HomeMy WebLinkAboutOrdinance 9562ORDINANCE N0. ~~•G AN ORDINANCE VACATING, ABANDONING, AND CLOSING AND EXTIN- GUISHING A PART OF GALVESTON AVENUE, SUCH PART BEING DESCRIBED MORE SPECIFICALLY HEREIN, AND RETAINING CERTAIN EASEMENTS THEREIN; PROVIDING FOR REVERSION OF FEE IN SAID LAND(S); REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT a part of Galveston Avenue described in Exhibit "A" at- tached hereto and incorporated herein by reference for all purposes, be and the same is vacated, abandoned, and permanently closed and extinguished. SECTION 2. That the fee to the land(s) in the above described vacated street and public right-of-way is hereby released and shall revert to the adjacent owner(s) as provided by law, SAVE AND EXCEPT that easements are retained by the City of Fort Worth for any and all existing and prospective utilities, including but not limited to electric, water, sewer, qas and telephone utilities, and that easements are also retained by said City for any necessary storm drainage facilities and water runoff.. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so or- dained. DISCUSSION f1r. Charles Mayui re, Director of St . Joseph Hospital (the applicant) , owner of abutting property, has requested that the City vacate 6150 sq.ft. of Galveston Avenue street right-of-way, as illustrated on the attached map. The subject street right-of-way, acquired by dedication, is unimproved, but contains storm drainage, electrical, water, sewer, gas, and telephone facilities. The subject request is made in order to replat the vacated right-of-way with adjacent property, thus expanding the building area and providing more usable yard space. The required and appropriate monetary consideration has been placed in escrow with the Real Property Department of the City. Reviewing City departments and private utility companies have raised no objections to this request, subject to the vacated right-of-way being replatted with adjacent property and the vacated right-of-way being retained as a utility easement for existing utility facilities, unless other satisfactory arrangements are made. A satisfactory replat has been submitted. The City Plan Commission has reviewed this request and recommends that the subject portion of street right-of-way be vacated as requested.
