ORDINANCE N0.
AN ORDINANCE DEANNEXING AND DISCONTINUING TERRITORY FROM WITHIN THE
CORPORATE LIMITS OF THE CITY OF FORT WORTH, TEXAS, PROVIDING THAT THIS
ORDINANCE SHALL AMEND EVERY PRIOR ORDINANCE IN DIRECT CONFLICT
HEREWITH, PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL
PRIOR ORDINANCES NOT IN DIRECT CONFLICT, AND PROVIDING FOR
SEVERABILITY AND NAMING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS
SECTION I.
That the hereinafter described territory within the corporate limits of the
City of Fort Worth, Texas, be and the same is hereby deannexed and discontinued
as a part of the City of Fort Worth, Texas, said territory being tracts of land
out of the E. Taylor Survey, Abstract No. 1560 and G.H. & R.R. Co. Survey,
Abstract No. 624, and being more particularly described by metes and bounds as
follows
TRACT I, TRINITY RANCH
BEING a tract of land situated in the E. Taylor Survey, Abstract No.
1560, and in the City of Fort Worth, Tarrant County, Texas, and being
a part of a tract of land conveyed to Trinity Ranch Joint Venture by
deed recorded in Volume 7887, Page 705, of the Deed Records of Tarrant
County, Texas, said tract being more particularly described as
follows:
BEGINNING at a point, said point being the point of intersection of
the westerly right-of-way line of R.M. 2871 with the Fort
Worth-Benbrook city limit boundary line,
THENCE and along the boundary line, North 89° 49' 23" West for a
distance of 889.43 feet to a point for corner, said point being a
point of curvature of a curve to the right having a chord bearing and
distance of North 49° 55' S4" East, 151.34 feet, a central angle of
06° 11' 16", a radius of 1402.04 feet, and a tangent of 75.78 feet,
THENCE and leaving said boundary line and along said curve an arc
distance of 151.42 feet to a point of tangency,
THENCE North 53° O1' 32" East, for a distance of 405.53 feet to a
point for corner, said point being on the westerly right-of-way line
of R.M. 2871,
THENCE and along the westerly right-of-way line of R.M. 2871, South
70° 46' 06" East, for a distance of 179.09 feet to a point for corner,
said point being the point of curvature of a curve to the left having
a chord bearing of South 44° 32' 19" East, 399.96 feet, a central
angle of 09° 29' 31", a radius of 2417.01 feet, and a tangent of
200.67 feet,

CONTAINING 167,879.89 square feet or 3.8540 acres of land.
TRACT II, TRINITY RANCH
BEING a tract of land situated in the G.H. & H. R.R. CO. Survey,
Abstract No. 624, and in the City of Fort Worth, Tarrant County,
Texas, and being a part of a tract of land conveyed to Trinity Ranch
Joint Venture by deed recorded in Volume 7887, Page 705, of the Deed
of Records of Tarrant County, Texas, said tract being more
particularly described as follows
BEGINNING at a point, said point being the point of intersection of
the southerly right-of-way line of U.S. Hwy 377 with the Fort
Worth-Benbrook city limit boundary line,
THENCE and along the boundary line, South 89° 58' 27" East for a
distance of 1297.82 feet to a point for corner, said point being a
point of .curvature of a curve to the left having a chord bearing and
distance of South 330 40' 09" West, 41.96 feet, a central angle of 020
31' 42", a radius of 950.89 feet, and a tangent of 20.98 feet,
THENCE and leaving said boundary line, and along said curve an arc
distance of 41.96 feet to a point of tangency,
THENCE South 32° 24' 18" West, for a distance of 100.00 feet to a
point of curvature of a curve to the right having a central angle of
12° 56' 27", a radius of 2225.35 feet, and a tangent of 252.38 feet,
THENCE and along said curve an arc distance of 502.62 feet to a point
for corner,
THENCE North 43° 52' S4" West, for a distance of 39.55 feet to a point
of curvature of a curve to the left having a central angle of 32° 03'
50", a radius of 1030.00 feet, and a tangent of 295.97 feet,
THENCE and along said curve an arc distance of 576.41 feet to a point
of reverse curvature of a curve to the right having a central angle of
25° 50' 02", a radius of 970.00 feet, and a tangent of 222.46 feet,
THENCE and along said curve an arc distance of 437.36 feet to the
POINT OF BEGINNING,
CONTAINING 318,643.32 square feet or 7.3150 acres of land.
SECTION 2.
That this ordinance shall and does hereby amend every prior ordinance in
direct conflict herewith, but as to all other ordinances or sections of
ordinances not in direct conflict herewith, this ordinance shall and the same is
hereby made cumulative.

SECTION 3.
That it is hereby declared to be the intent of the City Council that the
sections, paragraphs, sentences, clauses and phrases of this ordinance are
severable, and if any phase, clause, sentence, or paragraph or section of this
ordinance shall be declared unconstitutional by the valid judgment or decree of
any court of competent jurisdiction, such unconstitutionality shall not affect
any of the remaining phrases, clauses, sentences, paragraphs and sections of
this ordinance, since the same would have been enacted by the City Council
without the incorporation in this ordinance of any such unconstitutional phrase,
sentence, paragraph or section.
SECTION 4.
That this ordinance shall be in full force and effect from and after the
date of its publication and passage on second reading as provided for in Section
35 of Chapter XXVII of the Charter of the City of Fort Worth, Texas, and it is
so ordained.

RECOMMENDATION
It is recommended that the City Council adopt on first reading the attached
disannexation ordinance.
DISCUSSION
On January 15, 1985, the City Council adopted the Trinity Ranch Annexation
Ordinance on second and final reading. On April 8, 1985, the City of Fort
Worth received a formal request from Trinity Development to adjust the proposed
development's boundaries. This request meant that the City of Fort Worth and
the City of Benbrook must annex and disannex certain properties in order to
conform to the development's proposed thoroughfare system and 1"and use
categories.
On May 29, 1985, the City Plan Commission approved the proposed City limit
boundary adjustment with the City of Benbrook. On June 25, 1985, the Fort
Worth City Council approved the Joint Resolution and Agreement which described
the areas to be annexed and disannexed by both cities. On August 27 1985 the

However, because of an oversight, the intent to disannex said propert,~ was not
published in the newspaper nor posted on the site as required by Article 970a
of the Revised Civil Statutes of the State of Texas prior to the submission of
the formal disannexation request. Therefore, the disannexation ordinance, as
approved on August 27, 1985, was invalid.
In order to fulfill the requirements of both Article 970a and the Fort Worth
City Charter, the disannexation ordinance must be adopted on first reading by
the City Council. The ordinance will then be published in the newspaper, and
at least thirty (30) days thereafter, it will be presented to the City Council
for second and final adoption.
