AN ORDINAN.GE VACATING ABANDONING, AND CLOSING AND EXTIN-
GUISHING THOSE CERTAIN OPEN SPACE AND UTILITY EASEMENTS
DESCRIBED MORE SPECIFICALLY HEREIN LYING ON, OVER, AND
WITHIN THE OVERTON WOODS ADDITION TO THE CITY OF FORT
WORTH; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
THAT THOSE certain open space and utility easements lying on,
over, and within the Overton Woods Addition to the City of Fort
Worth, said easements being described more specifically in
Exhibit "A" attached hereto and incorporated by reference herein for
all purposes be and the same are vacated, abandoned, and permanently
closed and extinguished as open space and utility easements.
SECTION 2.
That all ordinances or parts of ordinances in conflict herewith
are hereby repealed.
SECTION 3.
That this ordinance shall take effect and be in full force and
effect from and after the date of its passage, and it is so or-
dained.

.RECOMMENDATION
It is recommended that the City Couuncil adopt an ordinance vacating the existing
Restricted Open Space and Utility Easements located adjacent to and between Lots
27-56, Lots 62-69 & Lot B, Block 9-R, Overton Woods Addition, as recorded in
Volume 388-171, page 64, P.R.T.C.T.
DISCUSSION
Jerry Thomas, on behalf of Belaire Land Corp., owner of all abutting property,
has requested that the City vacate the above-described Restricted Open Space &
Utility Easements, as shown on the attached map.
The subject easements, acquired by dedication, are platted and contain electtric,
gas, and telephone utility facilities. The subject vacation request is made in
order to replat the vacated easements with adjacent property, to expand the
building area, and provide more usable yard space.
The required and appropriate monetary consideration has been placed in escrow
with the Real Property Department, as required by the Land Agent for the City of
Fort Worth.
Reviewing City departments and private utility companies have raised no objec-
tions to this request, subject to the vacated easement being replatted with adja-
cent property. A satisfactory replat has been submitted.
