, THE ITY OF
FORT ~RTH, TEXAS; FIXING TIME AND PLACE FOR HEARING TO THE OWNERS
OF ABUTTING PROPERTY AND TO ALL OTHERS INTERESTID; DIRECTING THE
CITY SECRETARY TO GIVE NOTICE OF SUCH HEARING; ATID DIRECTING THE

CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY OOUNCIL AND BY FILING

CITY; AND PROVIDING AN EFFECTIVE DATE.
~, the City Council of the City of Fort Worth, Texas, has heretofore
ordered that each of the hereinafter described portions of streets, avenues and public
places in the City of Fort Worth, Texas, be improved by raising, grading and filling
same and by constructing thereon the following, to wit:
RAYNER AVENUE From East First Street to S.H. 121, known and des-
ignated as Project No. 29-024320-00, a six-inch
thick reinforced concrete pavement with aseven-inch
high monolithic concrete curb on a six-inch thick
lime stabilized subgrade so that the finished road-
way will be forty feet wide. Six-inch thick concrete
driveway approaches will be constructed where required

together with concrete curbs, gutters, driveways and incidentals to such improvements on
proper grade and line where same are not already so constructed, together with storm
sewers an drains and other necessary incidentals and appurtenances; all of said
improvements to be constructed as and where shown on the Plans and in strict accordance
with the Plans and Specifications therefore; contract therefore has been made and
entered into with JAMES W. JACKSON, INC.
and
WHEREAS, the City Council of the City of Fort Worth, Texas, has caused the Public
Works Director to prepare and file estimates of the cost of such improvements and
estimates of the amount per front foot proposed to be assessed against abutting property
and the owners thereof, and such estimates have been examined, NOW, THEREFORE,
BE IT ORDAINED BY THE CITY OOiJDTCIL OF THE CITY OF FORT WORTH, TEXAS, THAT:
I.
Such estimates be, and they are hereby adopted and approved.
II.
It is hereby found and determined that the cost of improvements on each portion of
streets, avenues, and public places hereinafter described, with the amount or amounts
per front foot proposed to be assessed for such improvements against abutting property
and the owners thereof, are as follows, to-wit:
RAYNER AVEN[7E From East First Street to 5. H.121, ]mown and
designated as Project No. 29-024320-00.
The estimated cost of improvements is $ 73,821.72 the estimated amount per front foot
to be assessed against abutting property and the owners thereof for concrete curb is
$3.43 the estimated amount per front foot to be assessed against abutting property and
the owners thereof for pavement is $ 44.32 the estimated amount per front foot to be
assessed against abutting property and the owners thereof for -0- wide concrete sidewalk
is $ 0.00; the estimated amount per square foot to be assessed against abutting property
and the owners thereof for six-inch thick concrete driveway is $ 2.57 square foot; the
total estimated amount per front foot to be assessed against abutting property and the
owners there of is $47.75, plus the cost incurred for concrete driveway construction
where specified.

III.
A hearing be given and held by and before the City Council of the City of Fort
Worth, Texas, to all owning or claiming any property abutting upon said portions of
highways, streets, avenues and public places, as well as to all owning or claiming any
interest in any such property.. Such hearing shall be given and held on the 25th day of
November , 1986, at 10:00 a.m., in the Council Chamber in the City Hall in the City of
Fort Worth, Texas, and the City Secretary is hereby directed to give or cause to be
given notice of the time and place of such hearing and of other matters and facts in
accordance with the terms and provisions of an Act passed at the First Called Session of
the Fortieth Legislature of the State of Texas, and lmown as Chapter 106 of the Acts of
said Session, now being ]mown as Article 1105b of Vernon's Texas Civil Statutes as
amended by Acts 1967, 60th Legislature, Page 365, Chapter 176, Section 1, ~nergency
effective May 12, 1967. Such notice shall be by advertisement inserted at least three
(3) times in a newspaper published in the City of Fort Worth, Texas, the first
publication to be made at least twenty-one (21) days before the date of said hearing.
Said notice shall comply with and be in accordance with the terms and provisions of said
Act as amended. The City Secretary is further directed to give or cause to be given
personal notice of the time and place of such hearing to all owning or claiming any
groperty abutting on said portions of highways, streets, avenues and public places, as
well as to all owning or claiming any interest in any such property. Such personal
notice shall be in writing and shall be given or caused to be given by the City
Secretary by depositing such written notice in the United States Mail at least fourteen
(14) days before the date of the hearing, postage prepaid, in envelopes addressed to all
persons owning or claiming any interest in the respective properties abutting the
highways, streets, avenues and public places or portions thereof to be improved, as the
names of such persons are shown on the current rendered tax rolls of the City of Fort
Worth and at the addresses so shown, or if the name of such respective owners do not
appear on such rendered tax rolls, then address to such owners as their names are shown
on the current unrendered tax rolls of the City of Fort Worth at the addresses shown
thereon. In those cases in which an owner of property abutting a highway, street,
avenue or public place or portion or portions thereof which is to be improved is listed
as "unlmown" on the then current City of Fort Worth tax rolls, or the name of an owner
is shown on the City of Fort Worth tax rolls but no address for such owner is shown, no
notice need be mailed. In those cases where the owner is shown to be an estate, the
mailed notice may be addressed to such estate. In this connection, the City Secretary
shall prepare and file or cause to be prepared and filed with these proceedings a list
of the properties to be assessed, the names of those person owning or claiming any
interest in said properties to when the notice was mailed, together with the last )mown
addresses determined as aforesaid of the respective owners and those persons owning or
claiming any interest in said property.
The City Secretary shall certify that each of the parties in said list whose
address is shown on the then current rendered or unrendered tax rolls of the City of
Fort Worth was mailed a copy of the notice of hearing and shall further certify the date
or dates on which said notice was mailed. A copy of each notice shall be attached to
such certificate. The certificate of the City Secretary will be conclusive evidence of
the facts therein recited.

