ORDINANCE NO. ~~~ AN ORDINANCE VACAT ING , ABANDONING , AND CLOSING AND EXT IN- GUISHING VARIOUS UTILITY AND INGRESS-EGRESS EASEMENTS LOCATED IN PHASE 1 OF THE MEADOW CREEK ADDITION TO THE CITY OF FORT WORTH IN THE J. JENNINGS SURVEY, A-873, TARRANT COUNTY, TEXAS, SAID EASEMENTS BEING DESCRIBED MORE SPECIFICALLY HEREIN; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1 . THAT THE hereinafter described utility and ingress-egress ~~ easements lying and being situated in Phase 1 of the Meadow Creek Addition to the City of Fort Worth, Texas, in the J. Jennings Survey, A-873, Tarrant County, Texas, said easements being shown on the plat of said Meadow Creek Addition, Phase 1, recorded in Volume 388-163, Page 43 of the Plat Records of T arrant County, Texas, and described more specifically in Exhibit "A" attached hereto and incorporated herein by reference for all purposes, be and the same are vacated, abandoned, and permanently closed and extin- guished. Jennings Survey, Abstract No. and shown on the plat of the south half of Block 9 and all of Block 11, gave and except Lots 23A, 23B, 24A, 24B, 25R and 26R, as recorded in Volume 388/163, Page 43, P.R.T.C.T. DISCUSSION Stephen C. Stolte, Project Manager for Fox and Jacobs, Inc., owner of all abutting property, has requested that the City vacate the above-described ease- ments as shown on the attached map. The subject easements, acquired by dedication, are platted and contain street lights and telephone utility facilities. The subject vacation request is made in order to replat the vacated easements with adjacent property, to expand the building area, and provide more usable yard space. The required and appropriate monetary consideration has been placed in escrow with the Real Property Department, as required by the Land Agent for the City of Fort Worth. Reviewing City departments and private utility companies have raised no objection to this request, subject to the vacated easements being replatted with adjacent property, and necessary replacement utility easements being provided on the re- quired replat. A satisfactory replat has been submitted.
