HomeMy WebLinkAboutOrdinance 9757;~.., _:. ~ ~ ,. ~ _ ~,,; ORDINANCE NO. ~~~~ AN ORDINANCE VACATING, ABANDONING, AND CLOSING AND EXTIN- GUISHING THE EASTERNMOST 200' OF THE ALLEY WITHIN BLOCK 91, TEXAS & PACIFIC RAILWAY COMPANY ADDITION TO THE CITY OF FORT WORTH, SAID VACATED PORTION BEING DESCRIBED MORE SPECIFICALLY HEREIN; PROVIDING FOR REVERSION OF FEE IN SAID LAND(S); REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECT ION 1 . THAT THE portion of the alley lying between and adjacent to Lots 5 through 8, and Lots 9 through 12, Block 91 , Texas & Pacific Railway Company Addition to the City of Fort Worth, Tarrant County, Texas, the plat of said Addition being recorded in Volume 63, Page 107, of the Plat Records of Tarrant County, Texas, said portion also being the easternmost 200' of said alley, be and the same is vacated, abandoned, and permanently closed and extinguished. SECT ION 2 . That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECT ION 3 . That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so or- dained. Qol~~e RECOP1~1ENUATION It is .recommended that the City Council adopt an ordinance vacating the easterly 200' portion of a 20' wide alley located adjacent to and between Lots 5-8 and 9-12, Block 91, Texas and Pacific Railway Company Addition, as recorded in Volume 63, Paye 107, P.R.T.C.T., as recommended by the City Plan Commission. DISCUSSION Robert Bohl, President of the Presbyterian Night Shelter, owner of abutting pro- perty, has requested that the City vacate the above-described portion of alley right-of-way, as shown on the attached map. The subject alley right-of-way, acquired by dedication, is open on the ground, and contains sewer, electric, gas, and telephone utility facilities, which will be r elocated at the applicant's expense. The subject vacation request is made in orde r to rep lat the vacated right-of-way with adjoining property t o faci 1 i tate the expansion of the Night Shelter Complex. The required and appropriate monetary consideration has been placed in escrow with the Real Property Department, as required by the Land Agent for t he City of Fort Worth. Reviewing city Departments and private utility companies have raised no objec- tions to this request, subject to submission of a replat of the vacated alley with abutting property. Also, the applicant has agreed to pay for relocation or abandonement of all utility facilities located within the vacated alley right- of-way. A satisfactory replat has been submitted.
