AN ORDINANCE VACATING, ABANDONING, AND CLOSING AND EXTIN-
GUISHING EAST NORTH 17TH STREET AND AN UNNAMED STREET
LYING BETWEEN BLOCK 3, RIVERSIDE GARDENS ADDITION TO THE
CITY OF FORT WORTH, AND THE G.C. AND S.F. RAILROAD RIGHT-
OF-WAY, EACH OF SAID ST RESTS BEING DESCRIBED MORE SPECIFI-
CALLY HEREIN; PROVIDING FOR REVERSION OF FEE IN SAID
LAND (S) ; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1 .
THAT THE:
(a) 50' public street and right-of-way known as East North 17th
Street, the centerline of the portion of the street vacated
hereby running east from the easternmost right-of-way line of
Samuels Avenue 380.22' to its intersection with the westernmost
right-of-way line of the unnamed public street and right-of-way
described more specifically hereinbelow; and,
(b) the unnamed 30' public street and right-of-way lying between
Block 3, Riverside Gardens Addition to the City of Fort Worth
and the G.C. and S.F. Railroad right-of-way, the centerline of
the portion of the street vacated hereby commencing at the
center of said street adjacent to the south boundary line of
Block 2, Riverside Gardens Addition to the City of Fort Worth
running in a southerly direction along said centerline for a
distance of 252.33' to the point said street lies adjacent to
the south boundary line of Block 3, Riverside Gardens Addition
to the City of Fort Worth,
be and the same are vacated, abandoned, and permanently closed and
extinguished.
SECTION 2 .
That the fee to the land(s) in the above described vacated
public streets and rights-of-way are hereby released and shall
revert to the adjacent owner(s) as provided by law, SAVE AND EXCEPT
that easements are retained for any and all existing and prospective
utilities and any and all existing and prospective drainage require-
ments, as necessary.
SECT ION 3 .
That all ordinances or parts of ordinances in conflict herewith
are hereby repealed.
SECT ION 4 .
That this ordinance shall take effect and be in full force and
effect from and after the date of its passage, and it is so or-
dained.

~2ECOMMENDATION
It is recommended that the City Council adopt an ordinance vacating a 380.22' x
50' portion of Northeast 17th Street from Samuels Avenue easterly to its
intersection with an unnamed north/south street right-of-way, located between and
adjacent to Lot 1-R, Block 2, Lots 1-R and 7, Block 3, Riverside Gardens
Addition, as recorded in Volume 388-46, Page 628 and Volume 388-B, Page 190,
P.R.T.C.T., and a 252.33' x 30' portion of a~n~unnamed north/south street, located
between and adjacent to Lot 8, Block 3, Riverside Gardens Addition, as recorded
in Volume 388-B, Page 190 P.R.T.C.T., and the G.C. & S.F. Railroad right-of-way
from Northeast 16th northerly to Northeast 17th Street, as recommended by the
City Plan Commission.
DISCUSSION.
Messrs. Gary Freer and Richard Moore, representing the La Veta Company and Freer
Mechanical Contractors and D.P. Valentine, General Manager, on behalf of G.C. &
S.F. Railroad Company, owners of abutting properties, have requested that the
City vacate the above described portions of street rights-of-way, as shown on the
attached map.
The subject street rights-of-way, acquired by dedication, are both open and
improved with pavement and contain water, sewer, two street lights, gas, and
electric utility facilities for which the responsible entities have requested
that appropriate easements be retained. The subject vacation request is made in
order to replat the vacated rights-of-way with adjacent property, to expand the
building area, and provide more usable yard space.
The required and appropriate monetary consideration has been placed in escrow
with the Real Property Department, as required by the Land Agent for the City of
Fort Worth.
Reviewing City departments and private utility companies have raised no
objections to this request, subject to the vacated rights-of-way being replatted
with adjacent property and any required utility easements are retained. A
satisfactory replat has been submitted.
