ORDINANCE NO. /L 7
AN OR DINANCE VACATING, ABANDONING, AND CLOSING AND EXTIN-
GUISHING A PORTION OF BRENTWOOD STAIR ROAD RIGHT-OF-WAY AS
MORE SPECIFICALLY DESCRIBED HEREIN; PROVIDING FOR REVER-
SION OF FEE IN SAID LAND(5); REPEALING ALL OR DINANCES IN
CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE.
BE IT OR DAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
THAT THE portion of the right-of-way of Brentwood Stair Road
lying adjacent to Tract 1, T.K. Hamby Survey, Tarrant County, Texas, v
said vacated portion being described more specifically in
Exhibit "A" attached hereto and incorporated by reference. herein for
all purposes be and the same is vacated, abandoned, and permanently
closed and extinguished.
SECTION 2.
That the fee to the land(s) in the above described vacated
portion of the right-of-way of Brentwood Stair Road is hereby
released and shall revert to the adjacent owner(s) as provided by
law, SAVE AND EXCEPT that easements are retained for any and all
existing and prospective utilities and any and all existing and
prospective drainage and surface water run-off easements required by
the City of Fort Worth, as necessary.
SECTION 3.
That all ordinances or parts of ordinances in conflict herewith
are hereby repealed.

That this ordinance shall take effect and be in full force and
effect from and after the date of its passage, and it is so or-
dained.

FIELD NOTES
Being a 0.0523 acre tract of land out of the T.K. Hamby Survey as recorded in
Deed Records, Volume 6438, Page 410, Tarrant County, Texas;
BEGINNING at an iron pin in the southeast corner of the T.K. Hamby Survey, said
pin also being the northeast corner of the described property;
THENCE south O1°, O1' east for a distance of 35.64 feet to an iron pin at a
point on a nontangent curve to the left rose long chord bears north T7° 25'
20" nest for a chord distance of 152.17 feet;
THENCE along, the curve to the left having a radius of 820.31 feet and an arc
length of 152.39 feet;
THENCE north 89° 02' east for a distance of 147.91 feet to the Point of
BEGINNING and containing 0.0523 acres 42,216.94 square feet of land:

It is recommended that the City Council adopt an ordinance vacating a triangular
shaped portion of Brentwood Stair Road right-of-way located easterly of the
intersection of Brentwood Stair Road & "T" Square Street, in the 8300 block of
Brentwood Stair Road along the north side of the subject road adjacent to Tract
1, T.K. Hamby Survey, and immediately west of the D.C. Harrison Survey, A-650, as
recommended by the City Plan Commission.
DISCUSSION:
E.T. Square Investors, owner of abutting property, has requested that the City
vacate the above described portion of street right-of-way, as shown on the
attached map.
The subject street right-of-way, acquired by dedication, is unimproved, but
contains a telephone utility line for which the responsible entity has requested
that an appropriate easement be retained. The subject vacation request is made
in order to replat the vacated right-of-way with adjacent property, to expand the
building area, and provide more usable yard space.
The required and appropriate monetary consideration has been placed in escrow
with the Real Property Mangement Department, as required by the Land Agent for
the City of Fort Worth.
Reviewing City departments and private utility companies have raised no
objections to this request, subject to the vacated right-of-way being replatted
with adjacent property, including retention of the required utility easement. A
satisfactory replat has been submitted.
