AN ORDINANCE DECREASING THE FUNDING APPROPRIATED TO THE AIR POLLUTION CONTROL PROGRAM, NONDEPARTMENTAL ACCOUNT NO. 90-35-00, IN ORDINANCE NO. 9690 FOR FISCAL YEAR 1986-1987 BY $124,326 AND TRANSFERRING SAID AMOUNT TO PUBLIC HEALTH DEPARTMENT, ACCOUNT N0. 50-30-04, THEREBY INCREASING APPROPRIATIONS IN THAT ACCOUNT FOR THE PURPOSE OF FUNDING THE ACTIVITIES OF LOCAL AIR PROGRAM; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULA- TIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDI- NANCES IN CONFLICT HEREWITH; PROVIDING FOR ENGROSSMENT AND ENROLLMENT; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1 . That the appropriation to the Air Pollution Control Program, Nondepartment Account No. 90-35-00, made in Ordinance 9690 and the Budget of the City Manager, is hereby decreased in the amount of $124,326, and said sum is hereby transferred to Public Health Department, Account No. 50-30-04, increasing the appropriation made to that account by the amount of $124,326 for the purpose of funding the activities of the Local Air Program. SECT ION 2. , Should any portion, section or part of a section of this ordi- nance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections or parts of sections of this Ordinance, which said remaining provisions shall be and remain in full force and effect. T rt ~` SECTION 3 . This ordinance shall be cumulative of Ordinance No. 9690, and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instances said conflicting provisions are hereby expressly repealed. SECTION 4 . The City Secretary of the City of Fort Worth is hereby directed to engross and enroll this Ordinance by copying the caption and Sections 1 and 5 in the minutes of the City Council and by filing the ordinance in the ordinance records of the city. SECT ION 5 . That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so or- dained. BACKGROUND On July 22, 1986 (P1&C G-6744), City Council authorized the City Manager to forego submitting a proposal to the Environmental Protection Agency for the Air Pollu- tion Program and fund the program on a local basis. The funding for the local Air Program in the amount of $124,326 was budgeted in the General Fund O1, Non-Departmental, Account No. 90-35-00. In order to utilize these funds, a transfer to the Health Department account is necessary.
