MENT'S AND OF AMOUNTS TO BE ASSESSED FOR IMPROVE[~NTS ON A PORTION OF
WHITE SETTIā¢F~r ROAD AND CLIFFORD ROAD
A1~ID SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES IN THE CITY OF
FORT WORTH, TEXAS; FIXING TIME AND PLACE FOR HEARING TO THE OWNERS
OF ABUTTING PROPERTY AND ~ ALL OTHERS INrERESTID; DIRECTING THE
CITY SECRETARY TO GIVE NOTICE OF SUCH HEARING; AND DIRECTING THE
CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE
CAPTION OF SAME IN THE MINU`1~ BOOR OF THE CITY COUNCIL AND BY FILING
THE OOMPLETE ORDINANCE IN THE APPROPRIATE ORDINANCE RECORDS OF THE
CITY; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Fort Worth, Texas, has heretofore
ordered that each of the hereinafter described portions of streets, avenues and public
places in the City of Fort Worth, Texas, be improved by raising, grading and filling
same and by constructing thereon the following, to wit:
WHITE SETTLII+~TTT ROAD From I.H. 820 to North Academy Boulevard, ]mown
and designated as Project No. 30-036848-00, a
seven-inch thick reinforced concrete pavement
with a seven-inch high attached concrete curb
on a six-inch thick lime stabilized subgrade, so
that the finished roadway will be sixty-feet
wide then transitionng from an interior street
to a double thirty-six foot roadway with a
twenty-eight foot wide median. Six-inch thick
driveway approaches will be constructed as
specified on the plans.
CLIFFORD ROAD From I.H.. 820 to White Settlement Road, known and
designated as Project No. 30-036848-00 , a
seven-inch thick reinforced concrete pavement
with a seven-inch high attached concrete curb on
a six-inch thick lime stabilized subgrade, so
that the finished roadway will be sixty-feet wide
for a distance of seventeen hundred feet, then
transitioning southwesterly for 500 feet to two
thirty-six feet wide traffic lanes with a
twenty-eight feet wide median and continuing as
a double thirty-six feet roadway to White Settle-
ment Road. Six-inch thick reinforced concrete
turn lanes and median openings will be
constructed where specified.

together with concrete curbs, gutters, driveways and incidentals to such improvements on
proper grade and line where same are not already so constructed, together with storm
sewers and drains and other necessary incidentals and appurtenances; all of said
improvements to be constructed as and where shown on the Plans and in strict accordance
with the Plans and Specifications therefore; contract therefore has been made and
entered into with J. L. Bertram Construction and Engineering, Inc. ;

WHEREAS, the City Council of the City of Fort Worth, Texas, has caused the Public
Works Director to prepare and file estimates of the cost of such improvements and
estimates of the amount per front foot proposed to be assessed against abutting property
and the owners thereof, and such estimates have been examined, NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS,
I.
Such estimates be, and they are hereby adopted and approved.
II.
It is hereby found and determined that the cost of improvements on each portion of
streets, avenues, and public places hereinafter described, with the amount or amounts
per front foot proposed to be assessed for such improvements against abutting property
and the owners thereof, are as follows, to-wit:

The estimated cost of improvements is $ 1,398,390.45 the estimated amount per front
foot to be assessed against abutting property and the owners thereof for concrete curb
is $ .2.45 the estimated amount per front foot to be assessed against abutting property
and the owners thereof for pavement is $ 54.04 the estimated amount per front foot to
be assessed against abutting property and the owners thereof for -0- wide concrete
sidewalk is $ 0.00; the estimated amount per square foot to be assessed against abutting
property and the owners thereof for six-inch thick concrete driveway is $ 3.04 per
square foot; the total estimated amount per front foot to be assessed against abutting
property and the owners thereof is $ * 104.09 , plus the cost incurred for concrete
driveway construction where specified.

III.
A hearing be given and held by and before the City Council of the City of Fort
Worth, Texas, to all owning or claiming any property abutting upon said portions of
highways, streets, avenues and public places, as well as to all owning or claiming any
interest in any such property. Such hearing shall be given and held on the 22nd day of
Jules, 1986, at 10:00 a.m., in the Council Chamber in the City Hall in the Ci y of Fort
Worth, Texas, and the City Secretary is hereby directed to give or cause to be given
notice of the time and place of such hearing and of other matters and facts in
accordance with the terms and provisions of an Act passed at the First Called Session of
the Fortieth Legislature of the State of Texas, and )mown as Chapter 106 of the Acts of
said Session, now being ]mown as Article 1105b of Vernon's Texas Civil Statutes as
amended by Acts 1967, 60th Legislature, Page 365, Chapter 176, Section 1, emergency
effective May 12, 1967. Such notice shall be by advertisement inserted at least three
(3) times in a newspaper published in the City of Fort Worth, Texas, the first
publication to be made at least twenty-one (21) days before the date of said hearing.
Said notice shall comply with and be in accordance with the terms and provisions of said
Act as amended. The City Secretary is further directed to give or cause to be given
personal .notice of the time and place of such hearing to all owning or claiming any
property abutting on said portions of highways, streets, avenues and public places, as
well as to all owning or claiming any interest in any such property. Such personal
notice shall be in writing and shall be given or caused to be given by the City
Secretary by depositing such written notice in the United States Mail at least fourteen
(14) days before the date of the hearing, postage prepaid, in envelopes addressed to all
persons owning or claiming any interest in the respective properties abutting the
highways, streets, avenues and public places or portions thereof to be improved, as the
names of such persons are shown on the current rendered tax rolls of the City of Fort
Worth and at the addresses so shown, or if the name of such respective owners do not
appear on such rendered tax rolls, then address to such owners as their names. are shown
on the current unrendered tax rolls of the City of Fort Worth at the addresses shown
thereon. In those cases in which an owner of property abutting a highway, street,
avenue or public place or portion or portions thereof which is to be improved is listed
as "unlmown" on the then current City of Fort Worth tax rolls, or the name of an owner
is shown on the City of Fort Worth tax rolls but no address for such owner is shown, no
notice need be mailed. In those cases where the owner is shown to be an estate, the
mailed notice may be addressed to such estate. In this connection, the City Secretary
shall prepare and file or cause to be prepared and filed with these proceedings a list
of the properties to be assessed, the names of those person owning or claiming any
interest in said properties to whom the notice was mailed, together with the last ]mown
addresses determined as aforesaid of the respective owners and those persons owning or
claiming any interest in said property.
The City Secretary shall certify that each of the parties in said list whose
address is shown on the then current rendered or unrendered tax rolls of the City of
Fort Worth was mailed a copy of the notice of hearing and shall further certify the date
or dates on which said notice was mailed. A copy of each notice shall be attached to
such certificate. The certificate of the City Secretary will be conclusive evidence of
the facts therein recited.

