AN ORDINANCE CALLING FOR AND ORDERI G AN ELECTION FOR MARCH 22, 1986, ON THE QUESTION OF THE ISSUANCE OF BONDS ,' WHEREAS, the City Council of said City deems it advis- able to issue the bonds of said City for the purposes hereinafter stated; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That an election shall be held in said City on Satur- day, the 22nd day of March, 1986, between the hours of 7:00 A.M. and 7:QO P.M., in the several regular Election Pre- cincts of said City which are the regular precincts of Tarrant County, Texas, to the extent they are within the city limits of said City, and at the Polling• Places as set forth on Exhibit "A" attached hereto and made a part hereof. SECTION 2. That the City4 Council shall appoint a Presiding Judge and an alternate presiding judge for each precinct. -~ Each Presiding Judge shall appoint not less than two nor more than two qualified election clerks to serve and assist in conducting said election, provided that if the Presiding Judge actually serves as expected, the Alternate Presiding Judge shall be one of such clerks. SECTION 3. That at said election, the following propositions shall be submitted in accordance with law: ` ~ _r ....« PROPOSITION N0. 1 Shall the City Council of said City be authorized to issue the bonds of said City, in one or more series or issues, in the aggregate principal amount of $115,600,000, with the bonds of each such series or issue, respectively, to mature serially within not to exceed forty years from their date, and to be sold at such prices and bear interest at such rates as shall be determined within the discretion of the City Council, for the purpose of constructing perma- nent street and storm sewer improvements by reconstructing, restructuring and extending the streets, thoroughfares, collectors and storm drains in said City, and related street and storm sewer improvements; and shall said City Council be authorized to levy and cause to be assessed and collected annual ad valorem taxes in an amount sufficient to pay the annual interest on said bonds and provide a sinking fund to pay said bonds at maturity? PROPOSITION NO. 2 Shall the City Council of said City be authorized to issue the bonds of said City, in one or more series or issues, in the aggregate principal amount of $16,650,000, with the bonds of each such series or issue, respectively, to mature serially within not to exceed forty years from their date, and to be sold at such prices and bear interest at such rates as shall be determined within the discretion of the City Council, for the purpose of improving land for park and recreation purposes by constructing new improve- ments to the City's park and recreation system facilities, renovating existing facilities and enlarging other such facilities; and shall said City Council be authorized to levy and cause to be assessed and collected annual ad valorem taxes in an amount sufficient to pay the annual interest on said bonds and provide a sinking fund to pay said bonds at maturity? g PROPOSITION N0. 3 Shall the City Council of said City be authorized to issue the bonds of said City, in one or more series or issues, in the aggregate principal amount of $10,000,000, .with the bonds of each such series or issue, respectively, to mature serially within not to exceed forty years from their date, and to be sold at such prices and bear interest at such rates as shall be determined within the discretion of the City Council, for the purpose of making improvements to the Central Library and expanding the City's library system by constructing an East Regional Library and a Diamond Hill Branch Library; and shall said City Council be authorized to Ievy and cause to be assessed and collected annual ad valorem taxes in an amount sufficient to pay the annual interest on said bonds and provide a sinking fund to pay said bonds at maturity? PROPOSITION N0. 4 Shall the City Council of said City be authorized to issue the bonds of said City, in one or more series or issues, in the aggregate principal amount of $5,750,000, with the bonds of each such series or issue, respectively, to mature serially within not to exceed forty years from their date, and to be sold at such prices and bear interest at such rates as shall be determined within the discretion of the City Council, for the purpose of making permanent public safety improvements, to-wit: building and equipping new police and fire facilities, and renovating existing police and fire facilities; and shall said City Council be authorized to levy and cause to be assessed and collected annual ad valorem taxes in an amount sufficient to pay the annual interest on said bonds and provide a sinking fund to pay said bonds at maturity? PROPOSITION NO. 5 Shall the City Council of said City be authorized to issue the bonds of said City, in one or more series or issues, in the aggregate principal amount of $12,000,000, with the bonds of each such series or issue, respectively, to mature serially within not to exceed forty years from their date, and to be sold at such prices and bear interest at such rates as shall be determined within the discretion of the City Council, for the purpose of constructing permanent improvements at the City's Will Rogers Memorial Complex; and shall said City Council be authorized to levy and cause to be assessed and collected annual ad valorem taxes in an amount sufficient to pay the annual interest on said bonds and provide a sinking fund to pay said bonds at maturity? PROPOSITION N0. 6 Shall the City Council of said City be authorized to issue the bonds of said City, in one or more series or issues, in the aggregate principal amount of $4,900,000, with the bonds of each such series or issue, respectively, to mature serially within not to exceed forty years from their date, and to be sold at such prices and bear interest at such rates as shall be determined within the discretion PROPOSITION N0. 