HomeMy WebLinkAboutOrdinance 9661ORDINANCE ~~p ~j AN ORDINANCE AMENDING THE COMPREHENSIVE ZONING OR DINANCE, OR DINANCE N0. 3011, AS AMENDED, SAME BEING AN ORDINANCE REGULATING AND RESTRICTING THE LOCATION AND USE OF BUILDINGS, STRUCTURES, AND LAND FOR TRADE, INDUSTRY, RESIDENCE OR OTHER PURPOSES, THE HEIGHT, NUMBER OF STORIES AND SIZE OF BUILD- INGS AND OTHER STR UCTURES, THE SIZE OF YAR DS AND OTHER OPEN SPACES, OFF-STREET PARKING AND LOADING, AND THE DENSITY OF POPULATION, AND FOR SUCH PURPOSES DIVIDING THE MUNICI- PALITY INTO DISTRICTS OF SUCH NUMBER, SHAPE AND AREA AS MAY BE DEEMED BEST SUITED TO CARRY OUT THESE REGULATIONS AND SHOWING SUCH DISTR ICTS AND THE BOUNDARIES THEREOF UPON "DISTRLCT MAPS"; PROVIDING FOR INTERPRETA- TION, PURPOSE AND CONFLICT; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES; PROVIDING A SAVINGS CLAUSE; PRO- VIDING A SEVER ABILITY CLAUSE; PROVIDING A PENAL CLAUSE; PROVIDING FOR ENGROSSMENT AND ENROLLMENT; PROVIDING FOR PUBLICATION AND NAMING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That Ordinance No. 3011, as amended, be and is hereby amended so that the permitted uses in the hereinafter described areas be altered, changed, and amended as follows: Z-86-048 PARCEL 1 0.6505 acres of land situated in the Shelby County School Land Survey, Abstract No. 1375, Tarrant County, Texas and also being a portion of Lot 4 of the Mrs. Mittie Scott tract as recorded in Volume 388-D, Page 113, Tarrant County Plat Records; said 0.6505 acres being more particularly described as follows: COMMENCING at intersection of Oak Grove Road south boundary Scott Tract; a 5/8 inch iron the proposed east (proposed 120.00 line of said Lot 9 rod found on the right-of-way line of foot wide) and the of the Mrs. Mittie Z-86-048 THENCE, along the said east right-of-way line of Oak (Cont.) Grove Road, N 0° 01' 44" E, a distance of 269.98 feet to a 5/8 inch iron rod set for the POINT OF BEGINNING of the herein described tract; THENCE, departing said right-of-way line of Oak Grove Road, N 89° 50' 58" E, a distance of 173.50 feet to a 5/8 inch iron rod set for corner; THENCE, N 0° 01' 44" E, a distance of 163.32 feet to a 5/8 inch iron rod set on the proposed south right-of- way line of Oak Grove-Shelby Road-County Road No. 1098 (proposed 60-foot right-of-way) and also being the northeast corner of the herein described tract; THENCE, along said south right-of-way line of Oak Grove-Shelby Road, S 89° 50' S8" W, a distance of 173.5 feet to a 5/8 inch iron rod set at the southeast corner of the intersection of the said south right- of-way line of Oak Grove-Shelby Rd., and the said east right-of-way line of Oak Grove Rd. being also the northwest corner of the tract herein described; THENCE, along the said east right-of-way line of Oak Grove Rd. S 0° 01' 44" W, a distance of 163.32 feet returning to the POINT OF BEGINNING hereof and con- taining 0.6505 acres (28,336 square feet) of land. (Southeast corner of Oak Grove Road and Oak Grove- Shelby Road) From "C R" M ulti-Family to "E" Commercial PARCEL 2 11.3626 acres of land situated in the Shelby .County School Land Survey, Abstract No. 1375, Tarrant County, Texas and also being a portion of Lot 4 of the Mrs. Mittie Scott tract as recorded in Volume 388-D, Page 113, Tarrant County Plat Records; said 11.3626 acres being more particularly described as follows: BEGINNING at a 5/8 inch iron rod found on the inter- section of the proposed east right-of-way line of Oak Grove Road (proposed 120.00 foot wide) and the south boundary line of said Lot 4 of the Mrs. Mittie Scott tract also being the southwest corner of the tract herein described; -2- Z-86-048 THENCE, along the said east right-of-way line of Oak (Cont.) Grove Road and the west boundary line of the herein described tract, N 0° 01' 41" E, a distance of 269.98 feet to a 5/8 inch iron rod set for corner; THENCE, departing said right-of-way line of Oak Grove Road, N 89° 50' 58" E, a distance of 173.50 feet to a 5/8 inch iron rod set for corner; THENCE, N 0° 01' 44" E, a distance of 163.32 feet to a 5/8 inch iron rod set on the proposed south