AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTIN-
GUISHING THE 20-FOOT ALLEY IN BLOCK 97, TEXAS AND PACIFIC
RAILWAY COMPANY'S ADDITION TO THE CITY OF FORT WORTH,
LYING BETWEEN THE EAST BOUNDARY LINE OF PINE STREET AND
THE WEST BOUNDARY LINE OF VIRGINIA AVENUE; PROVIDING FOR
REVERSION OF FEE IN SAID LANDS; RETAINING UTILITY AND
NECESSARY DRAINAGE EASEMENTS; REPEALING ALL ORDINANCES IN
CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That the 20-foot alley lying within Block 97, Texas and Pacific
Railway Company's Addition to the City of Fort Worth, lying between
the east boundary line of Pine Street and the west boundary line of
Virginia Avenue, be and the same is vacated, abandoned and perma-
nently closed and extinguished.
SECTION 2.
That the fee to the lands in the above described vacated alley
is hereby released and shall revert to the adjacent owners as pro-
vided by law, SAVE AND EXCEPT that easements are retained for any
'and all existing and prospective utilities and for any and all
existing and prospective drainage and surface water runoff, if same
be necessary.
SECTION 3.
That all ordinances or parts of ordinances in conflict herewith
are hereby repealed.

That this ordinance shall take effect and be in full force and
effect from and after the date of its passage, and it is so or-
dained.

Recommendation
It is recommended that the City Council adopt an ordinance vacating the 60' wide
right-of-way of East Presidio Street located adjacent to and between Lots 1-8,
Block 96, Lots 9-16, Block 97; Lots 8-14, Block 98; and Lots 1-7, Block 99, also
described as extending eastward from Pine Street, crossing Virginia Avenue, to
the west boundary line of Lot 1R, Great Western Foods Addition; to vacate the 60'
wide right-of-way of Virginia Avenue, located adjacent to and between Lots 8 & 9,
Block 96; Lot 9, Block 97; Lot 14, Block 98; and Lots 1 & 14, Block 99, also des-
cribed as extending northward from the north right-of-way line of East E1 Paso
Street, crossing East Presidio Street, to the east/west alleys located within
Block 97 & 98,; and to vacate the 20' wide alley contained in Block 97, between
Pine Street and Virginia Avenue, all previously noted Lots and Blocks being con-
tained in the Texas & Pacific Railway Company's Addition, as recorded in Volume
33, Pages 140 and 141, D.R.T.C.T., as recommended by the City Plan Commission.
Discussion
Mr.-John Bartosiewicz, General Manager of CITRAN, and representing Gary Santerre,
Director of the Transportation and Public Works Department, City of Fort Worth
and representing owners of abutting property, has requested that the City vacate
the above described portions of streets and alleys, as shown on the attached map.
The subject street and alley rights-of-way, acquired by dedication, are partially
open on the ground, and contain water, sewer, telephone, electric, and gas utili-
ty facilities. The subject vacation request is made in order to replat the
vacated rights-of-way with adjacent property, to expand the building area, and
provide more usable yard space.
The required and appropriate monetary consideration has been placed in escrow
with the Real Property Department, as required by the Land Agent for the City of
Fort Worth.
Reviewing City departments and private utility companies have raised n.o objec-
tions to this request, subject to the vacated rights-of-way being replatted with
adjacent property and any required utility easements being retained. A satisfac-
tory replat has been submitted.
