HomeMy WebLinkAboutOrdinance 9740.~ ORDINANCE N0. ,~ ORDINANCE ACCEPTING IMPROVEMENTS ON A PORTION OF HANDLEY-IDERVILLE ROAD AND PORTIONS OF SUNDRY OTHER STREETS, AVEN[JES AND PUBLIC PLACES 3N THE CITY OF Ft~RT WORTH, TEXAS; DECLARING THE CONTRACT WITH NEWELL/EBY JOINT VII~FI'URE FOR THE CONSTRUCTION OF SAID IMPROVFd~TI'S FULLY COMPLETED AND PERFORMED; DIRECTING THE ISSUANCE, EXECLFrION AND DELIVERY OF CERTIFICATES IN EVIDENCE OF SPECIAL ASSESSMENTS LEVIED AFTEEt GIVING EFFECT TO SUNDRY CREDITS HEREIN AUTHORIZED AND ALJAWED AGAINST SOME OF SAID ASSESSMENTS; DIRECTING THE CITY SECRETARY Tb ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL OF FORT WORTH, TEXAS, AND BY FILING THE COMPLETE ORDINANCE IN APPROPRIATE ORDINANCE RECORDS OF SAID CITY; AND PROVIDING AN EFFECTIVE DATE. WEIEREAS, the City of Fort Worth, Texas has heretofore entered into a contract with State Department of Highways and Public Transportation, for the making and construction of certain street improvements,on the hereinafter described portions of streets, avenues and public places in said City, to wit: HANDLEY-EDERVILLE ROAD From Midway Road to twenty-feet south of Jack Newell Boulevard South, known and designated as Project No. 30-036688-00, a seven-inch thick reinforced concrete pavement with a seven-inch high attached concrete curb on a six-inch thick cement modified subgrade, so that the finished roadway will be sixty feet wide. Six-inch thick concrete driveway approaches will be constructed where required and seven-inch thick reinforced concrete curb openings at private street intersections. WHEREAS, by sundry proceedings heretofore passed by the City Council of the City of Fort Worth, Texas, including Ordinance No. 9478 , a portion of the cost of said improvements was levied and assessed against the respective properties abutting on each of the above described portions of streets, avenues and public places and against the real and true owners thereof; and, WEIEREAS~ the City,Council of the CitX of Fort Worth, Texas, has, upon review, found and determined that, in some instances, in order to effect substantial justice and equality, it is desirable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance No. .9478 , and WHEREAS, the street improvements hereinabove mentioned have been completed upon each of the portions of streets., avenues and public places hereinabove described, and have been inspected and found to be in complete accordance with the contract therefore; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF Ft~RT WORTH, TEXAS, THAT : I. The improvements on each of the portions of streets, avenues and public places hereinabove described be, and they are hereby, accepted; and the contract with reference thereto be, and it is hereby, found and declared fully complete and performed. II. The Mayor, be, and he is hereby, directed to issue and execute in the name of the City, certificates in evidence of the special aseesments levied against abutting property and the owners thereof for such improvements, and the City Secretary is directed to attest same and impress thereon the corporate seal of the City, all in accordance with the proceedings relating to such improvements and assessments. The certificates shall be numbered, shall describe the property against which the assessment has been levied, shall, where known, state the name or names of the true owners of the respective parcels of property assessed and shall be issued in an amount equal to the difference between the principal amount of the assessment and the amounts of any credit issued thereon. The numbers of the certificates, with the property descriptions to be shown on the respective certificates, together with the names of the owners of said property, the principal amount of the assessment, the respective credits, if any which are hereby authorized, granted and allowed against the principal amount of some one or more of the assessments heretofore levied, and the principal amount for which each certificate is to be issued after giving effect to such credit, if any, are hereby enumerated and itemized as follows: -2- ~, IIL. When each of the certificates has been duly executed as hereinabove provided, same shall be delivered to the Tax Assessor-Collector as part payment of the contract price, VI. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council of Fort Worth, Texas, and by filing the complete ordinance in the appropriate Ordinance .Records of said City.
