ORDINANCE ACCEPTING IMPROVEMENTS ON A PORTION OF SAM CALLOTn1AY
ROAD AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC
PLACES IN THE CITY OF FORT WORTH, TEXAS; DECLARING THE CONTRACT
WITH AUSTIN ROAD COMPANY FOR THE CONSTRUCTION OF SAID
IMPROVEl~1EN25 FULLY COMPLETED AND PER~RMED; DIRECTING THE ISSUANCE,
EXECUTION AND DELIVERY OF CERTIFICATES IN EVIDENCE OF SPECL?~L
ASSESSMENTS LEVIED AFTER GIVING EFFECT TO SUNDRY CREDITS HEREIN
AUTHORIZED AND ALIAWED AGAINST SOME OF SAID ASSESSMENTS; DIRECTING
THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING
THE CAPTION OF SAME IN THE MINUTE BOOR OF THE CITY COUNCIL OF FORT
WORTH, TEXAS, AND BY FILING THE COMPLETE ORDINANCE IN APPROPRIATE
ORDINANCE REOORDS OF SAID CITY; AND PROVIDING AN EFFECTIVE DATE.
WHII2EAS, the City of Fort Worth, Texas, has heretofore entered into a
contract with Austin Road Company ,for the making and construction of certain
street .improvements on the hereinafter described portions of streets, avenues and
public places in said City, to-wit:
SAM CALIATnY~Y ROAD
From State Highway 183 to Sundown Drive,
known and designated as Project No.
29-036616-'00, a seven-inch thick hot-mix
asphaltic concrete pavement with seven-inch
high concrete curb and eighteen-inch wide
concrete gutter on a six-inch thick lime
stabilized subgrade, so that the finished
roadway will be forty-feet wide to Sam Cal-
loway Court, thence thirty-six feet wide to
Sundown Drive.. Six-inch thick concrete
driveway approaches will be constructed
where specified. Four-feet wide concrete
sidewalk will be constructed on both sides
of the roadway from State Highway 183 to Sam
Calloway Court with attached concrete
retaining walls where specified.

WHEREAS, by sundry proceedings heretofore passed by the City Council of the
City of Fort Worth, Texas, including Ordinance No. 9155 , a portion of the cost of
said improvements was levied and assessed against the respective properties abutting
on each of the above described portions of streets, avenues and public places and
against the real and true owners therof; and,
WHEREAS, the City Council of the City of Fort Worth, Texas, has, upon
review, found and determined that, in some instances, in order to effect substantial
justice and equality, it is desirable and necessary to grant and issue certain credits
against some one or more of the assessments levied by Ordinance No. 9155 and,
WEIEREAS, the street improvements hereinabove mentioned have been completed
upon each of the portions of streets, avenues and public places hereinabove described,
and have been inspected and found to be in complete accordance with the contract
therefore;
NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT;
I.
The improvements on each of the portions of street, avenues and public
places hereinabove described be, and they are hereby, accepted; and the contract with
reference thereto be, and it is hereby, found and declared fully completed and
performed.
II .
The Mayor, be, and he is hereby, directed to issue and execute in the name
of the City, certificates in evidence of the special assessments levied against
abutting property and the owner thereof for such improvements, and the City Secretary
is directed to attest same and impress thereon the corporate seal of the City, all in
accordance with the proceedings relating to such improvements and assessments. The
certificates shall be numbered, shall describe the property against which the
assessement has been levied, shall, where known, state the name or names of the true
owners of the respective parcels of property assessed and shall be issued in an amount
equal to the difference between the principal amount of the assessment and the amounts
of any credit issued thereon. The numbers of the certificates, with the property
descriptions to be shown on the respective certificates, together with the names of
the owners of said property, the principal amount of the assessment, the respective
credits, if any which are hereby authorized, granted and allowed against the principal
amount of some one or more of the assessments heretofore levied, and the principal
amount for which each certificate is to be issued after giving effect to such credit,
if any, are hereby enumerated and itemized as follows:

III.
When each of the certificates has been duly executed as hereinabove provided,
same shall be delivered to the Tax Assessor-Collector as part payment of the contract
price.
IV.
The City Secretary is hereby directed to engross and enroll this ordinance by
copying the caption of same in the Minute Book of the City Council of Fort Worth,
Texas, and by filing the complete ordinance in the appropriate Ordinance Records of
said City.
V.
This ordinance shall take effect and be in full force and effect from and
after the date of its passage.

PROJECT N0. 429-036616-00, SAM GALLOWAY ROAD FROM STATE HIGHWAY 183 TO SUNDOWN DRIVE, to be improved by
construction of seven-inch thick hot-mix asphaltic concrete pavement with seven-inch high concrete curb
and eighteerrinch wide concrete gutter on a six-inch thick lime stabilized subgrade, so that the
