ORDINANCE N0. ____~ t~° ORDINANCE ACCEPTING IMPROVEMENTS ON A PORTION OF KEMBLE STREET AND SOMERSET DRIVE AND PORTIONS OF SUNDRY OTHER S7.'REETS, AVENUES AND PUBLIC PLACES IN THE CITY OF FORT WORTH, TEXAS; DECLARING THE CONTRACT WITH IAWELL B. ALLISON CONTRACTOR, INC. Ft~R THE CONSTRUCTION OF SAID IMPROVEMEDfl'S FULLY COMPLETED AND PERFORMED; DIRECTING THE ISSUANCE, EXECUTION AND DELIVERY OF CERTIFICATES IN EVIDENCE OF SPECIAL ASSESSMEDYrS LEVIED AFTER GIVING EFFECT TO SUNDRY CRIDITS HEREIN AUTHORIZID AND ALIAWED AGAINST SOME OF SAID ASSESSMENTS; DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY OOPYING THE CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL OF FORT WORTH, TEXAS, AND BY FILING THE COMPLETE ORDINANCE IN APPROPRIATE ORDINANCE RECORDS OF SAID CITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Fort Worth, Texas has heretofore entered into a contract with State Department of Highways and Public Transportation, for the making and construction of certain street ianprovements on the hereinafter described portions of streets, avenues and public places in said City, to wit: KEMBLE STREET Frown Shilling Drive eastward to Cul-de-sac, (UNIT I) known and designated as Project No. 29-024312-00, Unit I, a six-inch thick hot-mix asphaltic concrete pavement with seven-inch high concrete curb and eighteen-inch wide concrete gutter on an eight-inch thick lime stabilized subgrade, so that the finished road- way will be twenty-four feet wide and ending with an eight-feet wide cul-de-sac. Six-inch thick reinforced concrete driveway approaches will be constructed where required. SOMERSET DRIVE From Normandy Drive southward to Martha Lane, (UNIT II) known and' designated as Project No. 29-024312-00, Unit II, a seven-inch thick high concrete curb and eighteen-inch wide concrete gutter on a two-inch thick sand cushion with hot-mix asphaltic concrete tie-in to the existing pavement on the east side of the street only. Additionally, the entire roadway will be resurfaced with a new two-inch thick hot-mix asphaltic concrete overlay so that the finished roadway will be thirty-six feet wide. Six-inch thick reinforced concrete driveway approaches will be constructed where required. -1- WHEREAS, by sundry proceedings heretofore passed by the City Council of the City of Fort Worth, Texas, including Ordinance No. 9568 , a portion of the cost of said improvements was levied and assessed against the respective properties abutting on each of the above described portions of streets, avenues and public places and against the real and true owners thereof; and, WE~REAS, the City Council of the City of Fort Worth, Texas, has, upon review, found and determined that, in some instances, in order to effect substantial justice and equality, it is desirable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance No. 9568 , and WI~REA.S, the street improvements hereinabove mentioned have been completed upon each of the portions of streets, avenues and public places hereinabove described, and have been inspected and found to be in complete accordance with the contract therefore; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT: I. The improvements on each of the portions of streets, avenues and public places hereinabove described be, and they are hereby, accepted; and the contract with reference thereto be, and it is hereby, found and declared fully complete and performed. II. The Mayor, be, and he is hereby, directed to issue and execute in the name of the City, certificates in evidence of the special assesments levied against abutting property and the owners thereof for such improvements, and the City Secretary is directed to attest same and impress thereon the corporate seal of the City, all in accordance with the proceedings relating to such improvements and assessments. The certificates shall be numbered, shall describe the property against which the assessment has been levied, shall, where known, state the name or names of the true owners of the respective parcels of property assessed and shall be issued in an amount equal to the difference between the principal amount of the assessment and the amounts of any credit issued thereon. The numbers of the certificates, with the property descriptions to be shown on the respective certificates, together with the names of the owners of said property, the principal amount of the assessment, the respective credits, if any which are hereby authorized, granted and allowed against the principal amount of some one or more of the assessments heretofore levied, and the principal amount for which each certificate is to be issued after giving effect to such credit, if any, are hereby enumerated and itemized as follows: -2- " r III. When each of the certificates has been duly executed as hereinabove provided, same shall be delivered to the Tax Assessor-Collector as part payment of the contract price. VI. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council of Fort Worth, Texas, and by filing the complete ordinance in the appropriate Ordinance Records of said City. The underrun amount is th e result of liquidated damages and differences between quantities estimated for the contract documents and quantities actually used to complete the work. FINANCING Sufficient funds are available in Street Improvements Fund 29, Retainage Account No. 205014848 and Encumbrance Contract No. 14848A to finance this final payment. COMPLIANCE WITH SPECIFICATIONS The project has been completed in accordance with the requirements of the contract.
