HomeMy WebLinkAboutOrdinance 22104-03-2016 ORDINANCE NO. 22104-03-2016 AN ORDINANCE VACATING AND EXTINGUISHING BLUEBONNET DRIVE, SCENIC HILL, AND AN UNNAMED STREET AND VACATING AND EXTINGUISHING PORTIONS OF LILLIAN STREET AND DELL STREET, SITUATED IN THE JOHN LITTLE SURVEY, ABSTRACT NO. 958, AND IN THE SCENIC VILLAGE, HAWKINS SCENIC HILL ADDITIONS AND B.M. ADAMS SUBDIVISION, OF THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS; AS RECORDED IN THE PLAT RECORDS OF TARRANT COUNTY, TEXAS AND CONTAINING APPROXIMATELY, RESPECTIVELY, 46,996; 2,149; 36,510 and 4,875 SQUARE FEET ACRE OF LAND MORE OR LESS; PROVIDING FOR REVERSION OF FEE IN SAID LAND; PROVIDING THAT THE CITY SHALL RETAIN ALL EXISTING UTILITIES EASEMENTS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the variable width right-of-way of Bluebonnet Drive situated in the John Little Survey, Abstract No. 958 of the City of Fort Worth, Tarrant County, Texas; Scenic Village Addition, an addition to the City of Fort Worth, Tarrant County, Texas, as recorded in Volume 388-G, Page 45 of the Plat Records of Tarrant County, Texas, and containing approximately 1.079 acre or 46,996 square feet of land more or less, and as more specifically described in Exhibit "A" attached hereto and incorporated herein by reference be and the same is vacated and extinguished. SECTION 2. That a portion of the variable width right-of-way of Lillian Street, situated in the John Little Survey, Abstract No. 958 of the City of Fort Worth, Tarrant County, Texas; as shown on Bluebonnet,Dell, Scenic Hill and Lillian ROW Vacation Ordinance No.22104-03-2016 (VA-15-017, 018-019, 022) Page 1 of 3 the plat of Hawkins Scenic Hill Addition, an addition to the City of Fort Worth, Tarrant County, Texas, recorded in Volume 1013, Page 69 of the Plat Records of Tarrant County, Texas, and containing approximately 0.049 acres or 2,149 square feet of land more or less, and as more specifically described in Exhibit "B" attached hereto and incorporated herein by reference be and the same is vacated and extinguished. SECTION 3. That the sixty (60) foot right-of-way of Scenic Hill Drive and a portion of the fifty (50) foot right-of-way of Dell Street, situated in the John Little Survey, Abstract No. 958 of the City of Fort Worth, Tarrant County, Texas, as shown on the plat of Hawkins Scenic Hill Addition, an addition to the City of Fort Worth, Tarrant County, Texas, as recorded in Volume 1013, Page 69 of the Plat Records of Tarrant County, Texas, containing approximately 0.838 acre or 36,510 square feet of land more or less, and as more specifically described in Exhibit "C" attached hereto and incorporated herein by reference be and the same is vacated and extinguished. SECTION 4. That all of the thirty-two and one-half unnamed street, situated in the John Little Survey, Abstract No. 958 of the City of Fort Worth, Tarrant County, Texas; as shown on the plat of B.M. Adams Subdivision, an addition of the City of Fort Worth, Tarrant County, Texas, as recorded in Volume 975, Page 19 of the Deed Records of Tarrant County, Texas, containing approximately 0.112 acre or 4,875 square feet of land more or less, and as more specifically described in Exhibit "D" attached hereto and incorporated herein by reference be and the same is vacated and extinguished. That the easements to the land in the above-described vacated street rights of way are hereby released and shall revert to the adjacent owner as provided by law. SECTION 6. All existing utility easement be shall be retained by the City until such time all utilities located in the easements are relocated at the adjacent owner's expense. SECTION 7. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 8. That this ordinance shall take effect upon adoption. DISCUSSION: Kimley-Horn, on behalf of FW Bluff Land, LP, has requested the vacation of these rights-of-way, to be replatted with the adjoining property for the Scenic Village Multi-Family Development. The City Plan Commission recommended approval of this request at its meeting on August 26, 2015. An acceptable final plat (FP-15-092) has been received in accordance with the Subdivision Ordinance. The final plat includes the dedication of right-of-way and public access easements to retain adequate connectivity. The City of Fort Worth (City) originally obtained the above mentioned rights-of-way through the platting process. The City does not own any fee interest in the rights-of-way or own any property adjacent to the rights-of-way and did not expend any City funds to purchase the right-of-way easements.
