AN ORDINANCE GRANTING TO THE FORT WORTH & RIO GRANDE RAILWAY COMPANY, ITS SUCCESSORS AND ASSIGNS, A STRIP OR PARCEL OF LAND AP_ PROXIMATELY 30 FEET WIDE OFF OF THE NORTH- ERLY SIDE OF RAILROAD AVENUE, AND EXTEND- ING FROM JENNINGS AVENUE TO THE SOUTH EAST- ERLY RIGHT OF WAY LINE OF THE TEXAS & PACIFIC RAILWAY COMPANY, VICINITY OF HENDERSON STREET. BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF FORT WORTH: SECTION I That the Fort Worth & Rio Grande Railway Company, its successors and assigns, be and it is hereby granted all rights and title to occupy and use for railroad purposes a strip or parcel of land approximately thirty feet wide along the north side of Railroad Avenue and more particularly described as follows: BEGINNING at a stone, the northwest coerner of the intersection of Jennings Avenue and Railroad Avenue of the City of Fort Worth, Tarrant County, Texas; THENCE west along the north line of said Railroad Avenue 2071.9 feet, more or less, to a point on the south easterly right of way line of the Texas & Pacific Railway Company, said point being fifty feet perpendicularly distant in a southeasterly direction from the center line of the main track of the Texas & Pacific Railroad; THENCE south«esterly along said southeasterly right of way line of said railroad a distance of 38.1 feet; THENCE easterly, making an angle of 32 degrees and 03 minutes in the northeast quadrant with last described course a distance of 669.6 feet to a spike, said spike being 30 feet perpendicularly distant in a southerly direction from the north line of said Railroad Avenue; THENCE easterly, parallel to and 30 feet perpendicularly distant in a southerly direction from the north line of said Railroad Avenue a distance of 1404.7 feet ; THENCE north 30 feet to point of BEGINNING. Said strip or parcel of land containing 1.356 acres more or less. SECTION II The strip or parcel of' land granted to said Railway Company, its successors and assigns by this ordinance, shall be used by said Railway Company for terminal and team track purposes only and said company shall leave sufficient space be- tween the curbing and the land used for such track Purposes on which may be placed telephone, trolley and other poles and also far enough from said curb- ing that it will not be necessary for wagons, trucks and other vehicles to sstr�Jothe purpose of loading and unloading freight, it being under- stood that said railway company, its successors and assigns, may construct team tracks and such additional paving and driveways on such strips or parcel of land as they may from time to time deem necessary. SECTION III The City of Fort Worth shall protect the said Fort Worth & Rio Grande Railway Company, its successors and assigns, in the peaceful possession and use of said strip or parcel of land, so long as it is used for railroad purposes. If at any time, however, said railway company, its successors or assigns, shall cease to use said strip or parcel of land for terminal or team track purposes as pro- vided for in this ordinance, then, and in that case, all rights and title to said strip or parcel of land shall revert to said city. SECTION IV The said Fort Worth & Rio Grande Railway Company, its successors and assigns, by acceptance and exerc j sw c.� t;lae grw It herein made, does agree to indemnify and hold harmless the said City of Fort Worth against and from any claim for damages, for or on account of injuries to persons or property re- sulting from the possession and use of said strip or parcel of land by said railway company, its suc- cessors or assigns. SECTION V This ordinance shall take effect and be in full force from and after the. date of its passage. APPROVED; Corporation Counsel
