AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTIN- GUISHING THE UTILITY EASEMENTS DESCRIBED MORE SPECIFICALLY HEREIN, SAID UTILITY EASEMENTS LYING WITHIN THE ALTA MERE ADDITION TO THE CITY OF FORT WORTH; REPEALING ALL ORDI- NANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. + BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1. That, 1) the 8-foot x 360-foot north/south utility easement located on and adjacent to the east boundary of Lots 1-6 and the west boundary of Lots 13, 14, 15R, 16R, 17R and 18, and 2) the 362.62-foot x 8=foot east/west utility easement located on and adjacent to the north boundary of Lots 7-12 and the south boundary of Lots 6 and 13, both of said easements being located in Block 30 of the Alta Mere Addition to the City of Fort Worth, Texas, and being shown on the plat of said addition recorded in Volume 1037, Page 413 of the Deed Records of Tarrant County, Texas, and Volume 388-0, Page 265 of the Plat Records of Tarrant County, Texas, be and the same are vacated, abandoned and permanently closed and extinguished. SECTION 2. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. ~ S~-~4- r~. ' SECTION 3. NUMBER ALTA MERE' ADDITION, BLOCK 30, LOTS 1 ~-9-87 **PZ-1464 1-14, 15R-17R AND 18 U.S. HWY. 80 >or-_.__ ~...... - I.ICCT /1 ~In AAAA/1111 T A~ ~1nT111- RECOMMENDATION: It is recommended that the City Council adopt an Ordinance vacating a north/south 8'x360' utility easement located adjacent to and between lots 1-6, and 13, 14, 15R, 16R, 17R and 18; and an east/west 362-62' x 8' utility easement located adjacent to and between Lots 7-12 and 6 and 13, both in Block 30, Alta Mere Addition, as recorded in Volume 1037, Page 413, D.R.T.C.T. and Volume 388-0, Page 265 P.R.T.C.T. DISCUSSION. E.L Gummelt, on behalf of Lowe's Companies, Inc owner of abutting property, has requested that the City vacate the above-described utility easements, as shown on the attached map. The subject easements, acquired by dedication, are platted but contain no utility facilities. The subject vacation request is made in order to utilize the vacated easements as part of the subject property, thus expanding the building area and providing more usable yard space. The required and appropriate monetary consideration has been placed in escrow with the Real Property Department, as required by the Land Agent for the City of Fort Worth. Reviewing the City depart~nents and private utility companies have raised no objections to this request. A satisfactory replat has been submitted.
