attest same and impress thereon the corporate seal of the City, all in accordance with the proceedings relating to such improvements and assessments. The certificates shall be numbered, shall describe the property against which the assessment has been levied, shall, where known, state the name or names of the true, owners of the respective parcels of pro— perty assessed and shall be issued in an amount equal to the difference between the principal amount of the assessment and the amounts of any credit issued thereon. The numbers of the certificates, with the property descriptions to be shown on the respective certifi— cates, together with the names of the owners of said property, the principal amount of the assessment, the respective credits, if any which are hereby authorized, granted and allowed against the principal amount of some one or more of -the assessments heretofore levied, and the principal amount for which each certificate is to be issued after giving effect to such credit, if any, are hereby enumerated and itemized as follows: r IZIe When each of the certificates has been duly executed as hereinabove provided, same shall be delivered to the Tax Assessor-Collector as part payment of the contract price. IV. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council of Fort Worth, Texas, and by filing the complete ordinance in the appropriate Ordinance Records of said City. V. This ordinance shall take effect and be in full force and effect from and after the date of its passage. Six-inch thick concrete driveways and four-foot wide concrete sidewalk will be constructed where specified. Contract No. 8891 Dated July 19, 1976 Contractor: Texas Bitulithic Company Contract Awarded: July 19, 1976 (M&C C-3462) Work Order Issued: October 18, 1976 Work Order Effective: November 1, 1976 Work Began: November 1, 1976 Project Substantially Complete and Final Inspection: May 19, 1977 Final Construction Approval: Working Time Bid: 50 Working Days Working Time Used: 43 Working Days Project Cost and Financing Original Bid Price: $43,542.90 Final Contract Cost: $43,539.25 Partial Payments Previously Made: 7 Amount: $39,185.33 Final Payment Due: $4,353.92 Final Payment to be made from Project No. 104-24000-260. An engineering cost overrun was experienced on this project due to the required redesigning of Camilla Street to better accommodate the Colonial Manor Rest Home expansion, on which construction started after the contract was awarded on this project. Colonial Manor is located on both sides of Camilla Street at Beach Street. A bond fund transfer in the about of $3,700 is required to supplement the project account in order to make the final payment to the contractor. Deviation from the Bid Price: Minor Deviation of $3.65 Compliance with Specifications: Tests made during construction show materials used and required thicknesses were in compliance with Contract Specifications. Recommendations It is recommended that (1) A Bond Fund Transfer in the amount of $3,700 be made from Assessment Paving Unspecified (104-24000-901) to Assessment Paving at Three Miscellaneous locations (104-24000-260) and (2) That the Project described be accepted by the Adoption of an Ordinance and Final Payment of $4,353.92 be made to Texas Bitulithic Company.
