ORDINANCE NO. ~
AN ORDINANCE VACATING, ABANDONING, AND CLOSING AND EXTIN-
GUISHING THE UTILITY EASEMENTS DESCRIBED MORE SPECIFI-
CALLY HEREIN, SAID UTILITY EASEMENTS LYING WITHIN THE ALTA
MERE ADDITION TO THE CITY OF FORT WORTH; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE
DATE .
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
THAT THOSE certain utility easements, described more specifi-
cally in Exhibit "A" attached hereto and incorporated herein by
reference for all purposes, lying within Blocks 3 and 8 of the Alta
Mere Addition to the City of Fort Worth, Tarrant County, Texas, the
plat of said Alta Mere Addition being recorded in Volume 1037,
Page 413 of the Deed Records of Tarrant County, Texas, be and the
same is vacated, abandoned, and permanently closed and extinguished.
SECTION 2 .
That all ordinances or parts of ordinances in conflict herewith
are hereby repealed.
SECTION 3 .
That this ordinance shall take effect and be in full force and
effect from and after the date of its passage, and it is so or-
dained.

ABANDONMENT OF 8 FOOT UTILITY EASEMENT
BEING the abandonment of approximately 210 linear feet of an 8 foot utility easement
centered on the rear lot lines of Lots 4-6, 10-12 and the remaining portions of Lots 3 and
9, Block 3, Alta Mere Addition as recorded in Volume 1037, Page 413, D.R.T.C.T.,
situated in the Hays Covington Survey, Abstract No. 256, Tarrant County, Texas, more
particularly described as follows:
BEGINNING at a point North a distance of 177.50 feet from the southeast corner of Lot
IR, Block 3, Alta Mere, as recorded in Volume 388-104, Page 188, D.R.T.C.T.;
THENCE North continuing along the east line of said.Lot IR a distance of 8.00 feet to a

THENCE East a distance of 210.00 feet to the west right-of-way of Joyce Drive;
THENCE South along the west right-of-way of Joyce Drive a distance of 8.00 feet to a
point;
THENCE West a distance of 210.00 feet, returning to the POINT OF BEGINNING and

Being the abandonment of approximately 726 linear feet of a 60 foot utility easement,
formerly Joyce Drive (right-of-way vacated by City Ordinance No. 8401) located in Lots
I -R2 and I S-R, Block 7 and Lot I -R, Block 8, Alta Mere Addition, as recorded in Volume
388-144, Page 62, D.R.T.C.T., situated irr the Hays Covington Survey, Abstract No. 256,
Tarrant County, Texas, more particularly described as follows:
BEGINNING at a point on the north right-of-way of Rosewood Avenue, being West along
the north right-of-way of Rosewood Avenue a distance of 30.00 feet from the southeast
corner of said Lot I -R, Block 8:
THENCE North a distance of 726.00 feet to the south right-of-way of Ashville Avenue;
THENCE East along the south right-of-way of Ashville Avenue a distance of 60.00 feet;
THENCE South a distance of 726.00 feet to the north right-of-way of Rosewood Avenue;
THENCE West along the north right-of-way of Rosewood Avenue a distance of 60.00 feet,
returning to the POINT OF BEGINNING and containing 43,560 square feet.

D.R.T.C.T., situated in the Hays Covington Survey, Abstract No. 256, Tarrant County,
Texas, more particularly described as follows:
BEGINNING at a point on the north right-of-way of Rosewood Avenue, being East a
distance of 176.00 feet from the intersection of the east right-of-way of Marquita Drive
and the north right-of-way of Rosewood Avenue:
THENCE North a distance of 541.50 feet to a point;
THENCE West a distance of 176.00 feet to a point on the east right-of-way of Marquita
Drive;
THENCE North along the east right-of-way of Marquita Drive a distance of 8.00 feet to a
point;
THENCE East a distance of 360.00 feet to a point on the western edge of a 60 foot utility
easement, said easement being the former right-of-way of Joyce Drive (as vacated by
city ordinance No. 840 I );
THENCE South along said 60 foot easement a distance of 8 feet to a point;
THENCE West a distance of 176.00 feet to a point;
THENCE South a distance of 541.50 feet to a point on the north right-of-way of
Rosewood Avenue;
THENCE West along the north right-of-way of Rosewood Avenue a distance of 8.00 feet,

east/west and north/south utility easement, containing a total of 900.5 linear
feet, and located within Lot 1-R, Block 8, Alta Mere Addition, both as recorded
in Volume 388-144, Page 62, P.R.T.C.T., and an 8' wide x 210' long east/west
utility easement centered on the common property line for Lots 4-6, 10-12 and
the remainders of Lots 3 and 9, Block 3, Alta P1ere Addition, as recorded in
Volume 1037, Paye 413, D.R.T.C.T.
DISCUSSION
David Ryan, owner of abutting property, has requested that the City vacate the
above described utility easements as shown on the attached map.
he subject easements, acquired by dedication, are platted and contain water
tility facilities. However, the Water Department has received and accepted a
eparate written instrument, which re-establishes the easements protecting the
ater utility facilities, and stated that said written instrument is not required
o be shown on the submitted replat. The subject vacation request is made in
rder to utilize portions of the vacated easements to expand the building area
nd provide more usable yard space.
he required and appropriate monetary consideration has been placed in escrow
ith the Real Property Department, as required by the Land Agent for the City of
ort Worth. Reviewing City departments and private utility companies have raised
0 objections to this request. A satisfactory replat has been submitted.
