T 'SAN ORDINANCE AMENDING CHAPTER 25 "PLANNING" OF THE CODE OF THE CITY OF FORT WORTH, TEXAS, (1986), BY AMENDING SECTION 25-1 THEREOF,BY ESTABLISHING THE FEES FOR APPLICATIONS FOR "HC" HISTORIC AND CULTURAL SUBDISTRICT ZONING AND "CD" CONSERVATION DISTRICTS OVERLAY ZONING, TO PROVIDING FOR REPEAL OF ORDINANCES AND OF CODE SECTIONS IN CONFLICT HEREWITH, PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL OTHER ORDINANCES AND CODE SECTIONS; PROVIDING A SEVERABILITY CLAUSE, PROVIDING FOR ENGROSSMENT AND ENROLLMENT, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1. That Chapter 25 of the Code of the City of Fort Worth, Texas, (1986), as amended, is hereby amended by revising Section 25-1(a) to establish fees for applications to the Zoning Commission for "HC Historic and Cultural Subdistrict Zoning and for "CD" Conservation District overlay zoning, and following said amendment the fees for applications before the Zoning Commission shall read as follows• 7_oning Commission Application for zoning change 0 to 1 acre R 650.00 1 to 5 acres X1,000.00 5 acres or more X1,300.00 Historic and Cultural Subdistrict Zoning No fee "CD" Conservation District Zoninq $ 100.00 Continuance Request of Zoninq Hearing before ~ 150.00 Zoning Commission Activity Council Special Hearinq Before City Council on Zoning Matter $ 300.00 w• ;~ ' SECTION 2. This ordinance shall be cumulative of all provisions of ordi- nances and of the Code of the City of Fort Worth, 'T'exas (1986) , as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 3. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitu- tional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 4. The City Secretary of the City of Fort Worth is hereby directed to engross and enroll this ordinance by copying the caption, Section 1 and effective date in the minutes of the City Council and by filing the ordinance in the ordinance records of the City. -2- r .. , • ~. * ~- ._ SECTION 5. This ordinance will amend the fol lowing zoning _ ap_pl i.cat.ion fees -Historic and Cultural Subdistrict Zoning No Fee Conservation District Zoning $ 100 nrcriiccrnsu Section 25-1 of the City Code sets forth fees for certain applications before the Planning Commission, Board of Adjustment and Zoning Commission. Under the current fees schedule, the application fee far a change in zoning ranges from $650 to $1,300. In October, 1986 the City Council reviewed and approved the Fort Worth Historic Preservation Plan that was presented by the Fort Worth Historical and Cultural Advisory Board. The board presented seven specific recommendations to council, one being a proposed reduction in the fee for "HC" and "CD" zoning applications. The Preservation Plan determined that the existing fee structure for an application for zoning change is a disincentive for neighborhoods to obtain these beneficial overlay zones and has recommended establishment of the . fee structure cited above. After reviewing and approving the Historic Preservation Plan, the Council requested that the H & CA hoard develop the general recommendations into specific codes and ordinances ana come back to City Council for approval. This is the culmination of that request. The fee reduction is expected to have a negligible effect on General Fund revenues.
