CITY SECRETARY CONTRACT NO. 44614
INTERLOCAL COOPERATION AGREEMENT
This Amendment is entered into by and between the City of Fort Worth (hereafter
"City"), a home rule municipal corporation organized under the laws of the State of Texas, with
its principal place of business at 1000 Throckmorton Street, Fort Worth, Texas, and Tarrant
County, acting on behalf of the Tarrant County- Medical Examiner's Office, hereinafter
"County"
WHEREAS, City and County entered into an Interlocal Agreement for Forensic
Laboratory Services identified as Fort )Vorth City Contract No. 44614 ("Agreement") for a
period of one year beginning October 1, 2012, which automatically renews from year to year
subject to appropriations of City funds for this Agreement; and
WHEREAS, City and County entered into the First Amendment to the Agreement,
which increased the overall contracted amount payable to County by City for services provided
under the Agreement;
WHEREAS, City and County entered into the Second Amendment to the Agreement,
which renewed the term of the Agreement and incorporated an agreed upon fee schedule;
WHEREAS, it is the collective desire of both City and County to renew the term of the
Agreement and amend the Agreement for Forensic Laboratory Services by increasing the overall
contracted amount that may be paid by City to County for services under this Agreement; and
NOW, THEREFORE, City and County, acting herein by the through their duly
authorized representatives, hereby amend the Agreement:
1.
Deleting the current text of Section 3 "Payment for Services" as amended by the First
Amendment to the Agreement and replacing it with the following:
Upon completion of the work by County, City will pay County in accordance with the
approved agreed upon fee schedule for the Services. The agreed upon fee schedule (Effective
October 1, 2014 through September 30, 2016) is attached and incorporated within as Exhibit A.
Payment will be made by City to County within thirty (3 0) days of receipt of County's invoices.
Each invoice shall be accompanied by sufficient documentation as required by City. However,

total payments by City during the term of this Agreement shall not exceed $350,000.00 (three
hundred and fifty thousand dollars), City- shall be solely responsible for monitoring payments
under this Agreement, and the not-to exceed amount shall not relieve City of its obligation to pay
County for Services rendered at City's request. County shall provide at least thirty (30) days
advance written notice of any changes in the fee schedule for any of the Services performed
under this Agreement. Any change to the fee schedule, if approved by the City, will be
incorporated within this Agreement as a replacement to Exhibit A. Any changes in the fee
schedule that require an increase in the not-to exceed amount of funding for this Agreement shall
be approved by written amendment to this Agreement by both the City and County.
2.
Section 4, Term. The term of the Agreement is hereby renewed. The current term will
expire on September 30, 2016,unless terminated earlier in accordance with the Agreement.
3.
All other provisions of the Agreement which are not expressly amended herein shall
remain in full force and effect.

HEARING:
SUBJECT: Authorize Execution of Amendment No. 3 to City Secretary Contract No. 44614 with
Tarrant County in the Amount of$150,000.00 for a Total Contract Amount of$350,000.00
for Forensic Laboratory Services to Increase the Contract Authority(ALL COUNCIL
DISTRICTS)
RECOMMENDATION:
It is recommended that the City Council authorize the execution of Amendment No. 3 to City Secretary
Contract No. 44614 with Tarrant County for forensic laboratory services to increase the contract
authority in the amount of$150,000.00 for a total contract amount of$350,000.00.
DISCUSSION:
On April 2, 2013, the City Council authorized (M&C C-26186) the execution of a one year Interlocal
Agreement (Agreement) with Tarrant County for forensic laboratory services in the amount of
$50,000.00. The Agreement includes options to renew for subsequent years of service.
On November 19, 2013, the City Council authorized (M&C C-26566) the execution of Amendment No.
1 to City Secretary Contract No.44614,which increased the total contract amount to$150,000.00.
Amendment No. 2 to City Secretary Contract No. 44614, which was administratively authorized,
renewed the term of the Agreement and incorporated a new fee schedule.
Staff recommends amending City Secretary Contract No. 44614 to increase the contract authority
under the Agreement in the amount of$150,000.00 for a total contract amount of$350,000.00. The
increase in contract authority will fulfill two important objectives. First, the increased authority will
compensate Tarrant County for processing the backlog of cases needing forensic analysis. Second,
the increased authority will address the City's growing need for additional forensic laboratory
services. Historically, the City utilized Cellmark Forensics for DNA analysis. Cellmark Forensics
recently relocated to Virginia. The City's continued use of Cellmark Forensics would likely result in
additional court and travel related costs.
Staff recommends using Tarrant County to perform the DNA analysis previously performed by Cellmark
Forensics and allowing Cellmark Forensics to continue working on specialized cold cases. If the
contract authority is increased, funds currently allocated to Cellmark Forensics for DNA analysis will be
used to compensate Tarrant County for the additional services.
Pursuant to Article 49.25 of the Texas Code of Criminal Procedure, a medical examiner may charge
reasonable fees for its services.
M/WBE OFFICE-A waiver of the goal for MBE/SBE subcontracting requirements was requested by
the Police Department and approved by the MANBE Office, in accordance with the BDE Ordinance,
because the purchase of goods and services is from sources where subcontracting or supplier
opportunities are negligible.

ADMINISTRATIVE CHANGE ORDER-An Administrative Change Order or increase may be made by
the City Manager in the amount of up to$50,000.00 and does not require specific City Council approval
as long as sufficient funds have been appropriated.
FISCAL INFORMATION/CERTIFICATION:
The Financial Management Services Director certifies that funds are available in the current operating
budget of the Police Department in the General Fund and that prior to an expenditure being made, the
Police Department is responsible for verifying the availability of funds.
