HomeMy WebLinkAboutOrdinance 9620~~ i.. _yf ORDINANCE N0. ~~~~~",y AN ORDINANCE VACATING, ABANDONING, AND CLOSING AND EXTIN- GUISHING CERTAIN PORTIONS OF WEST HUMBOLT STREET AND OAK GROVE STREET, AS MORE SPECIFICALLY DESCRIBED HEREIN: A PUBLIC OPEN SPACE EASEMENT LOCATED WITHIN LOT 1, BLOCK 1, VANDERVOORT'S ADDITION TO THE CITY OF FORT WORTH, AS MORE SPECIFICALLY DESCRIBED HEREIN; AND THE NORTH-SOUTH AND EAST-WEST ALLEYS IN BLOCK 3, MULKEY'S SUBDIVISION OF BLOCK 1, FIELDS WELCH ADDITION TO THE CITY OF FORT WORTH AS MORE SPECIFICALLY DESCRIBED .HEREIN; PROVIDING FOR REVERSION OF FEE IN SAID LAND(S); REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT THE FOLLOWING: 1) portions of West Humbolt Street and Oak Grove Street, described in Exhibit "A" hereto incorporated herein by reference for all purposes; and 2) the ten foot (10') wide alley running north-south and lying between and adjacent to Lots 2, 3, 6, and 7 of Block 3, Mulkey's Subdivision of Block 1, Fields Welch Addition to the City of Fort Worth and the eight foot (8') wide alley running east-west and lying between and adja- cent to Lots 1 through 8, in said Block 3, of Mulkey's Subdivision of Block 1, Field's Welch Addition; and, 3) the public open space easement in Lot 1, Block 1, Vandervoort's Addition to the City of Fort Worth, Tarrant County, Texas, as said public open space easement is shown on the plat of said Vandervoort's Addition recorded in Volume 388-117, Page 52 of the Plat Records of Tarrant County, Texas, be and the same are vacated, abandoned, and permanently closed and extinguished. SECTION 2. That the fee to the land in the above described vacated streets, alleys, and public open space easement is hereby released and shall revert to the adjacent owner(s) as provided by law SAVE AND EXCEPT that easements are retained for any and all existing and prospective utilities and any and all existing and prospective drainage requirements, as necessary. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so or- dained. DIVISION, BLOCK 3, LOTS 1-8, OF FIELDS `''~~ WELCH ADDITION, BLOCK 1 (V-82-44, (J V-83-2, and V-84-74) Recommendation It ~s recommended that the City Council adopt an ordinance vacating Oak Grove Street, from West Dashwood Street to West Humbolt Street; West Humbolt Street, from Oak Grove Street to Galveston Avenue; the 10' wide north/south alley and the 8` wide east/west alley, both located adjacent to Lots 1-8, Block 3, Mulkey's Subdivision of Block 1, Fields Welch Addition; and the 20' x 20' triangular pub- lic open space easement located on the northeast corner of West Dashwood Street and Oak Grove St reet, within Lot 1, Block 1, Vandervoort Addition, all as recom- mended by the City Plan Commission. Discussion Richard Davis, surveyor, and Barry Hudson, planner, agents for Vandervoort's Dairy, owner of all abutting properties, have requested that the City vacate the above-described streets, alleys and public open space easement, as shown on the attached maps. .The subject streets, alleys and public open space easement, acquired by dedica- tion, are open on the ground and contain water, sewer, electric, telephone, street lights and storm drain facilities. The subject vacation request is made in order to replat the vacated rights-of-way with adjacent property, to expand the building area, and provide more usable yard space. The required and appropriate monetary consideration has been placed in escrow with the Real property Department, as required by the Land Agent for the City of Fort Worth. Reviewing City departments and private utility companies have raised no objec- tions to this request, subject to the vacated right-of-way being replotted with adjacent property, to include retention of required utility easements.