right-of- way line of Oak Grove-Shelby Road-County Road No. 1098 (proposed 60-foot right-of-way) and also being the most northerly northwest corner of the herein de- scribed tract; THENCE, along said south right-of-way line of Oak Grove-Shelby Road, N 89° 50' 58" E, a distance of 1028.17 feet to a 5/8 inch iron rod set for the north- east corner of the tract herein described; THENCE, departing said right-of-way line of Oak Grove-Shelby Road, S 0° 02' 47" W a distance of 437.70 feet to a found 1/2 inch iron rod being for the south- east corner of the tract herein described; THENCE, along the south boundary line of the tract herein described also being the south boundary line of said Lot 4 of the Mrs. Mittie Scott Tract N 89° 56' 26" W, a distance of 1201.53 feet returning to the POINT OF BEGINNING hereof and containing 11.3626 acres (494,957 square feet) of land. (Southeast corner of Oak Grove Road and Oak Grove- Shelby Road) From "C-R" M ulti-Family to "C" M ulti-Family SECTION 2. That the zoning regulations and districts, as herein estab- lished, have been made in accordance with the comprehensive plan for the purpose of promoting the health, safety, morals and general welfare of the community. They have been designed to lessen congestion in the streets; to secure safety from fire, panic, flood and other dangers; to provide adequate light and air; to prevent overcrowding of land; to avoid undue concentra- tion of population; to facilitate the adequate provisions of transportation, water, sewerage, parks and other public require- ments. They have been made after a full and complete public -3- hearing, with reasonable consideration, among other things, of the character of the district and its peculiar suitability for the particular uses and with a view of conserving the value of building and encouraging the most appropriate use of land throughout the community. SECTION 3. That this ordinance shall be cumulative of all other ordinances of the City of Fort Worth affecting zoning and shall not repeal any of the provisions of such ordinances, except in those in- stances where provisions of such ordinances are in direct con- flict with the provisions of this ordinance. SECTION 4. That all rights or remedies of the City of Fort Worth, Texas, are expressly saved as to any and all violations of Ordinance No. 3011 or of any amendments thereto that have accrued at the time of the effective date of this ordinance; and, as to such accrued violations, and all pending litigation, both civil or criminal, same shall not be affected by this ordinance but may be prosecuted until final disposition by the courts. SECTION 5. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sen- tence, paragraph or section of this ordinance shall be declared void, ineffective or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such voidness, ineffectiveness or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs or sec- tions of this ordinance, since the same would have been enacted by the City Council without the incorporation herein of any such void, ineffective or unconstitutional phrase, clause, sentence, paragraph or section. SECTION 6. That any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not more than One Thousand Dollars ($1,000.00) for each offense. Each day that a violation is permitted to exist shall constitute a separate offense. -4- T SECTION 7. That the City Secretary of the City of Fort Worth, Texas, is hereby directed to engross and enroll this ordinance by copying the caption and penalty clause of same in the minutes of the City Council of the City of Fort Worth, Texas, and by filing the ordinance in the ordinance records of said City. SECTION 8. That the City Secretary of the City of Fort Worth, Texas, is hereby directed to publish this ordinance for two (2) days in the official newspaper of the City of Fort Worth, Texas, as authorized by Article 1176b-1, Revised Civil Statutes of Texas. SECTION 9. That this ordinance shall be in full force and effect from and after the date of its passage and publication as required by law, and it is so ordained.