4 FOR ) PUBLIC SAFETY IMPROVEMENT BONDS IN THE AGGREGATE SUM OF $5,750,000 AGAINST ) PROPOSITION N0. 5 FOR ) WILL ROGERS MEMORIAL COMPLEX IMPROVEMENT BONDS IN THE AGGREGATE SUM OF $12,000,000 AGAINST ) PROPOSITION N0. 6 FOR TRINITY RIVER GREENBELT FROM TRINITY PARK TO RIVERSIDE PARK (HERITAGE TRAIL DEVELOPMENT) IMPROVEMENT BONDS IN THE AGGREGATE SUM OF $4,900,000 AGAINIST ) That said ballots shall be printed in English and in Spanish for use in said election. SECTION 6 That the City Secretary of the City of Fort Worth shall be the clerk for absentee voting at said election. Absentee voting shall be conducted by two methods: A. Voting by personal appearance; and B. Voting by mail. Absentee voting by personal appearance shall be conducted in the south lobby of the City Hall, 1000 Throckmorton Street, Fort Worth, Texas, during those hours that the City Secre- tary's Office is open for business, those hours being on weekdays only, beginning at 8:00 A.M. and ending at 5:00 P.M. Said absentee voting shall begin on Monday, March 3, i i of the City Council, for the purpose of improving land for park purposes by constructing permanent improvements to the Trinity River greenbelt from Trinity Park to Riverside Park (Heritage Trail Development); and shall said City Council be authorized to levy and cause to be assessed and collected annual ad valorem taxes in an amount sufficient to pay the annual interest on said bonds and provide a sinking fund to pay said bonds at maturity? SECTION 4. That all resident, qualified electors of the City shall be entitled to vote at said election. SECTION 5. That the official ballots for said election shall be prepared in accordance with the Texas Election Code so as to permit the electors to vote "FOR" or "AGAINST" the aforesaid Propositions, which shall be set forth in substantially the following form: PROPOSITION N0. 1 FOR ) STREET AND STORM SEWER IMPROVEMENT BONDS IN THE AGGREGATE SUM OF $115,600,000 AGAINST ) PROPOSITION NO. 2 FOR ) PARKS AND RECREATION SYSTEM IMPROVEMENT BONDS IN THE AGGREGATE SUM OF $16,650,000 AGAINST ) PROPOSITION NO. 3 FOR ) LIBRARY SYSTEM IMPROVEMENT BONDS IN THE ) AGGREGATE SUM OF $10,000,000 AGAINST ) 1986, and shall end at 5:00 P.M. on March 18, 1986. Said absentee voting shall be conducted on weekdays only. The Absentee Ballot Board is hereby created to process absentee voting results, and Ralph LeMond is hereby ap- pointed as Presiding Judge. The Presiding Judge shall appoint at least two other members of such Board. A. An electronic voting system, as defined in Chapter 121 of the Texas Election Code, shall be used for voting on the Propositions prescribed herein, and for the counting of the ballots and the tabulation of the results. Said elec- tronic voting system shall be used for absentee voting by personal appearance, for absentee voting by mail, and for voting at the regular polling places at said election. The conduct of the election and the use of the electronic voting system shall be in accordance with the Texas Election Code. B. The City Secretary's Office located at City Hall, 1000 Throckmorton Street, Fort Worth, Texas, is hereby established as the Central Counting Station for counting the ballots cast in said election and the tabulation of the results. C. Ruth Howard Alexander, having knowledge and exper- ience in the conduct of elections with the electronic voting system for which the Counting Station is established, and being a registered voter of the City of Fort Worth, is hereby appointed as the Counting Station Manager. The Counting Station Manager shall be in charge of the overall administration of the Central Counting Station and the general supervision of the personnel working at said Sta- tion. D. Jay Marshall, being trained in the operation of the automatic tabulating equipment installed at the Central Counting Station, is hereby appointed Tabulation Supervisor of the Central Counting Station. The Tabulation Supervisor shall be in charge of the operation of the automatic tabula- ting equipment at the Central Counting Station. E. The appointments of Don Morris, Mike Little, and Kay Cecil as Assistants to the Tabulation Supervisor are hereby approved. They shall assist the Tabulation Super- visor in the operation of the automatic tabulating equipment as directed by the Tabulation Supervisor. F. Jack W. Green is hereby appointed as Presiding Judge of the Central Counting .Station. He shall maintain order at the Central Counting Station and shall have such authority as may be prescribed by the Texas Election Code. The Presiding Judge of the Central Counting Station shall receive the same compensation per hour as the Presiding Precinct Judges, except that he will be entitled to a minimum compensation of five (5) hours' pay regardless of the amount of time worked. SECTION 9 That notice of said election shall be given by posting a substantial copy of this Ordinance in English and in Spanish in three (3) public places of said City and also at the City Hall, not less than 15 days prior to the date set for said election; and a substantial copy of this Ordinance also shall be published on the same day in each of two successive weeks in a newspaper of general circulation i published in said City, the date of the first publication to ~ i be not less than 14 days prior to the date set for said election. SECTION 10 That it is hereby officially found and determined that the meeting at which this Ordinance was adopted and said election was called was open to the public and public notice of the time, place and purpose of said meeting was given, all as required by Vernon's Annotated Civil Statutes, Article 6252-17, as amended.
