AN ORDINANCE VACATING AND EXTINGUISHING PORTIONS OF
CEDAR STREET AND AN ALLEY, SITUATED IN BLOCK 89 OF THE
TEXAS AND PACIFIC RAILWAY COMPANY ADDITION, AN
ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY,
TEXAS; AS RECORDED IN VOLUME 63, PAGE 107 OF THE PLAT
RECORDS OF TARRANT COUNTY, TEXAS AND CONTAINING
APPROXIMATELY RESPECTIVELY 16,025.19 AND 7,996.20 SQUARE
FEET ACRE OF LAND MORE OR LESS; PROVIDING FOR REVERSION
OF FEE IN SAID LAND; PROVIDING THAT THE CITY SHALL RETAIN
ALL EXISTING UTILITIES EASEMENTS; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That a portion of Cedar Street situated the southeast corner of Block 89 of the Texas and
Pacific Railway Company Addition, an addition to the City of Fort Worth, Tarrant County, Texas
as recorded in Volume 63, Page 107 of the Plat Records of Tarrant County, Texas, containing
approximately 16,025.19 square feet or 0.3679 acre of land more or less, and as more specifically
described in Exhibits "A" and "B" attached hereto and incorporated herein by reference be and
the same is vacated and extinguished.
SECTION 2.
That a twenty (20) foot alley right-of-way lying between Poplar Street and Cedar Street,
situated in the northeast corner of Block 89 of the Texas and Pacific Railway Company Addition,
an addition to the City of Fort Worth, Tarrant County, Texas, as recorded in Volume 63, Page
107 of the Plat Records of Tarrant County, Texas, and containing approximately 7,996.20 square

feet or 0.1836 acres of land more or less, and as more specifically described in Exhibits "C" and
"D" attached hereto and incorporated herein by reference be and the same is vacated and
extinguished.
SECTION 3.
That the easement to the land in the above-described vacated street right of way is hereby
released and shall revert to the adjacent owner as provided by law.
SECTION 4.
All existing utility easement be shall be retained by the City until such time all utilities
located in that easement are relocated at the owner's expense.
SECTION 5.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 6.
That this ordinance shall take effect upon adoption.

Adopt Ordinance Vacating a Portion of Cedar Street and an Alley in Block 89, Texas and Pacific Railway
Addition, to be Replatted by Paulos Properties, LLC, American Can! and Presbyterian Night Shelter TC
with the Adjoining Property to Provide Additional Security and Parking for the Lancaster Lofts (COUNCIL
DISTRICT 8)
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached ordinance vacating a portion of Cedar Street and an alley in Block 89, Texas and
Pacific Railway Addition, to be replatted by Paulos Properties, LLC, American Can! and Presbyterian
Night Shelter TC with the adjoining property to provide additional security and new parking for the
Lancaster Lofts; and
2. Waive any and all purchase fee value of the vacated land in accordance with City Policy.
DISCUSSION:
James DeOtte Engineering, Inc., on behalf of Paulos Properties, LLC, American Can! and Presbyterian
Night Shelter TC, has requested the vacation of these rights-of-way to be replatted with the adjoining
property to provide better security and additional parking for the residents of the Lancaster Lofts. The City
Plan Commission recommended approval of this request at its meeting on August 27, 2014. An
acceptable final plat (FS-14-216) has been received in accordance with the Subdivision Ordinance.
Vacation of these rights-of-way will create block faces in excess of the 500 foot maximum and a block
perimeter in excess of the 1600 foot maximum in this MU-2 zoned area. The City Plan Commission
approved a waiver of these conditions on October 28, 2015.
The City of Fort Worth (City) originally obtained the above mentioned rights-of-way through the platting
process. The City does not own any fee interest in the rights-of-way or own any property adjacent to the
rights-of-way and did not expend any City funds to purchase the right-of-way easements. In accordance
with the City's policy regarding street and alley vacation transactions approved by the City Council on
March 6, 2007 (M&C G-15624), Staff recommends waiving the fair market value or any portion thereof of
purchase price of the right-of-way easements for the streets and alley.
This project is located in COUNCIL DISTRICT 8, Mapsco 77B.
This M&C does not request approval of a contract with a business entity.

The Financial Management Services Director certifies that approval of these recommendations will have
