ORDINANCE NO.
AN ORDINANCE PERMITTING SHERMAN L. WILSON, HIS HEIRS
AND ASSIGNS, TO LEAVE THE EXISTING BUILDING FOR A
MAXIMUM DISTANCE OF TWO FEET AS IT IS NOW LOCATED IN
EVANS AVENUE FOR SOME TWELVE FEET ALONG THE WEST
LINE OF LOT 580, BLOCK 22, HYDE PARK ADDITION TO THE
CITY OF FORT WORTH, TARRANT COUNTY, TEXAS ; AND PRO-
VIDING THAT THIS ORDINANCE SHALL BECOME EFFECTIVE
IMMEDIATELY.
WHEREAS, Sherman L. Wilson is the owner of Lot 580, Block
22, Hyde Park Addition to the City of Fort Worth, Tarrant
County, Texas, along the west side of which a property en-
croachment exists in Evans Avenue; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS :
SECTION 1.
That Sherman L. Wilson, the owner of said land above de-
scribed and the improvements situated thereon, and his heirs
and assigns, be permitted to leave the existing building for
a maximum distance of two feet as said building now exists in
Evans Avenue for some twelve feet along the west line of said
Lot 580; and that said improvements on said above described
real property be allowed to stand during the life of said
building as the same is now constructed, provided, however,
that in the event such building be demolished or major alter-
ations and repairs be made to said building in the future,
said building shall be reconstructed or repaired so as not to
the public in and to the property encroached upon by the exist-
ing building in the event the City Council may determine to
devote the property encroached upon to public use.
SECTION 2 .
That this ordinance shall take effect and be in full
force and effect from and after the date of its passage, and
it is so ordained.

On November 13, 1972, (M&C L-4170) the City Council approved the acquisi-
VALKES tion of a strip of land from the front and south side of Lot 580, Block 22,
Hyde Park Addition, including improvements thereon, required for right-of-
way for the widening and improvement of Allen Avenue at Evans Avenue.
The owner, Sherman L. Wilson, removed from the Allen Avenue right-of-way
that part of the building within the taking. The remaining portion of
the building, which is used as a beauty shop, encroaches approximately
two feet onto the right-of-way of Evans Avenue for a distance of twelve
feet. Mr. Wilson contemplates removing all of the now existing improve-
ments soon after the street improvements are completed and rebuild with a
new commercial building.
To permit the encroachment of the existing building onto the Evans Avenue
right-of-way until such time as the entire building is removed, Mr. Wilson
has requested that the City enact an ordinance therefor.
It is recommended that an ordinance be adopted granting a 2 feet by 12 feet
encroachment onto Evans Avenue for an existing building on Lot 580, Block 22,
Hyde Park Addition, for the remaining life of the building, subject to
revocation at any time the City Council determines that the encroached land
is needed for public purposes.
