HomeMy WebLinkAboutResolution 4596-02-2016 A Resolution NO. 4596-02-2016 SUPPORTING A HOUSING TAX CREDIT APPLICATION FOR THE STANDARD AT BOSWELL MARKETPLACE AND LOCAL GOVERNMENT COMMITMENT WHEREAS, the City's 2015 Comprehensive Plan is supportive of the preservation, improvement, and development of quality affordable accessible rental and ownership housing; WHEREAS, the City's 2013-2018 Consolidated Plan makes the development of quality affordable accessible rental housing units for low income residents of the City a high priority; WHEREAS, The Standard at Boswell Marketplace, LP, an affiliate of Standard Residential, LLC, has proposed a development for affordable mixed income multifamily rental housing named The Standard at Boswell Marketplace to be located at the northwest corner of Old Decatur Road and West Bailey Boswell Road in the City of Fort Worth; WHEREAS, The Standard at Boswell Marketplace, LP has advised the City that it intends to submit an application to the Texas Department of Housing and Community Affairs ("TDHCA") for 2016 Competitive (9%) Housing Tax Credits for The Standard at Boswell Marketplace, a new complex consisting of approximately 130 units, of which at least ten percent (10%) will be dedicated for Rental Assistance Demonstration units and at least five percent (5%) will be market rate units; WHEREAS, TDHCA's 2016 Qualified Allocation Plan provides that an application for Housing Tax Credits may qualify for up to seventeen (17) points for a resolution of support from the governing body of the jurisdiction in which the proposed development site is located. WHEREAS,the QAP also awards one (1)point for a commitment of development funding from the city in which the proposed development site is located. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: The City of Fort Worth, acting through its City Council, hereby confirms that it supports the application of The Standard at Boswell Marketplace, LP to the Texas Department of Housing and Community Affairs for 2016 Competitive (9%) Housing Tax Credits for the development of The Standard at Boswell Marketplace to be located at the northwest corner of Old Decatur Road and West Bailey Boswell Road (TDHCA Application No. 16015), and that this formal action has been taken to put on record the opinion expressed by the City Council of the City of Fort Worth. ORT WORT The City of Fort Worth, acting through its City Council, additionally confirms that it will commit to development fee waivers in an amount not to exceed $1,500.00 to The Standard at Boswell Marketplace, LP, conditioned upon receipt of Housing Tax Credits. The City Council finds that the waiver of such fees serves the public purposes of providing quality, accessible, affordable housing to low and moderate income households in accordance with the City's Comprehensive Plan and Action Plan. The City of Fort Worth, acting through its City Council, further confirms that the City has not first received any funding for this purpose from the Applicant, affiliates of the Applicant, or any Consultant, General Contractor or Guarantor of the proposed development or any party associated in any way with the Applicant, The Standard at Boswell Marketplace, LP. Acknowledge receipt of requests for support for applications for 2016 Competitive (9%) Housing Tax Credits from various developers; 2. Consider and adopt the attached Resolutions for 2016 applications for Competitive (9%) Housing Tax Credits for the seven multifamily housing developments listed below to be located at various sites throughout the City, in accordance with the City's policy; and 3. Approve the commitment of development fee waivers in an amount not to exceed $1,500.00 for each of the multifamily developments listed below, and find that the waiver of such fees serves the public purpose of providing quality, accessible, affordable housing for low to moderate-income households in accordance with the City's Comprehensive Plan and Annual Action Plan. DISCUSSION: On February 9, 2016, the City Council approved Mayor and Council Communication (M&C) G-18664 which adopted a policy for Council Resolutions of Support or No Objection for 2016 applications to the Texas Department of Housing and Community Affairs (TDHCA) for Competitive (9%) Housing Tax Credits and for local government commitment of development funding. The approved policy states that in order to obtain a Resolution of Support, a development must have the following: 1. Either (a) ten percent of the total units dedicated for Rental Assistance Demonstration (RAD), or (b) five percent of the total units dedicated for Permanent Supportive Housing and a minimum of five percent of the units dedicated as market rate; and 2. Appropriate zoning for the intended use of site. If the site does not have appropriate zoning, then Staff must review the request for the zoning change and