HomeMy WebLinkAboutOrdinance 18510-03-2009Ordinance No. 18610-03-2049 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS iN THE WATER CAPITAL PROJECTS FUND tN THE AMOUNT OF 8443.630.00 AND IN THE SEWER CAPITAL PROJECTS FUND IN THE AMOUNT OF 8418,971.81, FROM AVAILABLE FUNDS, FOR THE PURPOSE OF EXECUTING A CONTRACT WITH STABILE & WINN, INC., FOR PAVEMENT RECONSTRUCTION AND WATER AND SANITARY SEWER REPLACEMENT ON CANTON DRIVE, CHURCH STREET, HALBERT STREET AND VAN NATI'A LANE; PROVIDING FOR A SEVERABfLITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2008-2009, there shall also be increased estimated receipts and appropriations in the Water Capital Projects Fund in the amount of 5443,830.00 and in khe Sewer Capital Projects in the amount of $418,971.61, from available funds, for the purpose of executing a contract with Stabile & Winn, Inc., for pavement reconstruction and water and sanitary sewer replacement on Canton Drive, Church Street, Halbert Street and Van Natta Lane. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction.. such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 18283 and alI other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repeated. Authorize the transfer of $862,601.61 from the Water and Sewer Operating Fund to the Water Gapital Projects Fund in the amount of $443,630.00 and Sewer Gapital Projects Fund in the amount of $418,971.61; 2. Adapt the attached appropriation ordinance increasing estimated receipts and appropriations in the Water Capital Projects Fund in the amount of $443,630.40 and the Sewer Gapital Projects Fund in the amount of $418,971.61, from available funds; and 3. Authorize the City Manager to execute a contract in the amount of $2,153,409.42 with Stabile and Winn, Inc., for Pavement Reconstruction and Water and Sanitary Sewer Replacement on Canton Drive, Ghurch Street, Halbert Street and Van Natta Lane. DISCUSSION: The 2004 Gapita! Improvement Program {C!P} includes funds far pavement reconstruction of Ganton Drive {Meadowbrook Boulevard to Craig Street}, Ghurch Street {Louise Street to Handley Drive}, Halbert Street {Craig Street to Routt Street) and Van Natta Lane tMuse Street to Janice Lane}, Street improvements include pavement reconstruction, canstruation of standard concrete curb, driveway approaches and sidewalks as indicated on the plans. The iNater Department has determined that severely deteriorated waker and sanitary sewer lines shau(d t,e reaiaced prior tc street reconstruction. The new pavement section will consist of seven inch concrsts oust six inch limn stabilized sub-grade with seven inch integral concrsts curb. Funding in the amount of $83,307.44 is included for associated water and sewer project management, construction survey, material testing, inspection and project close out {water $41,642.00 and sewer $41,665.44}. The contingency funds to cover change orders total $37,109.00 {water $19,142.D0 and sewer $17,967.00}. Funding in the amount of $131,133.58 is required for associated paving and drainage construction survey, project management, pre-construction, material testing, inspection and project close out. The contingency fund for possible change orders for paving and drainage improvements is $42,337.D0. MIWBE -Stabile and Winn, Inc., is in compliance with the City's MIWBE Ordinance by committing to six percent MIWBE participation and documenting good faith effort on this combined project. Stabile and Winn, Inc., identified several subcontracting opportunities. However, the MWBE's contacted in the areas identified did not respond or submit the lowest bids. The Citys MIWBE goal on this combined project is 26 percent. This project is located in COUNCIL DISTRICT 5, Mapsco 79H and M, 80F, G and J. FISCAL INFORMATION t CERTIFICATION: __ The Financial Management Services Director certifies that upon approval and completion of recommendations, and the adoption of the attached appropriation ordinance, funds will be available in the current capital budgets, as appropriated, of the Water Capital Projects Fund, the Sewer Capital Projects Fund and the Street Improvements 2DD4 Overruns Fund.
