ORDINANCE N0.
AN ORDINANCE AMENDING ORDINANCE NO. 9164, AS AMENDED, THE
FORT WORTH PLUMBING CODE, BY PROVIDING FOR THE LOCATION OF
GAS METERS; PROVIDING FOR THE INSTALLATION OF GAS LINES;
PROVIDING FOR DEFINITIONS; PROVIDING FOR THIS ORDINANCE TO
BE CUMULATIVE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING
A SAVINGS CLAUSE; PROVIDING A PENALTY CLAUSE; PROVIDING
FOR PUBLICATION IN PAMPHLET FORM; PROVIDING F'OR ENGROSS-
MENT AND EN ROLLMENT; PROVIDING FOR PUBLICATION IN THE
OFFICIAL NEWSPAPER; AND PROVIDING FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That Section 1202 of Ordinance No. 9164, as amended, is hereby
amended by revising Section 1202(d) to read as follows:
"(d) Gas Piping: Any installation of pipe, valves or fit-
tings that is used to convey fuel gas, installed on any
premises or in any building, but shall not include:
(1) Any portion of the service piping.
(2) Any approved piping connection six (6) feet
(1.8 m) or less in length between an existing gas
outlet and a gas appliance in the same room with the
outlet.
(3} Any gas piping supplying gas from the main to the
measuring point, provided such piping is installed
according to the law and the rules of the Railroad
Commission of Texas."
SECTION 2 .
That Section 1202 of Ordinance No. 9164, as amended, is hereby
amended by revising Section 1202(8) to read as follows:
"(g) Service Piping: The piping and equipment between the
street gas main and the gas measuring point.
SECTION 3 .
That Section 1211 of Ordinance No. 9164, as amended, is hereby
amended by revising Paragraph (1) thereof to read as follows:

"(1) All gas meters shall be located at the building on
the site being served. Where it is impracticab:Le to do so,
the Administrative Authority may approve an alternative
location. In approving an alternative location, the
Administrative Authority shall take into account the
required gas supply and the accessibility to the gas
main. Any person aggrieved by the decision of the
Administrative Authority may appeal such decision to the
Board of Plumbers. All meters set at approved locations
shall be protected from moving machinery and equipment."
SECT ION 4 .
That Section 1211 of Ordinance No. 9164, as amended, is hereby
amended by revising Paragraph (8) thereof to read a:~ follows:
"8. The initial installation and any future maa.ntenance of
the service piping shall be the responsibility of the
serving gas supplier. When service piping is installed or
is in need of repair or replacement, the serving gas
supplier shall do so without charge to the customer except
as approved by the City Council through the gas rate
structure. However, where the existing gas service piping
enters directly under the house beneath the surface of the
ground, the owner shall at his own expense install a riser
outside the building and connect the same to the existing
house piping.
SECTION 5 .
This ordinance shall be cumulative of all provisions of ordi-
nances and of the Code of the City of Fort Worth, Texas ( 1964) , as
amended, except where the provisions of this ordinance are in direct
conflict with the provisions of such ordinances and such Code, in
which event conflicting provisions of such ordinances and such Code
are hereby repealed.
SECTION 6 .
It is hereby declared to be the intention of the City Council
that the sections, paragraphs, sentences, clauses and phrases of
this ordinance are severable, and if any phrase, clause, sentence,
paragraph or section of this ordinance shall be declared unconstitu-

tional by the valid judgment or decree of any court of competent
jurisdiction, such unconstitutionality shall not affect any of the
remaining phrases, clauses, sentences, paragraphs and sections of
this ordinance, since the same would have been enacted by the City
Council without the incorporation in this ordinance of any such

unconstitutional phrase, clause, sentence, paragraph or section.
SECTION 7 .
Any person, firm or corporation who violates, disobeys, omits,
neglects or refuses to comply with or who resists the enforcement of
any of the provisions of this ordinance relating to fire safety or
public health and sanitation shall be fined not more than One
Thousand Dollars ($1,000.00) for each offense and shall be fined not
more than Two Hundred Dollars ($200.00) for all oi_her violations.
Each day that a violation is permitted to exist shall constitute a
separate offense.
SECTION 8.
All rights and remedies of the City of Fort Worth, Texas, are
expressly saved as to any and all violations of the provisions of
Ordinance No. 9164 or any other ordinances affecting plumbing which
have accrued at the time of the effective date of this ordinance;
and, as to such accrued violations and all pending litigation, both
civil and 1criminal, whether pending in court or not, under such
ordinances, same shall not be affected by this ordinance but may be
prosecuted until final disposition by the courts.
SECTION 9.
The City Secretary of the City of Fort Worth, Texas, is hereby
authorized to publish this ordinance in pamphlet form for general

distribution among the public, and the operative provisions of_ this
ordinance as so published shall be admissible in evidence in all
courts without further proof than the production thereof, as pro-
vided in Chapter XXV, Section 3, of the Charter of the City of Fort
Worth, Texas.
SECTION 10.
The City Secretary of the City of Fort Worth is hereby directed
.. to engross and enroll this ordinance by copying the caption and
Sections 7, 11 and 12 in the minutes of the City Council and by
filing the ordinance in the ordinance records of the City.
SECTION 11.
The City Secretary of the City of Fort Worth, Texas, is hereby
directed to publish the caption and Sections 7, 11 and 12 of this
ordinance for two (2) days in the official newspaper. of the City of
Fort Worth, Texas, as authorized by Art. 1176b-1, Revised Civil
Statutes of Texas.
SECTION 12.
This ordinance shall be in full force and effect 'from and
after its passage and publication as required by law, and it is so
ordained.

Recommendation
It is recommended that the City Council adopt the attached ordinance amending
the Fort Worth Plumbing Code as described below
Discussion
Section 1211 of the Fort Worth Plumbing Code .(Ordinance No 9164) provides that
the initial installation of gas lines on a customer's property shall be the
responsibility of the customer. This typically is accomplished by the builder
of a home installing the pipeline or by the customer hiring a plumber to do the
installation. After initial installation is completed, Lone Star Gas Company
assumes the responsibility for repairing and maintaining the gas line Lone
Star Gas has requested that the City amend the Plumbing Code to require the gas
company to install all gas service lines on a customer's property and to bill
the customer only through the gas rate structure which is approved by the City
Council The attached ordinance was drafted for this purpose
The City staff has reviewed these proposed amendments and recommends their
adoption. The matter was submitted for the consideration of the Board of
Plumbers, which met in session on August 5, 1986, and approved the proposed
changes
