HomeMy WebLinkAboutOrdinance 7878 i ORDINANCE NO. 07f-7f AN ORDINANCE APPROPRIATING REVENUE OF THE CITY OF FORT WORTH IN THE SUM OF $79,368 FROM THE GENERAL FUND BALANCE TO ACCOUNT NO. 90-62-00, FOR THE PURPOSE OF PROVIDING FUNDS, TO BE DISBURSED UNDER CONTRACT, TO REIMBURSE WOMEN'S HAVEN, INC. , FOR EXPENSES INCURRED IN PROVIDING TEMPORARY SHELTER TO FORT WORTH RESIDENTS THAT ARE VICTIMS OF INTRA-FAMILY VIOLENCE; PROVIDING A SEVERA- BILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ORDINANCES IN CONFLICT HEREWITH; AND APPROVING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the City Manager of the City of Fort Worth shall be provided with such revenue as may be secured from various sources included in Ordinance No. 7787 and in the Budget of the City Manager; and in addition thereto there is appropriated $79,368 from the General Fund balance to Account No. 90-62-00 for the purpose of providing funds, to be disbursed under contract, to reimburse Women's Haven, Inc. , for expenses incurred in providing temporary shelter to Fort Worth residents that are victims of intra-family violence. SECTION 2. Should any part, portion, section or part of a section of this ordinance be declared invalid or inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way affect the remaining portions, parts, sections or parts of sections of this ordinance, which provisions shall be, remain and continue to be in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 7787, but all other ordinances and appropriations for which provision has been heretofore made are hereby expressly repealed if in conflict with the provisions of this ordinance. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. A short time after the budget was adopted, the City Attorney received a Texas Attorney General's opinion which indicated that there is no legal obstacle to the City entering into a contractual agreement for the funding of Women's Haven, Inc. On November 11, 1978, the City Council adopted CP-44 which approved the con- cept of entering into a contractual agreement with Women's Haven, Inco The contract provides for City reimbursement to Women's Haven, Inco on a per diem basis for services provided to Fort Worth residents victimized by intrafamily violence. The total reimbursement to Women's Haven, Inc, under the contract shall not exceed $79,368, Staff was directed to work out details and submit the proposed contract to the City Council for approval. The proposed contract will contain the following provisions; 1) The City of Fort Worth will reimburse Women's Haven, Inco monthly at the rate of $23047 per person per day for qualifying Fort Worth residents staying in a Women's Haven shelter from October 1, 1978, through September 30, 19799 up to a maximum of $79,368. The reimburse- ment will be made for both women and their children. 2) The term of the contract shall be from the date of its execution through September 309 1979, with a thirty-day cancellation clause for either party, Financing Funds are available in the General Fund Balance.
