HomeMy WebLinkAboutOrdinance 9799a +~ `; f `;, ~~ ORDINANCE NO. ~~ AN ORDINANCE REPEALING ORDINANCE NO. 9733 OF THE CITY OF FORT WORTH, AS AMENDED BY ORDINANCE NO. 9751 AND ORDINANCE NO. 9789, SAME BEING AN ORDINANCE PROHIBITING THE ESTAB- LISHMENT OF PAWN SHOPS, THE ISSUANCE OF CERTIFICATES OF OCCUPANCY AND THE ISSUANCE OF BUILDING PERMITS FOR THE CONSTRUCTION, REPAIR OR RENOVATION OF STRUCTURES TO BE USED FOR PAWN SHOPS WITHIN THE CIT Y, PENDING CONSIDERATION BY THE ZONING COMMISSION AND THE CITY COUNCIL OF PROPOSED RESTRICTIONS REGARDING THE LOCATION OF PAWN SHOPS IN THE CITY OF FORT WORTH; AND NAMING AN EFFECTIVE DATE. WHEREAS, on September 30, 1986, the City Council adopted Ordinance No. 9733 which directed the Zoning Commission of the City of Fort Worth to conduct public hearings and to report to the City Council as expeditiously as possible its recommendations relating to proposed amendments to the Comprehensive Zoning Ordinance (Appendix °'A" of the Code of the City of Fort Worth), restricting the location of pawn shops within the City of Fort Worth and in particular prohibiting the location of pawn shops within the "E" Commercial zoning district of the City of Fort Worth; and WHEREAS, pending the report of the Zoning Commission, Ordinance No. 9733 further prohibited the establishment of pawn shops, the issuance of certificates of occupancy and the issuance o.f building permits for the construction, repair or renovation of structures to be used as pawn shops within the City of Fort Worth; and WHEREAS, on October 28, 1986, the City Council adopted Ordinance No. 9751, which amended Ordinance No. 9733 by providing that the moratorium with respect to pawn shops shall not be appli- cable to applications for building permits filed prior to September 30, 1986; and ~~ ~ • . - ..,,:,. WHEREAS, on December 22, 1986, the City Council adopted Ordinance No. 9789, which further amended Ordinance No. 9733, by providing that the moratorium with respect to pawnshops shall not be applicable to locations for which a secondhand dealer license had been issued by the City of Fort Worth and an application for a pawn- shop license had been filed with the State of Texas prior to September 30, 1986, provided that a pawnshop license was issued by the State prior to October 28, 1986; and WHEREAS, on November 12, 1986, the Zoning Commission recom- mended to the City Council certain amendments to the Comprehensive Zoning Ordinance regarding the use, location and other regulation of pawn shops within the City of Fort Worth; and WHEREAS, the City Council has adopted Ordinance No. 9798, amending the Comprehensive Zoning Ordinance to provide for the use, location and other regulation of pawn shops within the City of Fort Worth ; and WHEREAS, the City Council now desires to repeal the moratorium on the establishment of pawn shops, the issuance of certificates of occupancy and the issuance of building permits for the construction, repair or renovation of structures to be used as pawnshops; NOW, THEREFORE; BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECT ION 1 . That Ordinance No. 9733 of the City of Fort Worth, adopted September 30, 1986, as amended by Ordinance No. 9751, adopted -2- is ' ~; October 28, 1986, and as further amended by Ordinance No. 9789, adopted December 22, 1986, be, and the same is hereby, repealed as of the effective date of this ordinance. SECT ION 2 . That this ordinance shall be in full force and effect from and after the effective date of Ordinance No. 9798.
