AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTIN- GUISHING THE EASEMENTS SPECIFICALLY DESCRIBED HEREIN, LOCATED IN THE NORTHEAST INDUSTRIAL ADDITION; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: R SECTION 1. That the following utility easements which are shown in more specific detail on the plat of the Northeast Industrial Addition to the City of Fort Worth, said plat being recorded in Volume 388-169, Page 50 of the Plat Records of Tarrant County, Texas, be and the same are vacated, abandoned and permanently closed and extinguished: 1. A five-foot (5') wide utility easement located within Lot 2, Block 4, Northeast Industrial Addition, and adjacent to the south property line of said lot; 2. A ten-foot ( 1 0' ) wide utility easement, the centerline of said easement being the common property line of Lots 1 and 2, Block 4, Northeast Industrial Addition, said common property line being the south boundary line of said Lot 1 and the north boundary line of said Lot 2; and 3. A ten-foot (10') wide utility easement, the centerline of said easement being the common property line of Blocks 3 and 4, Northeast Industrial Addition, said common property line being the south boundary line of said Block 3 and the north boundary line of said Block 4. SECTION 2. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. ~i Wt_- 4 ~ a .. _ , ,.:~ SECTION 3. REFERENCE suB~ECTVACATION OF UTILITY EASEMENTS PAGE NUMBER NORTHEAST INDUSTRIAL PARK, BLOCK 3, 1 of-_ 6-23-87 _ **PZ-1466 BLOCK 4 LOTS 1 AND 2 HANDLEY EDERVILLE ROAD, SOUTH OF MIDWAY (V-85-57) Recommendation _1 It. is recommended that the City Council adopt an Ordinance vacating three utility easements being a 5' wide utility easement located along and parallel to the south property line of Lot 2, Block 4, Northeast Industrial Addition, a 10' wide utility easement centered on the common property line of Lots 1 and 2, Block 4, Northeast Industrial Addition, and a 10' wide utility easement centered on the common property line of Lot 1, Block 4 and Block 3, Northeast Industrial Addition, all as recorded in Volume 388-169, Page 50, P. R. T. C. T. nicrllccinn Kenneth B. Newell for Riverbend, a Texas General Partnership, owner of abutting property, has regriested that the City vacate the three above-described utility easements, as shown on the attached map. The subject easements, acquired by dedication, are platted but contain no utility facilities. The subject vacation request is made in order to utilize the vacated easement as part of the subject property, thus expanding the building area and providing more usable yard space. The Director of Real Property Management has determined that a $1.00 consideration fee satisfies the City of Fort Worth's interest in this request. Reviewing City departments and private utility companies have raised no objections to this request. A satisfactory replat has been submitted.
