If such certificate be assigned then the holder thereof shall be entitled to receive from the City Treasurer the amount paid upon the presentation to him of such certificate so endorsed and credited; and such endors~nent and credit shall be the Treasurer's Warrant for making such payment. Such payments by the Treasurer shall be receipted for the holder of such certificate in writing and by surrender thereof when the principal, together with accrued interest and all costs of collection and reasonable attorney's fees, if incurred, have been paid in full. Said certificates shall further recite substantially that the proceedings with reference to making the improvements have been regularly had in compliance with the law, and that all prerequisites to the fixing of the assessment lien against the property described in such certificate and thepersonal liabilityof the owners thereof have been performed, and such recitals shall be prima facie evidence of all the matters recited in such certificates, and no further proof thereof shall be required in any court. Said certificates may have coupons attached thereto in evidence of each or any of the several installments thereof, or may have coupons for each of the first four installments, leaving the main certificate to serve for the fifth installment, which coupons may be payable to the City of Fort Worth, or its assigns may be signed with the facsimile signatures of the Mayor and City Secretary. i~ ~ 4 V 1' ~ \ F Said certificates shall further recite that the City of Fort Worth, Texas shall exercise all of its lawful powers, when requested so to do, to aid in the enforcement and collection thereof, and may contain recitals substantially in accordance with the above and other additional recitals pertinent or appropriate thereof, and it shall not be necessary that the recitals be in the exact form above set forth, but the substance thereof shall be sufficient. The fact that such improvements may be omitted on any portion of any of said units adjacent to any premises exempt from the lien of such assessments shall not in anywise invalidate, affect or impair the lien of such assessments upon other premises. BACKGROUND On June 17, 1986 (M&C C-9704), the City Council awarded a construction contract for the paving of White Settlement Road and C1 afford Road (from I.H. 820 to Academy Boulevard) to J. L. Bertram Construction and Engineering, Inc., in the amount of X1,394,437.11. Also, Ordinance No. 9659 was adopted approving the assessment rates and setting July 22, 1986, as the date for the benefit hear- ing. , Due to delays in mailing notices to the property owners the benefit hearing was rescheduled. As a result, on July 22, 1986, (M&C G-6741) Ordinance No. 9659 was amended and August 19, 1986 was set as the date for the benefit hearing. All of the adjacent property owners were notified of the rescheduled benefit hearing by mail on July 17, 1986. DATE REFERENCE SUBJECT BENEFIT HEARING, ASSESSMENT PAV- PAGE 8/19/86 NUMBER ING'QF WHITE SETTLEMENT ROAD AND 2of 2 G-.6782 -IF ORD R AD ORIGIN OF PROJECT On 'January 15, 1985 (M&C C-8811), the City Council approved Community Facilities Agreement No. 14270 with Haydn Cutler, for the development of Clifford Village Addition, Block 2, Lots 1 and 2, and Block 1, Lot 1. Segments of White Settlement Road and Clifford Road are border streets to the develop- ment. On April 23, 1985 (M&C C-8974), a Community Facilities Agreement was authorized with Legacy Square Joint Venture for the development of Legacy Square, Blocks 1 - 5, to which a segment of White Settlement Road is also a border street. The assessment paving of White Settlement Road from I.H. 820 to Academy Boulevard and Clifford Road from I.H. 820 to White Settlement Road in- cludes the two street sections covered by the CFA's and the construction of a section of White Settlement Road which is an interior street to the Clifford Village Addition and is fully funded by the developer but constructed under this contract to provide for traffic continuity. IMPROVEMENTS White Settlement Road and Clifford Road will be constructed with a 7-inch thick reinforced concrete pavement, 7-inch high attached concrete curb, and driveway approaches where specified on the plans. Storm drain improvements consist of 4,776 feet of reinforced concrete pipe and appurtenances. Street lights will be installed at a later date by City crews. ASSESSMENTS Based on standard City policy and the law bid unit prices, the cost to the property owners for their share of the construction plus street lights is approximately $722,023.78, of which $247,911.83 will be prepaid. Cost to the City of Fort Worth for paving and drainage is approximately $672,413.33 plus $69,721.85 (5% of total construction cost) for engineering inspection and administrative cost. Street light cost to the City of Fort Worth is $38,638.85. Property owners' share of the street lights are shown on the assessment rolls and are based on the Engineer's estimate of probable cost. It is the opinion of the Department of Transportation and Public Works that as a result of the proposed construction, each parcel of adjacent property will be enhanced in value by an amount equal to or greater than the proposed assessment.
