HomeMy WebLinkAboutOrdinance 9736 '".'~ 3 ;t> - ORDINANCE NO.~~ AN ORDINANCE VACATING, ABANDONING, AND CLOSING AND EXTIN- GUISHING; A) THE 1200 BLOCK OF WEST CANNON AVENUE FROM THE WEST RIGHT-OF-WAY LINE OF SOUTH HENDERSON STREET WEST TO THE EAST RIGHT -OF-WAY LINE OF FIFTH AVENUE; AND, B) THE 15' ALLEY RUNNING NORTH-SOUTH WITHIN BLOCK 3 OF THE SANDIDGE ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS, AS SAME IS SHOWN ON THE PLAT OF SAID ADDI- TION RECORDED IN VOLUME 47, PAGE 69 OF THE PLAT RECORDS OF TARRANT COUNTY, TEXAS; PROVIDING FOR REVERSION OF FEE IN SAID LAND(S); REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS e SECT ION 1. 4 THAT, a) the 1200 Block of West Cannon Avenue from the west right-of-way line of South Henderson Street west to the east right- of-way line of Fifth Avenue; and, b) the 15' alley running north- south within Block 3 of the Sandidge Addition to the City of Fort Worth, Tarrant County, Texas, as same is shown on the plat of said addition recorded in Volume 47, Page 69 of the Plat Records of Tarrant County, Texas, be and the same are vacated, abandoned, and permanently closed and extinguished . SECT ION 2. That the fee to the land(s) in the above described vacated portion of West Cannon Avenue and the 15° alley more particularly described above are hereby released and shall revert to the adjacent owner(s) as provided by law, SAVE AND EXCEPT that easements are retained for any and all existing and prospective utilities and any and all existing and prospective drainage requirements, as neces- sary. t ry y` .a. c~ ~ ~~ ~ 1 .~., , ~` ,. NUMBER tiACATION OF STREET AND ALLEY e PZ-1422 SANDIDGE ADDITION, BLOCKS 2 AND for 1.__ DEVELUPMENr X30/7/86 ** ~'~ + RECOMMENDATION + Y t is recommended that the City Council adopt an ordinance vacating the 1200 block of West Cannon Avenue and the 15' wide north/south alley in Block 3, Sandidge Addition, as recommended by the City Plan Commission. DISCUSSION Harris Hospital-Plethodist, with the written consent of all abutting property owners, has requested that the City vacate the 1200 block of West Cannon Avenue from South Henderson Street west to 5th Avenue, and the 15' aide north/south alley in Block 3, Sandidye Addition, from blest Cannon Avenue south to West Cooper Street, as shown on the attached map. The subject street and alley riyhts-of-way, acquired by dedication, are open on the yround and contain sewer, electric, and telephone utility facilities. The subject vacation request is made in order tc replat the vacated riyhts-of-way with adjoining property to facilitate the expansion of the Harris Hospital complex. The subject vacation request was submitted and reviewed prior to tine adoption of the City's compensation policy, therefore, compensation for the vacated riyhts- of-way is not required. The City Plan Commission has reviewed this request and recommends that the sub- ject rights-of-way be vacated as requested. Reviewing City departments and private utility companies have raised no objec- tions to this request, provided the vacated rights-of-way are replatted with adjacent property. A satisfactory replat has been submitted.
