HomeMy WebLinkAboutOrdinance 9615Ds c _ ORDINANCE NO. ~~~~ AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTIN- GUISHING ALL STREETS AND ALLEYS, AS MORE SPECIFICALLY DESCRIBED HEREIN, WITHIN OAKWOOD CEMETERY, ALSO KNOWN AS FORT WORTH CITY CEMETERY; PROVIDING FOR REVERSION OF FEE IN SAID LANDS; REPEALING ALL ORDINANCES IN CONFLICT HERE- WITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That all streets, whether named or unnamed, and alleys within Oakwood Cemetery, also known as the Fort Worth City Cemetery, lying and being situated within the boundaries of the property described in Exhibit "A" hereto, be and the same are vacated, abandoned and permanently closed and extinguished. SECTION 2. That the fee to the lands in the above described vacated streets and alleys is hereby released and shall revert to the adja° cent owners as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. ~8s 7 b '., SECTION 4. DISCUSSION Messrs. Jim Brittian, surveyor, and Plichael Buckley, engineer, on behalf of Walker, Brown & McCall, Inc., owners of abuttiny property, have requested that the City vacate the above described streets and alleys, as shown on the attached map. The subject street and alley rights-of-way, acquired by dedication, are open on the ground, but contain no utility facilities. The subject vacation request is made in order to replat the vacated rights-of-way with adjacent property, to expand the cemetery area, and provide more usable yard space. The required and appropriate monetary consideration has been placed in escrow with the Real Property Department, as required by the Land Agent for the City of Fort Worth. Reviewing City departments and private utility companies have raised no objections to this request, subject to the vacated right-of-way being replatted with adjacent property and any required utility easements are retained. A satisfactory replat has been submitted.
