This law provides that, in order to be awarded a contract as low bidder, non-resident bidders (out of state contractors whose corporate offices or principal place of business are outside of the State or Texas) bid projects for construction, improvements, supplies or services in Texas at an amount lower than the lowest Texas resident bidder by the same amount that a Texas resident bidder would be required too underbid a non-resident bidder in order to obtain a comparable contract in the State in which the non-resident's principal place of business is located. The appropriate blanks in Section A must be filled out by all out-of-state or non-resident bidders in order for your bid to meet specifications. The failure of out-of-state or non-resident contractors to do so will automatically disqualify that bidder. Resident bidders must check the box in Section B. A. Non-Resident vendors in (give State), our principal place of business, are required to be percent lower than resident bidders by State law. A copy of the Statute is attached. Non-resident vendors in (give State), our principle place of business, are not required to underbid resident bidders. B. DISCUSSION: Mayor and Council Communication (M&C C-26017, approved on December 18, 2012) authorized the execution of non-exclusive annual contracts with Garrett Demolition, Inc., (City Secretary Contract No. 44188), Intercon Environmental, Inc., (City Secretary Contract No. 44189) and Lindamood Demolition, Inc., (City Secretary Contract No. 44220) for structural demolition and asbestos abatement services for all City departments with a combined not to exceed a total expenditure of $650,000.00 across all three contracts during any one-year term. Total expenditures during the original one-year contract term were $455,715.19. However, during the current (first renewal) term, total expenditures have reached approximately $611,000.00 with three months remaining in the annual term. The amount of work expected for the remainder of the term will exceed the $650,000.00 combined annual limit. A similar volume of work is anticipated for at least the next two years mainly due to an increase in the number of substandard structures being demolished by the Code Compliance Department. The increased aggregate not to exceed amount recommended by this Mayor and Council Communication will allow for continued uninterrupted asbestos abatement and demolition services on an as-needed basis to all City departments. The project will serve in ALL COUNCIL DISTRICTS.
