ORDINANCE NO.
AN ORDINANCE DECREASING THE UNDESIGNATED FUND BALANCE OF
THE GENERAL FUND OF THE CITY OF FORT WORTH FOR FISCAL YEAR
1986-1987 BY $20,000 AND APPROPRIATING SAID SUM TO ACCOUNT
NO. 20-10-00, TRANSPORTATION AND PUBLIC WORKS, FOR THE
PURPOSE OF RETAINING THE FIRM OF VINSON AND ELKINS AS
COUNSEL ON MATTERS PERTAINING TO THE SOUTHWEST FREEWAY;
PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDI-
NANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL
PRIOR ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR
ENGROSSMENT AND ENROLLMENTS AND PROVIDING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS
SECTION 1.
That the undesignated General Fund balance of the General Fund
of the City of Fort Worth for fiscal year 1986-1987 is hereby de-
creased by appropriating $20,000 from said fund to Account No.
20-10-00, Transportation and Public Works, to provide funds for

retaining the firm of Vinson and Elkins, to assist the City in
matters pertaining to the- financing and construction of the
Southwest Freeway and other matters.
SECT ION 2.
Should any portion, section or part of a section of this ordi-
nance be declared invalid, inoperative or void for any reason by a
court of competent jurisdiction, such decision, opinion or judgment
shall in no way impair the remaining portions, sections or parts of
sections of this ordinance, which said remaining provisions shall be

SECTION 3 .
That this ordinance shall be cumulative of Ordinance No. 9690
and all other ordinances and appropriations amending the same except
in those instances where the provisions of this ordinance are in
direct conflict with such other ordinances and appropriations, in
which instances said conflicting provisions are hereby expressly re-
pealed.
SECT ION 4 .
The City Secretary of the City of Fort Worth is hereby directed
to engross and enroll this ordinance by copying the caption and
effective date of this ordinance in the minutes of the City Council
and by filing the ordinance in the ordinance records of the City.
SECTION 5 .
That this ordinance shall take effect and be in f ull force and
effect from and after the date of its passage, and it is so or-
dained.

Recommendation
It is recommended that the City Council
1 Adopt the attached resolution authorizing the employment of Vinson &
Elkins, attorneys at law, as outside counsel to provide special expertise
and assistance to the City Attorney with regard to the financing and con-
struction of the Southwest Freeway and -other projects that may arise from
time to time
2 Adopt the attached supplemental appropriations ordinance appropriating the
amount of $20,000 to the General Fund No O1, Transportation and Public
Works Account No ?_0-10-00, Index Code 230284 This will result in a
$20,000 increase in appropriations and a subsequent decrease in the
General Fund's unrestricted, undesignated fund balance
Background
As reported to the City Council in Informal Report 7151 (August 5, 1986), the
construction of the Southwest Freeway from S H 121 (Airport Freeway) south to
F M 1187 is contingent upon many cornplex factors The City is currently con-
sidering several alternative methods for development and financing of the fr~e-
way, including methods authorized under the following acts
1 Texas Transportation Corporation Act (Art 15281, Tex Rev Civ St at )
2 Road Utility District Act (Art 667r-1 (Tex Rev. Civ St at )
3 Count y Road District (County Road and Bridge Act, Sec 4 411, Art 6702-1,
Tex Rev C i v St at )
4 Toll Road Authority (Texas Turnpike Authority Act, Art 6674V, Tex Rev.
Civ St at )
Mr. Bob Randolph, an attorney with the law firm of Vinson & Elkins in Houston,
Texas, possesses great expertise and experience in matters regarding the
development and financing of highway projects The City Manager and the City
Attorney recommend that Mr Randolph be retained to advise the City with regard
to the development of transportation financing and construction options,
including legislative matters, at both the federal and state levels, It is
anticipated that Mr Randolph's expertise will be valuable to the City both
with regard to the Southwest Freeway and also with regard to other projects
which may arise
Financing
A supplemental appropriation will be necessary in the General Fund Number O1,
Transportation and Public Works Account No 20-10-00 to fund this project This

will result in an increase in appropriations to said account and a decrease in
the General Fund's undesignated fund balance The expenditure will be made from
Index Code 230284 The General Fund unrestricted, undesignated fund balance
will be $23,844,835 after this supple mental appropriation action
