HomeMy WebLinkAboutOrdinance 17959-01-2008Ordinance Na. 17959-01-2008 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE PARK GAS LEASE PROJECT FUND IN THE AMOUNT OF $38,731 FROM GAS WELL BONUS REVENUES FOR THE PURPOSE OF EXECUTING A PROFESSIONAL SERVICES AGREEMENT WITH HUITT-ZOLLARS, INC., FOR THE MASTER PLANNING OF MALLARD COVE PARK; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE 1T ORDAWED BY THE CITY GOUNGIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2007-2008 in the Budget of the City Manager, there shah also be increased estimated receipts and appropriations in the Park Gas Lease Project Fund in the amount of $38,739 from Gas Well Bonus Revenues for the purpose of executing a professional services agreement with Huitt-Zollars, Inc., for the Master Planning of Mallard Cove Park. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ord{Hance No. 17749 and all other ardinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting prouisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize the City Manager to execute a professional services agreement with Huitt-Zollars, Inc., in the amount of $34,731 for the master planning of Mallard Cove Park; and 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations by $38,731 in the Park Gas Lease Project fund from Gas Well Bonus Revenue for Mallard Cove Park. DISCUSSION: On September 6, 2005, (M&C L-14129) City Council authorized the City Manager to convert the dedicated parkland for subsurface drilling and extraction of natural gas in Mallard Cove Park. On November 29, 2005, (M&C C-21168) City Council approved the acceptance of a lease agreement for natural gas drilling under the park which is located north of Randol Mill Road and east of Interstate 820. The total available acreage in Mallard Cove Park is 103.9 acres with a 33.5 net mineral acre interest owned by the City of Fort Worth. The net transfer to the City less administrative and legal fees totals $43,055.75. Parks and Community Services (PACs) staff solicited proposals from firms specializing in park master planning and selected Huitt-Zollars, Inc., to provide such services. The master planning effort will include a site assessment of existing natural resources, and with staff and neighborhood input, develop recommendations for along-term site plan, identify environmental site improvements, and operational costs. The proposed agreement for these services is in the amount of $34,731 with an additional $4,000 appropriated for PACs administration salaries together totaling $38,731. This proposed expenditure is in compliance with the City Council approved policy for the expenditure of Gas Well Revenues. Mallard Cove Park is located in Council District 4, Mapsco 66 G and L. FISCAL INFORMATION/CERTIFICATION: The Finance Director certifies that upon approval of the above recommendation and adoption of the attached appropriation ordinance, funds will be available in the current capital budget, as approved, of the Park Gas Lease Project Fund.