IV.
T'he City Secretary is hereby directed to engross and enroll this ordinance by
copying the caption of same in the Minute Book of the City Council and by filing the
complete ordinance in the appropriate Ordinance Records of this City.
V.
This ordinance shall take effect and be in full force and effect from and after
the date of its passage. ;~''

2. authorize the City Manager to execute a contract with James W. Jackson,
Inc. for the construction of Rayner Avenue from East First Street to
SH 121 (Airport Freeway);
3. authorize the City Manager to reject the bid proposals for Water Contract
(Unit I), 10-Inch Water Main Replacement in Rayner Avenue, since all the
contractors failed to comply with bid specifications.
4, adopt the attached ordinance:
A. declaring the necessity for and ordering the improvements;
B. making provisions for levying the assessments;
C. directing the Transportation and Public Works Department to prepare
estimates and amounts to be assessed;
D. awarding the contract to James W. Jackson, Inc., in the amount of
$70,306.40 based on their lowest responsive bid for street
construction;
E. making appropriations to cover the indebtedness thereby incurred for
improvements of the project described below; and
A. approving the estimate of costs and amounts proposed to be assessed;
and,

BACKGROUND
On August 16, 1985, the Transportation and Public Works Department received
paving petitions signed by the owners of 55.2 percent of the land adjacent to
Rayner Avenue between East First Street and State Highway 121 (Airport
Freeway), requesting the street to be improved on the assessment basis. The
street is open on the ground and is being used by the public. All of the
adjacent property is Zoned "I" and "J" (Light Industrial), and is partially
developed.
On October 1, 1985 (M&C G-6449), the City Council authorized the Director of
Transportation and Public Works to design the improvement of Rayner Avenue with
in-house forces and advertise the project for bids. The Water Department
determined that an existing 10 inch water main in Rayner Avenue was in need of
replacement, and engineering plans were prepared for advertisement with the
street construction project. This 10-inch water main, however, will be replaced
by the Water Department Field Operations crews.

It is proposed to improve this segment of Rayner Avenue with a 6-inch thick
reinforced .concrete pavement and a 7-inch high concrete curb on a 6-inch thick
lime stabilized subgrade. Concrete driveway approaches will be constructed
where required. The new roadway will be 40 feet wide in the existing 70 foot
wide right-of-way.
RECEIPT OF BIDS
Bids for the project were received September 11, 1986, after being advertised
on August 21 and 28, 1986, with 30 working days allotted.

**The staff reviewed bids received for compliance with all bid specifications.
It is the opinion of staff that the bid submitted by Lowell B. Allison
Contractors, Inc.., was non-responsive to specifications as they did not comply
with the City's MBE/WBE Policy. The lowest responsive bidder James W. Jackson
Inc., is in compliance with the City's MBE and WBE Policy for this particular
bid.
PROJECT FINANCING
Based on the lowest responsive bid of $70,306.40 for street improvements,
$54,721.10 is anticipated to be the property owner's share of the project
costs. This amount will be provided by a bond fund transfer from the Special
Assessments Fund 94, Unspecified Account No. 009905-00 where sufficient funds
are available to Account No. 024320-00, Rayner Avenue.

The cost to the City for street construction is calculated at $15,585.30. A
bond fund transfer is n ecessary from Street Improvement Fund 29, Project
No. 025901-00, Reconstru ction Unspecified, in which sufficient funds are
available, to Project No. 024320-00, Rayner Avenue, to finance this project.
Sufficient funds are available in Street Improvements Fund 29, Account
No. 095103-00, Engineering Salaries, to finance engineering inspection and
administrative costs.
