AN ORDINANCE VACATING, ABANDONING, AND CLOSING AND EXTIN- GUISHING A TEN-FOOT ( 1 0' ) UTILITY EASEMENT LOCATED WITHIN LOT 10, BLOCK 13 OF THE J. S. SMITH ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS, SATD EASEMENT BEING DESCRIBED MORE SPECIFICALLY HEREIN; PROVIDING FOR REVER- SION OF FEE IN SAID LAND(S); REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECT ION 1 . That the ten-foot (10') by twenty-foot_(20') utility easement located within, adjacent to, and along the south lot line of Lot 10, Block 13 of the J. S. Smith Addition of the City of Fort Worth, Texas, said utility easement being described more specifically in Exhibit "A" which is attached hereto and incorporated herein by reference, be and the same is hereby vacated, abandoned and perma- nently closed and extinguished. SECTION 2 . That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 3 . That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so or- dained. S. SMITH ADDITION, to the City of Fort Worth recorded in Volume 204-A, Page 118, of the Deed Records, Tarrant County, Texas. Said strip of land being an easement granted to the City of Fort Worth and recorded in Volume 3826, Page 139, of the Deed Records of Tarrant County, Texas, and being more particularly described as follows: BEGINNING at a point in the South line of said Lot 10, also being the North line of a 10-foot alley, and lying West 8.0 feet from the Southeast corner of said Lot 10; THENCE NORTH 10.00 feet and parallel t:o the East line of said Lot 10 to a point; THENCE WEST 20.00 feet and parallel to the South line of said Lot 10 to a point; THENCE SOUTH 10.00 feet and parallel t:o the East line of said Lot 10 to a point in the South line thereof ; THENCE EAST 20.00 feet along the South line of said Lot 10 and the North line of the aforesaid 10-foot alley to the POINT OF BEGINNING, containing 200 square feet of land. Smith's Addition, Block 13, - for-1 L~-l~-Et~~4a~-arr `-~t , 4050 South Freeway Service Road RECOPIPIENDATION It is recommended that the City Council adopt an ordinance vacating a 10' X 20' utility easement located adjacent to and along the south lot line of Lot 10, Block 13, J.S. Smith's Addition, as recorded in Volume 204-A, Page 118, D.R.T.C.T., said strip of land being an easement granted to the City of Fort Worth, as recorded in Volume 3826, Page 139, D.R.T.C.T. DISCUSSION Jack Carson, owner of abutting property, has requested that the City vacate the above-described easement, as shown on the attached map. The subject easement, acquired by dedication, is platted but contains no utility facilities. The subject vacation request is nnade in order t o utilize the vacated easement area as part of the subject property, thus expanding the building area and providing more usable yard space. The required and appropriate monetary consideration has been placed in escrow with the Real Property Department, as required by the Land Agent for the City of Fort Worth. Reviewing City departments and private utility companies have raised no ob- jections to this request.
