HomeMy WebLinkAboutOrdinance 9884. , ORDINANCE N0. -~~ ~ AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTIN- GUISHING CERTAIN EASEMENTS IN THE WEST PLAZA ADDITION TO THE CITY OF FORT WORTH IN THE HAYS COVINGTON SURVEY, TARRANT COUNTY, TEXAS, DESCRIBED MORE SPECIFICALLY HEREIN; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVID- ING AN EFFECTIVE DATE.. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1. That the emergency access and utility easement described in Exhibit "A" hereto, the utility easements described in Exhibits "B", "C" and "D" hereto, and the sanitary sewer easement described in Exhibit "E" hereto, each of said easements having been acquired by dedication and being variously located in the West Plaza Addition to the City of Fort Worth, the plats of said Addition being recorded in Volume 388-137, Pages 28-29, or Volume 388-199, Page ']',5 , of the Plat Records of Tarrant County, Texas, or in the Hays Covington Survey, Tarrant County, Texas, the descriptions in said Exhibits being incorporated herein by reference for all purposes, be and the same are vacated, abandoned and permanently closed and extin- g ui shed . BLOCK 2, LOTS D AND B-1 - CHERRY LANE, POIiCEE ADMINIB~RAaOSV.Y1 SOUTH OF HIGHWAY I-30 PARE" ADIRINISI~' Tr,'. ~~ Recommendation. ri. .J It is recommended that the City Council adopt an Ordinance vacating a 26' wide emergency access and utility easement (EA & UE), located on Lot D, Block 2, West Plaza Addition, as recorded in Volume 388-199, Page 55, P.R.T.C.T.; a utility easement centered on the common property line (10' total width) of Lots D and B-1, Block 2, West Plaza Addition, and along the westerly property line (5' total width) of Lot D, Block 2, West Plaza Addition, as recorded in Volume 388-137, Pages 28 and 29, and Volume 388-199, Page 55, P.R,T.C.T.; a 15' x 38' utility easement located adjacent to the north property line of Lot D, Block 2, West Plaza Addition, approximately 157' west of Cherry Lane and a 15' x 59.43' utility easement (north/south) located between the southerly property lines of Lots B-1 and 8-3, Block 2, West Plaza Addition, as recorded in Volume 388-199, Page 75, and Volume 388-137, Page 28, P.R.T.C.T., located approximately 160' west of Cherry Lane; and a 15' wide sanitary sewer easement located near the easterly and northerly property lines of Lot D, Block 2, West Plaza Addition, created out of a tract of land described by deed to Mariner Economy Lodging Corporation, as recorded in Volume 8382, Page 1721, D.R.T,C.T. Discussion Dun away Associates, Agents on behalf of Mariner Limited Service Hotel Corporation (Archie Bennett, Jr. - President) and Target Stores (Edward J. Bierma - Uice President), owners of abutting properties, have requested that the City vacate the above-described, as shown on the attached map. The subject easements, acquired by dedication, are platted and contain sewe r and telephone utility facilities. The subject vacation request is made in order to replat the vacated easements with adjacent property, to expand the building area and provide more usable yard space and readjust the location of the subject easements with a replat of the subject property. The required and appropriate monetary consideration has been placed in escrow with the Real Property Department, as required by the Land Agent for the City of Fort Worth. Reviewing City departments and private utility companies have raised no objections to this request, subject to the vacated easements being replatted with adjacent property.
