HomeMy WebLinkAboutOrdinance 9657,.±~- , ORDINANCE N0. ~C~ ~~ AN ORDINANCE AMENDING ORDINANCE NO. 9633, BY SUBSTITUTING IN LIEU OF EXHIBIT "A" THEREOF A REVISED EXHIBIT °'A", WHICH REVISED EXHIBIT "A" REFLECTS THE COMBINATION OF THE POLLING PLACES FOR PRECINCT NOS. 1237, 1251 AND 1300 WITH THE POLLING PLACE FOR PRECINCT NO. 1150; AND FURTHER RE- FLECTS THE COMBINATION OF THE POLLING PLACES FOR PRECINCT NOS. 4274 AND 4341 WITH THE POLLING PLACE FOR PRECINCT NO. 4120; MAKING THIS ORDINANCE CUMULATIVE OF ALL ORDI- NANCES; REPEALING ALL ORDINANCES AND PROVISIONS IN CONFLICT HEREWITH; PROVIDING A SEVER ABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That Ordinance No. 9633 be, and the same is hereby, amended by substituting in lieu of Exhibit "A" thereof a Revised Exhibit "A", which Revised Exhibit "A" reflects the combination of the polling places for Precinct Nos. 1237, 1251 and 1300 with the polling place for Precinct No. 1150; and which Revised Exhibit "A" further re- flects the combination of the polling places for Precinct Nos. 4274 and 4341 with the polling place for Precinct No. 4120. The Revised Exhibit "A" is attached hereto and incorporated herein and made a part of Ordinance No. 9633 for all purposes. SECTION 2. This ordinance shall be, and is hereby, declared to be cumula- tive of all other ordinances of the City of Fort Worth, and this ordinance shall not operate to repeal or affect any of such other ordinances except insofar as the provisions thereof might be incon- ~,. sistent or in conflict with the provisionsfof this ordinance, in which event such conflicting provisions, if any, in any such ordi- nance or ordinances are hereby repealed. SECTION 3. If any section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be unconstitutional, such hold- ing shall not affect the validity of the remaining portions of this ordinance, and all of the remainder of this ordinance not so held to be unconstitutional shall continue to be in full force and effect. SECTION 4. This ordinance shall take effect and be in full force and effect from and after the date of its passage. Background.: On May 13, 1986, the City Council adopted Ordinance No. 9633, ordering special emergency elections to be held on July 12, 1986, to fill vacancies on the City Council for Districts 6 and 7. Exhibit "A" of Ordinance No. 9633 describes the polling place locations for precincts in Districts 6 and 7. Pollin Places for Precinct Nos. 1237, 1251, 1300 to be combined with Precinct No. 50 District 6 Ordinance No. 9633 currently provides that the polling place for Precinct No. 1251 will be combined with the polling place for Precinct No. 1300, and that the polling place for Precinct No. 1237 will be combined with the polling place for Precinct No. 1150. Precinct No. 1300 was created by the Tarrant County Commissioner's Court in 1985, effective March 1, 1986, to comply with statutory limitations on the maximum number of registered voters in a precinct. In order to accommodate the creation of this new precinct, a new polling place was anticipated and a poten- tial election judge was contacted by the Office of the City Secretary regarding his availability to conduct the July 12, 1986, election. Since the adoption of Ordinance No. 9633 on May 13, 1986, the City Secretary was informed that the potential election judge had decided not to conduct the election in Precinct No. 1300. Therefore, the City Secretary recommends that the pol 1 i ng places for Precinct No. 1251 and 1300 be combined with the polling place for Precinct No. 1150 (which already has the polling place for Precinct No. 1237 combined with it). The result will be that the polling places for Precinct Nos. 1237, 1251 and 1300 will be combined with the polling place for Precinct No 1150, with one Presiding Judge and one Alternate Presiding Judge serving all four precincts. These four precincts were combined at the same polling place location for the City's Capital Improvement Bond election held in March of this year, and no DATE REFERENCE SUBJECT ORDINANCE AMENDING ORDINANCE N0. Should the City Council desire to: 1. Combine the polling places for Precinct Nos. 1237, 1251 and 1300 with the polling place for Precinct No. 1150, and 2. PAGE 6/17/86 NUMBER G-6710 9633, COMBINING THE POLLING PLACES FOR 2 or 2 P E THE POLLING PLACE FOR PRECINCT NO 1150 AND COMBINING THE POLLING PLACES FOR PRECINCT NOS, 4274 ANO 4341 WITH THE POLLING PLACE FOR PRECINCT N0. 4120 difficulties were encountered. These four precincts have an approximate total of 3,798 qualified voters, however,. sufficient election equipment, ballots and election clerks will be provided to accommodate the voter turnout for all four precincts. The combination of the polling places will have no discernible impact upon the accessibility of the voters to the polls in these four pre- cincts or upon the election results in District 6. As usual, this proposed change must be submitted to the United States Department of Justice for approval prior to the election. Pollin Places for Precinct Nos. 4274 and 4341 to be combined with Precinct o. 4 2 District In prior elections, including the City's recent Capital Improvement Bond elec- tion, the polling place for Precinct No. 4274 has been combined with the polling place for Precinct No. 4120. The reason for this combination has been that Precinct No. 4274, which was created four years ago, has not been large enough (approximately 200 voters) to justify a separate polling place However, in March of this year, the Tarrant County Commissioners' Court created Precinct No. 4341 out of a portion of Precinct No. 4120 because Precinct No. 4120 had surpassed the allowed 3,000 registered voters. With the new Precinct 4341 and the relatively new Precinct No. 4274, these two precincts combined have enough registered voters to justify a polling place separate from the polling place location for Precinct No. 4120. For this reason, the City Council, upon the recommendation of the City Secretary, provided in Ordinance No. 9633 that the polling place for Precinct No. 4341 be combined with the polling place for Precinct No. 4274, located at the Como Multi-Purpose Center, and that these precinct polling places not be combined with the polling place for Precinct No. 4120. Since the adoption of Ordinance No. 9633, setting out the polling place loca- tions, opposition to the separation of the polling places has been voiced by two election workers in Precinct 4120. This is contrary to the recommendation of the City Secretary. However, should the City Council wish to combine the polling places of these precincts with the polling place for Precinct No. 4120, then Ordinance No. 9633 must be amended to reflect this change, and then sub- mitted to the United States Department of Justice for its approval prior to the election. Should the City Council combine these polling places, sufficient election equipment, ballots and election clerks will be provided to accommodate the voter turnout for all three precincts.
