HomeMy WebLinkAboutOrdinance 9600;L1 ~' ?^ ORDINANCE N0._-' AN ORDINANCE AMENDING CHAPTER 6 OF THE CODE OF THE CITY OF FORT WORTH (1964}, AS AMENDED, BY AMENDING ARTICLE III, SECTION 6.07 THEREOF TO PROVIDE FOR ADDITIONAL MEMBERS OF THE EMERGENCY PHYSICIANS ADVISORY BOARD; AMENDING ARTI- CLE IX, SECTION 6.30 TO PROVIDE FOR THE REQUIREMENT OF A TWO MILLION DOLLAR UMBRELLA LIABILITY INSURANCE COVERAGE; AMENDING ARTICLE IX, SECTION 6.31 TO PROVIDE FOR A REGULA- TORY FEE TO BE CHARGED FOR EACH PATIENT TRANSPORT TO DEFRAY THE COSTS OF MEDICAL REGULATION BY THE EMERGENCY PHYSICIANS ADVISORY BOARD; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR PUBLICATION OF THIS ORDINANCE; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That Section 6.07 of Article III of Chapter 6 of the Code of the City of Fort Worth (1964), as amended, be and the same is hereby amended so that hereafter same shall read and be as follows: "Section 6.07. Membership; Qualifications The EPAB shall consist of a board whose membership shall be composed of the following: (a) The medical director, or his designee, of each hospital emergency department which is located within the corporate limits of the city and which maintains an emergency medical services program staffed by in-house physicians and which provides twenty-four (24) hour coverage, seven (7) days a week; and (b) Five (5) additional licensed physicians, with active specialties or sub-specialties providing said physicians with medical expertise of benefit in developing standards for emergency pre-hospital care." SECTION 2. That Section 6.30(d) of Article IX of Chapter 6 of the Code of the City of Fort Worth (1964), as amended, be and the same is hereby amended so that hereafter said subsection (d) shall read as follows: "Section 6.30. Insurance ***** (d) A two million dollar ($2,000,000) umbrella policy providing additional coverage to all underlying liability policies; *****~~ SECTION 3. That Section 6.31 of Article IX of Chapter b of the Code of the City of Fort Worth (1964), as amended, be and the same is hereby amended so that hereafter said section shall read as follows: "Section 6.31. Fees required. A fee of three dollars ($3.00) per patient transport shall be charged and collected by the operator of an ambulance, which sum shall be paid to the EPAB to defray the costs of medical regulation of the system. Payments shall be made monthly or as otherwise directed by the EPAB." SECTION 4. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitu- tional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the ,, -2- y remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 5. The City Secretary of the City of Fort Worth, Texas, is hereby directed to publish the caption and Section 1, 2 and 3 of this ordinance for two (2) days in the official newspaper of the City of Fort Worth, Texas, as authorized by Art. 1176b-1, Revised Civil Statutes of Texas. SECTION 6. That this ordinance shall take effect and be in full force and effect from and after its passage, and it is so ordained. Background• On November 5, 1985, the. City Council adopted Ordinance No. 9510, providing for the regulation of ambulance service in the City. The ordinance is codified as Chapter 6 of the Code of the City of Fort Worth In the process of implementing the new ambulance service system for the City, the staff has become aware of the need for the following revisions to the word- i ng of Chapter 6: 1. An increase in the membership of the Emer ency Physicians Advisor Board AB ect,on 6.0 c,ty o e Representat,ves of the Tarrant County l~edi al Society have formally requested that an additional five (5) licensed physicians be appointed to the E.PAB. The additional physicians shall be qualified in appropriate medical specialties and sub-specialties so as to provide for more well-rounded expertise in the make-up of the Board in order to facilitate the promulgation of effective standards for pre-hospital care. 2. A reduction in the re uired amount of umbrella liability covera a from Ten , ,on o ars to wo , ,on o ars , Section 6. 0, C,ty o e Mar et conditions in the liability insurance industry indicate that the present requirement of umbrella liability coverage of $10,000,000 is unrealistic and unobtainable as a practical matter. A study of the present market indicates that a lowering of the required amount of coverage to $2,000,000 is more in line with present market realities. 3. A clarification of the medical re ulatory fee rovision. [Section 6.31, ,ty o e It ,s recommen ed that ect,on .3 a reworded to clarify that the $3.00 fee to defray costs of medical regulation shall be charged for each~atient transport by an ambulance operator. This will eliminate the ~igui y~ container-in the present wording of Section 6.31, which uses the term "$3.00 per ambulance run." The above recommended changes to Ordinance No. 9510 (Chapter 6, City Code) have been approved by the Fort Worth Ambulance Authority and are implemented in the attached proposed ordinance.
