AN ORDINANCE VACATING, ABANDONING, AND CLOSING AND EXTIN-
GUISHING THE EAST - WEST 20' ALLEY IN BLOCK 109, ROSEN
HEIGHTS ADDITION TO THE CITY OF FORT WORTH; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXA5:
SECTION 1.
THAT THE East - West 20' alley in Block 109, Rosen Heights
Addition to the City of Fort Worth, as shown in Volume 204, Page 75
of the Deed Records of Tarrant County. Texas, be and the same is
vacated, abandoned, and permanently closed and extinguished as an
alley.
SECTION 2.
That the fee to the land(s) in the above described vacated
alley is hereby released and shall revert to the adjacent owner(s)
as provided by law, SAVE AND EXCEPT that easements are retained for
any and all existing and prospective utilities and all existing and
prospective drainage requirements, if any.
SECTION 3.
That all ordinances or parts of ordinances in conflict herewith
are hereby repealed.

SECTION 4.
That this ordinance shall take effect and be in full force and
effect from and after the date of its passage, and it is so or-
dained.

RECOMMENDATION
It is recommended that the City Couuncil adopt an ordinance vacating an east/west
20' wide alley located within Block 109, adjacent and between Lots 1 through 24,
all as recorded in Volume 204, Page 75 of the D.R.T.C.T., as recommended by the
City Plan Commission.
DISCUSSION
Ben Cardenas, owner of Lots 1-6, Block 109, Rosen Heights Addition, with consent
of all remaining property owners in the block, has requested that the City vacate
the alley in Block 109, Rosen Heights Addition, adjacent to Lots 1-24, from
Kearnery Street to West Long Street, as shown on the attached map.
The subject alley right-of-way, acquired by dedication, is open, improved, and
contains street light and electric facilities, for which the responsible enti-
ties have required appropriate utility easements. The subject vacation request
is made in order to replat the vacated rights-of-way with adjacent property, to
expand the building area, and provide more usable yard space.
The required and appropriate monetary consideration has been placed in escrow
with the Real Property Department, as required by the Land Agent for the City of
Fort Worth.
Reviewing City departments and private utility companies have raised no objec-
tions to this request, subject to the vacated right-of-way being replatted with
adjacent property, to include the retention of required utility easements.
The City Plan Commission has recommended that the vacated alley may be replatted
with abutting property whenever such abutting property is redeveloped. A satis-
factory replat for Lots 1-7, and included in the north 10' of the abutting alley,
has been submitted.