the Councilmember must support the rezoning request. Council may consider providing a Resolution of No Objection for applications that do not qualify under the policy for a Resolution of Support. Logname: 19RESOLUTION FOR 2016 NINE PERCENT TAX CREDIT APPLICATION Page 1 of 4 Resolutions of Support: Staff requests that the City Council consider and adopt Resolutions of Support for the applications listed below as the Fort Worth Housing Authority (FWHA) has confirmed that the applicants have met the policy's requirements by agreeing with the FWHA to set aside a minimum of ten percent of the total units in their developments for RAD units, and have met the zoning requirements: Avondale Farms Seniors to be developed by Avondale Farms Seniors, LP, an affiliate of GFD Holdings, LLC, to be located at the southeast corner of US 287 and Avondale-Haslet Road (Council District 7, Mapsco 4V and 5S). The site for the proposed development is zoned " PD-828 PD/C - Medium Density Residential" which allows for two-story multifamily residential. Churchill at Golden Triangle Community to be developed by Churchill Golden Triangle Community, L.P., an affiliate of Churchill Senior Communities, L.P., to be located at the 11000 block of Metroport Way (formerly Keller Hicks Road),. south of Timberland Boulevard and east of the 11000 block of IH-35W Service Road (Council District 7, Mapsco 21 G and 21 L). The site for the proposed development is zoned "G - Intensive Commercial ", but Councilmember Shingleton supports the zoning change to "D - High Density Multifamily" . Harmon Senior Villas to be developed by AMTEX Harmon, L.P., an affiliate of AMTEX Multi-housing, LLC, to be located at 12801 Harmon Road in the City's extraterritorial jurisdiction (Council District 7, Mapsco 21 J and 21 K). This applicant will also provide ten pereent of the 10 total units for Permanent Supporting Housing units in addition to the RAD and market rate units. Councilmember Shingleton supports the annexation and a zoning change to "PD/D - High Density Multifamily". The Standard at Boswell Marketplace to be developed by The Standard at Boswell Marketplace, LP, an affiliate of Standard Residential, LLC, to be located at the northwest corner of Old Decatur Road and West Bailey Boswell Road (Council District 7, Mapsco 33K). The site for the proposed development is zoned "C - Medium Density MultifamilyDevelopment, LEG, to be located north of MeAlister Road and east of 1 lemphill Street (6otineil Di-116-1.". Tram's at MeAllister to be developed by TX McAlister 2016, Ltd., an affiliate of Generation 1 10 1 , Mapsco 11 9N). The site for the proposed developfflent is zoned "G - Medium Density Multifarnily-IL Woodlawn Place to be developed by Tremore Marine Creek, L.P., an affiliate of Carleton Development, Ltd., to be located at the southeast corner of Bowman-Roberts Road and Cromwell-Marine Creek Road (Council District 2, Mapsco 46C and 46D). The site for the proposed development is zoned " C - Medium Density Multifamily and E - Neighborhood Commercial" . Councilmember Espino supports the necessary zoning change for a portion of the site. Resolutions of No Objection: Based on the policy, Staff requests that the City Council consider and adopt Resolutions of No Objection for the following applications: Park Summit Apartments to be developed by Pedcor Investments-2016-CLV, L.P., an affiliate of Pedcor Investments, LLC to be located at 7450 Parkwood Hill Boulevard (Council District 4, Mapsco 36R). The site for the proposed development is zoned "E - Neighborhood Commercial". Trails at McAlister to be developed by TX McAlister 2016, Ltd., an affiliate of Generation Housing Development, LLC, to be located north of McAlister Road and east of Hemphill Street (Council District 6, Mapsco 119N). The site for the proposed development is zoned "C - Medium Density Multifamily ". This local commitment of development funding would qualify for an additional point for applicants and increase the competitiveness of their applications. Staff requests that Council consider development fee waivers in an amount not to exceed $1,500.00 for the following applications: Harmon Senior Villas to be developed by AMTEX Harmon, L.P., an affiliate of AMTEX Multi-housing, LLC, to be located at 12801 Harmon Road. Fee waivers will be conditioned upon a proposed development receiving an allocation of Housing Tax Credits by TDHCA. These proposed developments are subject to all applicable City laws, ordinances, policies and procedures including those pertaining to zoning changes and annexation. Councilmember support of zoning changes and annexation for purposes of these Resolutions does not constitute approval of such required zoning change or annexation. The proposed developments are located in COUNCIL DISTRICTS 2, 4, 6 and 7. This M&C does not request approval of a contract with a business entity.
