HomeMy WebLinkAboutOrdinance 22025-01-2016 ORDINANCE NO.22025-01-2016 AN ORDINANCE VACATING AND EXTINGUISHING A PORTION OF FAIRMOUNT AVENUE AND TWO ALLEYS, SITUATED IN BLOCK 1 OF E.F. SEIDELLS SUBDIVSION OF BLOCKS 11 AND 12 OF THE FIELDS WELCH ADDITION AND BLOCK 1 OF THE J.N. BROOKERS SUBDIVISION OF BLOCK 11 FIELD-WELCH ADDITION, AN ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS; AS RECORDED IN, VOLUME 388-47, PAGES 149-150, VOLUME 106, PAGE 26 AND VOLUME 204, PAGE 38 OF THE PLAT RECORDS OF TARRANT COUNTY, TEXAS AND CONTAINING APPROXIMATELY RESPECTIVELY 1,000, 2,400 AND 2,800 SQUARE FEET ACRE OF LAND MORE OR LESS; PROVIDING FOR REVERSION OF FEE IN SAID LAND; PROVIDING THAT THE CITY SHALL RETAIN ALL EXISTING UTILITIES EASEMENTS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH;AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That a portion of Fairmount Avenue situated in Block 1 of the Seidells Subdivision of Block 12, Fields Welch Addition, an addition to the City of Fort Worth, Tarrant County, Texas according to the plat thereof recorded in Volume 388-47, Pages 149-150 of the Plat Records of Tarrant County, Texas, containing approximately 1,000 square feet or 0.022 acre of land more or less, and as more specifically described in Exhibits "A"and"B"attached hereto and incorporated herein by reference be and the same is vacated and extinguished. SECTION 2. That a portion of a twelve (12) foot alley right-of-way lying between West Rosedale Street and Oleander Street, situated in Block 1 of the E.F. Seidels Subdivision of Block 12, Fields Welch Addition, an addition to the City of Fort Worth, Tarrant County, Texas, as recorded in Volume 106, Page 26 of the Plat Records of Tarrant County, Texas, and containing approximately 2,400 square feet or 0.55 acres of land more or less, and as more specifically described in Exhibits "C" and "D" attached hereto and incorporated herein by reference be and the same is vacated and extinguished. That an eight (8) foot alley right-of-way lying between West Rosedale Street and Oleander Street, situated in Block 1 of the J.N. Brookers Subdivision of Block 11, Field-Welch Addition, an addition to the City of Fort Worth, Tarrant County, Texas, as recorded in Volume 204, Page 38 of the Plat Records of Tarrant County, Texas, and containing approximately 2,800 square feet or 0.064 acres of land more or less, and as more specifically described in Exhibits "E" and "F" attached hereto and incorporated herein by reference be and the same is vacated and extinguished. SECTION 4. That the easement to the land in the above-described vacated street right of way is hereby released and shall revert to the adjacent owner as provided by law. SECTION 5. All existing utility easement be shall be retained by the City until such time all utilities located in that easement are relocated at the owner's expense. SECTION 6. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 7. That this ordinance shall take effect upon adoption. Waive any and all purchase fee value of the vacated land in accordance with City Policy. DISCUSSION: Cates-Clark and Associates, LLP, on behalf of Oleander Investments, LLC, has requested the vacation of these rights-of-way, to be replatted with the adjoining property for two new multi-family developments within the Near Southside. The City Plan Commission recommended approval of this request at its meeting on March 25, 2015. Acceptable final plats (FS-15-019 and FS-15-020) have been received in accordance with the Subdivision Ordinance. The City of Fort Worth (City) originally obtained the above mentioned rights-of-way through the platting process. The City does not own any fee interest in the rights-of-way or own any property adjacent to the rights-of-way and did not expend any City funds to purchase the right-of-way easements. In accordance with the City's policy regarding street and alley vacation transactions approved by the City Council on March 6, 2007 (M&C G-15624). Staff recommends waiving the fair market value or any portion thereof of purchase price of the right-of-way easements for the streets and alley. This project is located in COUNCIL DISTRICT 9, Mapsco 76L. This M&C does not request approval of a contract with a business entity.
