MOODY ADDITION MORE SPECIFICALLY DESCRIBED HEREIN; PROVIDING FOR REVERSION OF FEE IIQ SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the alley and the portions of the public streets described below and shown on the plat of the J. M. Moody Addition to the City of Fort Worth, said plat being recorded in Volume Page of the Records of Tarrant County, Texas, be and the same are vacated, abandoned and permanently closed and extinguished: 1. The north/south alley lying between and adjacent to Lots 1-12, Block 17, J. M. Moody Addition to the City of Fort Worth; 2. The sixty-foot (60') right-of-way lying between and adjacent to Blocks 8 and 17, J. M. Moody Addition to the City of Fort Worth, said right-of-way being the portion of N.E. 29th Street from Hutchinson Street to Oscar Avenue; and 3. The sixty-foot (60') right-of-way lying between and adjacent to Blocks 16 and 17, J. M. Moody Addition to the City of Fort Worth, said right-of-way being the portion of Hutchinson Street from N.E. 29th Street to Dewey Street. SECTION 2. That the fee to the land in the above described vacated alley and public streets and rights-of-way are hereby released and shall revert to the adjacent owners as provided by law, SAVE AND EXCEPT that easements are retained for any and all existing and prospective utilities and any and all existing and prospective drainage require- ments, as necessary. v ~-;6~ ~\ ` ~ ~,. .. SECTION r3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so or- dained. Moody Addition, adjacent to and between Lots 1-12, from N.E. 29th Street to Dewey Street, an eastlwest portion of N.W. 29th Street (60' right-of-way) adjacent to and between Blocks 17 and 8, J.M. Moody Addition, from Hutchinson Street to Oscar Avenue, and a northlsouth portion of Hutchinson Street (60' right-of-way) adjacent to and between Blocks 17 and 16, J.M. Moody Addition, from N.E. 29th Street to Dewey Street, as recommended by the City Plan Commission. Discussion The Fort Worth Independent School District, with the consent of other adjacent property owners, is requesting that the City vacate the three (3} above-described rights-of-way, as shown on the attached map. The subject streets and alley rights-of-way, acquired by dedication, are open on the ground and contain water and sewer utility facilities. The subject vacation request is made in order to replat the vacated right-of-way with adjacent property, to expand the building area and provide more usable yard space. The City Land Agent has determined that this land area is part of a land exchange between the City and the applicant and that the fair market value of the land vacated will be received by virtue of the exchange, therefore, no monetary fee is required from the proponent. Reviewing City departments and private utility companies have raised no objections to this request, subject to the vacated rights-of-way being replatted with adjacent property and any required utility easements being retained. A satisfactory replat has been submitted.
