ORDINANCE N0. ~~~~j'P~r -t~'
AN ORDINANCE VACATING, ABANDONING, AND
CLOSING AND EXTINGUISHING EMERGENCY ACCESS
AND UTILITY EASEMENTS AS SPECIFICALLY
DESCRIBED HEREIN, PROVIDING FOR REVERSION
OF FEE TN SAID LAND(S), REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH AND PROVIDING
AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF_FORT WORTH,
TEXAS
SECTION 1.
THAT THE emergency access and utility easement
described in Exhibit "A" attached hereto and incorporated by
reference herein for all purposes, as well as two (2) 10' by
10' water easements, two (2) 10' by 10' fire hydrant easements,
and one (1) 5' by 10' water meter easement in Lot 2, Block
9R, Stonegate Addition to the City of Fort Worth as shown on
the plat recorded in Volume 388-180, Pages 92 anct 93, Plat
Records of Tarrant County, Texas, be and the same are vacated,
abandoned, and permanently closed and extinguished.
SECTION 2.
That all ordinances or parts of ordinances in conflict
herewith are hereby repealed.
SECTION 3.
That this ordinance shall take effect and be in full
force and effect from and after the date of its passage, and
it is so ordained.

LEGAL DESCRIPTION
26 FOOT WIDE EMERGENCY ACCESS
AND UTILITY EASEMENT
Being 26.0 foot wide strips of land situated in the S. C. Inman
Survey, Abstract Number 824, Tarrant County, Texas, also being in
Lot 2, Block 9R, of Stonegate Addition as recorded in Volume
388-180, Pages 92 & 93, County Records, Tarrant County, Texas said
26.0 foot wide strips of land being described by centerlines as
follows:

RECOMMENDATION
It is recommended that the City Council adopt an ordinance vacating the north-
easterly portion of an emergency access and utility easement (private street)
known as "Via Villani" and all of two emergency access and utility easements
(private streets) known as "Via Palermo" and "Via Bologna", along with adjacent
utility easements described as two 10' x 10' water meter easements, two 10` x 10'
fire hydrant easements, and one 5' x 10' water meter easements, all as recorded
in Volume 388-180, Pages 92 and 93, P.R.T.C.T.
DISCUSSION
Carter & Burgess, Inc., on behalf of Stonegate Garden Multifamily No. 2 LTD., a
Texas Partnership, and Hulen Joint Venture, a Texas Joint Venture, as a General
Partner, owners of all abutting property, have requested that the City vacate the
above-described easements, as shown on the attached map.
The subject easements, acquired by dedication, are platted and contain water uti-
lity facilities. The subject vacation request is made in order to replat the
vacated easements with adjacent property, to expand the building area, provide
more usable yard space and readjust the location of the subject easements with a
replat of the subject property.
The required and appropriate monetary consideration has been placed in escrow
with the Real Property Department, as required by the Land Agent for the City of
Fort Worth.
Reviewing City departments and private utility companies have raised no objec-
tions to this request, subject to the vacated easements being replatted with
adjacent property. A satisfactory replat has been submitted.