IV.
The City Secretary is hereby directed to engross and enroll this ordinance by
copying the caption of same in the Minute Book of the City Council and by filing the
complete ordinance in the appropriate Ordinance Records of this City.
V.
This ordinance shall take effect and be in full f c~~and effect from and after
the date of its passage. ~

BACKGROUND
On January 15, 1985 (M&C C-8811), the City Council approved Community
Facilities Agreement No. 14270 with Hayden Cutler, for the development of
Clifford Village Addition, Block 2, Lot 1 and 2, and Block 1, Lot 1. Segments
of White Settlement Road and Clifford Road are border streets to the
development. On April 23, 1985 (M&C C-8974), a Community Facilities Agreement
was authorized with Legacy Square Joint Venture for the development of Legacy
Square, Blocks 1 - 5, to which a segment of White Settlement Road is also a
border street. The assessment paving of White Settlement Road from I.H: 820 to
Academy Boulevard and C1 ifford Road from I.H. 820 to White Settlement Road
includes the two street sections covered by the CFA's and the construction of a
section of White Settlement Road which is an interior street in Clifford
Village Addition fully funded by the developer but constructed under this
contract to provide traffic continuity.

White Settlement Road and Clifford Road will be constructed of 7-inch thick
reinforced concrete pavement with attached concrete curb and driveway
approaches where specified on the plans. Storm drain improvements consist of
4,776 feet of reinforced concrete pipe and appurtenances. Street lights will be
installed at a later date by City crews,

The project was advertised for bids on March 6 and 13, 1986, and the following
bids were received on March 27, 1986, with 120 working days allotted to
complete the project.

PROJECT COST AND FINANCING
For White Settlement Road and Clifford Road, based on the low bid of
$1,394,437.11 for street and storm drain improvements, approximately
$797,359.46 is the property owner's share of project costs. Of this amount
$115,538.37 will be paid in cash by the developer for the interior street
portion of White Settlement, and $251,657.89 will be paid in cash by the
developers for the border streets. These funds will be deposited prior to the
benefit hearing. The remaining $430,163.20 will be assessed and will be
provided for by a bond fund transfer from Special Assessments Fund 94, Project
No. 009905-00, Special Assessments Unspecified Account (in which sufficient
funds are available) to Fund 94, Project No. 036848-00, Assessment Paving of
White Settlement Road and Clifford Road in Clifford Village Addition.
The cost to the City for construction is approximately 597,077.65 of which
$305,272.09 is for street improvements and $291,805.56 is for drainage
improvements. Engineering costs are estimated at $127,126.41. Bond fund
transfers will be necessary in the amount of $565,900 from Street Improvements
Fund 30, Project No. 035420-00, Berry Street at I35 W and in the amount of
$31,080.00 from Fund 30, Project No. 036867-000, White Settlement Road (in
which sufficient funds are available) to Fund 30, Project No. 036848-00, White
Settlement Road/Clifford Road to Clifford Village Addition in order to provide
additional funds to finance the City's portion of this construction cost.
Sufficient funds are available in Street Improvements Fund 30, Project No.
095102-00, salaries to finance the City's engineering costs.
For street 1 fights for White Settlement Road and C1 ifford Road, the total cost
is estimated at $84,917.50. Of this amount, $54,412.36 will be assessed against
the abutting property owners. Payments totaling $7,634.70 for interior street
lighting and $22,014.97 for border street lighting will be paid in cash by the
developer prior to the benefit hearing. The remaining assessment of $24,762.69
will be provided by a bond fund transfer from Fund 94, Project No. 009905-00,
Special Assessments Unspecified to Project No. 032174-00, Legacy Square Street
Lights. Sufficient funds are available in Street Improvements Fund 30, Account
No. 032153-00, Clifford Village Street Lights, and 032174-00, Legacy Square
Street Lights to finance the $31,004.14 City share of street light costs.
