ORDINANCE N0. .~
AN ORDINANCE VACATING, ABANDONING, AND CLOSING AND EXTIN-
GUISHING THAT PORTION OF EAST FIRST STREET IN THE CITY OF
FORT WORTH DESCRIBED MORE SPECIFICALLY HEREIN; PROVIDING
FOR REVERSION OF FEE IN SAID LAND (S) ; REPEALING ALL ORDI-
NANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS
SECT ION 1 .
THAT THE portion of East First Street, a public street and
right-of-way in the City of Fort Worth, Tarrant County, Texas, said
portion being described more specifically in Exhibit "A" attached
hereto and incorporated herein by reference for all purposes, be and
the same is vacated, abandoned, and permanently closed and extin-
guished.
SECT ION 2 .
That the fee to the land(s) in the above described vacated
portion of East First Street is hereby released and shall revert to
the adjacent owner(s) as provided by law, SAVE AND EXCEPT that
easements are retained for any and all existing and prospective
utilities and any and all existing and prospective drainage require-
ments, as necessary.
SECT ION 3 .
That all ordinances or parts of ordinances in conflict herewith
are hereby repealed.

That this ordinance shall take effect and be in full force and
effect from and after the date of its passage, and it is so or-
dained.

It is recommended that the City Council adopt an ordinance vacating a 44.08' x
`?5.89' x 42.19' x 145.36' section of the East First Street right-of-way located
between the westerly right-of-way line of Rayner Avenue westward to the east line
of the Trinity River levee (Tarrant County Water Control and Improvement District
No. 1 property), as reccommended by the City Plan Commission.
DISCUSSION
James L. Brittain, owner of abutting property, has requested that the City vacate
the above-described street right-of-way, as shown on the attached map:
The subject street right-of-way, acquired by dedication, is poorly paved without
curb and gutter, and contains water, sewer, gas and telephone utility facili-
ties. The subject vacation request is made in order to replat the vacated
right-of-way with adjacent property, to expand the building area, and provide
more usable yard space.
The required and appropriate monetary consideration has been placed in escrow
with the Real Property Department, as required by the Land Agent for the City of
Fort Worth.
Reviewing City departments and private utility companies have raised no objection
to this request, subject to the vacated right-of-way being replatted with adja-
cent property, and that the required replat include dedication of utility ease-
ments for all existing and proposed utility facilities. A satisfactory replat
has been submitted.
